Johnny Mercil, who was in charge of use-of-force training at the time of Floyd\u2019s arrest, caused a number of problems for the prosecution this week, including when defense attorney Eric Nelson showed Mercil images of bystanders and quoted their language toward Chauvin during the arrest.<\/p>\n<p>After Mercil notably confirmed that Chauvin did not have Floyd in a \u201cneck restraint\u201d while he was detaining him, Nelson asked the use-of-force expert if an officer\u2019s environment would affect how long he restrains a suspect. Mercil answered \u201cyes.\u201d<\/p>\n<p>If bystanders were \u201ccheering\u201d on the officer, Nelson outlined, that\u2019d be one thing. But \u201cif they were saying, I\u2019d slap the f*** out of you, or, you\u2019re a p****, or, you\u2019re a chump, would that reasonably tend to raise alarm to the police officer?\u201d<\/p>\n<p>\u201cYes, sir,\u201d Mercil responded.<\/p>\n<p>Nelson also showed an image of one male bystander being physically restrained by another bystander while hurling threats. Mercil agreed this was taking place in the image, again strengthening the defense\u2019s argument.<\/p>\n<p>Attorney Andrew Branca for Law of Self Defense, <a href=\"https:\/\/legalinsurrection.com\/2021\/04\/chauvin-trial-day-7-wrap-up-a-horrible-day-for-the-prosecution\/\">writing<\/a> at Legal Insurrection, outlined the exchange between Nelson and Mercil as follows:<\/p>\n<blockquote readability=\"15\">\n<p><em>Would the threat of imminent physical violence from bystanders be a sufficient reason to maintain restraint on a suspect? If the crowd is shouting that they\u2019re going to slap the \u201cF\u201d out of you, that you\u2019re a \u201cp-word,\u201d that you\u2019re a bum, would that be sufficient to cause the officers to be alarmed about the prospect of imminent physical violence from the bystanders?<\/em><\/p>\n<p><em>Yes, Mercil answered, it would.<\/em><\/p>\n<\/blockquote>\n<p>Notably, the prosecution then asked Mercil if bystanders\u2019 repeated comments about Chauvin\u2019s use of force, such as someone yelling, \u201cyou\u2019re killing him,\u201d would trigger an officer to reexamine his position.<\/p>\n<p>Mercil agreed that \u201cpotentially\u201d that might be the case.<\/p>\n<p>Chauvin, 45, is currently on trial for&nbsp;second-degree murder, third-degree murder, and second-degree manslaughter in relation to Floyd\u2019s death. The former officer&nbsp;can be found guilty of all, some, or none of the charges since they are all separate.<\/p>\n<p>Since he has no criminal history, Chauvin is likely looking at \u201cserving about 12 1\/2 years whether he is convicted of second or third-degree murder,\u201d <a href=\"https:\/\/apnews.com\/article\/derek-chauvin-trial-murder-charge-explained-5e7c935f560219caee61fcc0bef0a23d\">according<\/a> to The Associated Press.
