It happened again on Thursday when President Joe Biden announced the first phase his executive gun control actions.<\/p>\n<p><span>\u201cMost people don\u2019t know you walk into a store, you have a background check. You go to a gun show, you can buy whatever you want with no background check,\u201d Biden said during Thursday\u2019s press conference.&nbsp;<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"5.7226277372263\">\n<p lang=\"en\" dir=\"ltr\">Biden says background checks aren\u2019t used at gun shows. That is false.  <a href=\"https:\/\/t.co\/jfkvfvrLjX\">pic.twitter.com\/jfkvfvrLjX<\/a><\/p>\n<p>\u2014 Beth Baumann (@eb454) <a href=\"https:\/\/twitter.com\/eb454\/status\/1380206745117593600?ref_src=twsrc%5Etfw\">April 8, 2021<\/a><\/p>\n<\/blockquote>\n<p>The reality is quite different.<\/p>\n<p><span>The majority of sellers at gun shows are Federal Firearms Licensees (FFLs), and are required to conduct a background check every time they sell a firearm. It doesn\u2019t matter if the sale takes place at a brick and mortar store or a gun show. A seller has to go through the entire <\/span><a href=\"https:\/\/www.dailywire.com\/news\/dont-believe-the-left-purchasing-a-firearm-is-far-more-complex-than-voting\"><span>process<\/span><\/a><span> of purchasing the firearm, which includes filling out the ATF\u2019s 4473 form, which includes information like the person\u2019s full name, social security number, driver\u2019s license number, and address. The bottom of the form has a number of questions that are used to determine whether or not a person is prohibited from owning a firearm. Being an illegal alien, dishonorably discharged from the military, or a drug user are all reasons someone would be denied a sale. The answers are generally based on the honor system, unless criminal convictions are flagged during the background check.&nbsp;<\/span><\/p>\n<p><span>The FFL then inputs that information into the National Instant Criminal Background Check System (NICS). NICS will tell the FFL whether or not to proceed with the sale. If there is something in the buyer\u2019s past that would prohibit them from purchasing the gun, like a criminal conviction, the sale is denied.<\/span><\/p>\n<p>Failing to provide truthful answers on a 4473 form can result in fines up to $250,000 and\/or 10 years in prison.<\/p>\n<p><span>In some states, Private Party Transfers (PPTs) take place. This is where two private citizens buy and sell guns to one another. A background check is not required to complete this process but it is federally regulated.<\/span><\/p>\n<p>Under&nbsp;<a href=\"https:\/\/www.atf.gov\/firearms\/qa\/whom-may-unlicensed-person-transfer-firearms-under-gca\" target=\"_blank\" rel=\"noopener noreferrer\">current law<\/a>, two private parties can transfer firearms to one another without going through an FFL \u201cprovided the transferor does not know or have reasonable cause to believe the transferee is prohibited from receiving or possessing firearms under federal law.\u201d Some states, however, require citizens to obtain the transfer through an FFL.<\/p>\n<p>If a PPT is taking place between two parties in two different states, both the buyer and seller have to conduct the transfer through an FFL. PPTs are most common between family members, particularly parents and their kids, and close family friends.<\/p>\n<p>Press Secretary Jen Psaki was forced to address Biden\u2019s blatant lies about the \u201cgun show loophole\u201d during her press conference later in the day.<\/p>\n<p>\u201cThe president said in a moment ago, \u2018You go to a<span> gun show, you can buy whatever you want, no background check.\u2019 Is there a special exemption in federal law that he\u2019s referring to, or do FFLs not have to do background checks when they\u2019re at a gun show?\u201d Real Clear Politics\u2019 Philip Wegmann asked.&nbsp;<\/span><\/p>\n<p>Psaki asked Webmann to clarify his question.<\/p>\n<p>\u201cI mean, is it the president\u2019s belief that you do not have to undergo a background check when you are at a gun show?\u201d the reporter asked.<\/p>\n<p>\u201cNo, that\u2019s not his belief,\u201d Psaki said, contradicting Biden\u2019s previous claims. \u201cHe believes background checks should be universal.\u201d<\/p>\n<p>The reporter reminded Psaki that Biden said \u201cno background check\u201d takes place at gun shows. She replied by saying, \u201cWell, we know what his position is, right? So let me reiterate that. Background checks are something that should be universal. They\u2019re supported by more than 80 percent of the public. He\u2019s supported legislation, advocated for that, and advocated against loopholes as well and so that\u2019s his position.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"8.3038869257951\">\n<p lang=\"en\" dir=\"ltr\">REPORTER: &#8220;Is it the president&#8217;s belief that you do not have to undergo a background check when you are at a gun show?&#8221;<a href=\"https:\/\/twitter.com\/PressSec?ref_src=twsrc%5Etfw\">@PressSec<\/a>: &#8220;No it&#8217;s not his belief. He believes that background checks should be universal.&#8221; <a href=\"https:\/\/t.co\/CBXGhsI6Bk\">pic.twitter.com\/CBXGhsI6Bk<\/a><\/p>\n<p>\u2014 Daily Caller (@DailyCaller) <a href=\"https:\/\/twitter.com\/DailyCaller\/status\/1380213173664505856?ref_src=twsrc%5Etfw\">April 8, 2021<\/a><\/p>\n<\/blockquote>\n<p>Federal firearm laws are not tossed out of the window simply because an FFL is stationed in a gun show, rather than a store. The same laws still apply, regardless of where they sell a gun, with each transaction requiring a background check.<\/p>\n<p>The important factor to understand is that what both Biden and Psaki mean by \u201cuniversal background checks\u201d is the construction of a system which regulates private party transfers. The only way to create a so-called \u201cuniversal background check\u201d is to create a firearms registry, something some Second Amendment advocates believe could lead to firearm confiscation.<\/p>\n<p><em>Beth Baumann is a Political Reporter at The Daily Wire.
