The specificity of court trials is what separates our system from the witch trials of the past. By diluting \u2014 or even removing \u2014 Derek Chauvin from the case, Crump and Sharpton are trying to alter the question posed to the court.<\/span><\/p>\n<p><span>Chauvin is not on trial in place of America, and cannot be sacrificed as such by bypassing the structure of our lawful justice system.<\/span><\/p>\n<p><b>There is still no evidence of racism<\/b><\/p>\n<p><span>Beyond the fact that George Floyd was black and Derek Chauvin was white, there has been no evidence presented publicly that Chauvin is a racist, or that he targeted Floyd in a racist manner, or that any of the subsequent events were motivated by racism.<\/span><\/p>\n<p><span>The existence of racism \u2014 though often reported as fact \u2014 has simply been assumed.<\/span><\/p>\n<p><b>George Floyd\u2019s autopsy<\/b><\/p>\n<p><span>Central to the accusations leveled against Chauvin is the claim that he caused Floyd\u2019s death. As <a href=\"https:\/\/www.dailywire.com\/news\/shapiro-no-the-derek-chauvin-trial-isnt-a-referendum-on-american-racism\">noted<\/a> by Ben Shapiro, Floyd\u2019s \u201cautopsy report shows that Floyd had fentanyl and methamphetamine in his system and had a serious heart problem, and that Chauvin\u2019s neck hold did not in fact cause damage to Floyd\u2019s trachea.\u201d<\/span><\/p>\n<p><span>\u201cThat means that while Chauvin\u2019s neck restraint may have contributed to Floyd\u2019s death by ratcheting up his blood pressure, for example, it\u2019s uncertain that it caused Floyd\u2019s death more than, say, the excited delirium from which Floyd may have already been suffering,\u201d Shapiro noted.<\/span><\/p>\n<p><span>These medical facts are critical components of the case both against and in defense of Chauvin, and any argument which disregards them is either ignorant or deeply cynical.<\/span><\/p>\n<p><b>Minneapolis Police Department policy may have included the knee hold Chauvin used<\/b><\/p>\n<p><span>While Minneapolis Police Department (MPD) Chief Medaria Arradondo has <\/span><a href=\"https:\/\/www.kare11.com\/article\/news\/local\/george-floyd\/minneapolis-police-training-materials-show-knee-to-neck-restraint-similar-to-used-on-george-floyd\/89-9f002e3f-972a-4410-86cb-50a1237fc496\"><span>argued<\/span><\/a><span> that \u201cofficers are not trained to place their knee on a suspect\u2019s neck like Chauvin did to Floyd,\u201d former MPD officer Thomas Lane produced department training materials which included \u201cinformation on a restraint called the \u2018maximal restraint technique,\u2019 and a photo of an officer with his knee to a suspect\u2019s neck similar to the hold used by former officer Derek Chauvin on Floyd.\u201d<\/span><\/p>\n<p><span>\u201cThe training materials specify: \u2018the maximal restraint technique shall only be used in situations where handcuffed subjects are combative and still pose a threat to themselves, officers or others, or could cause significant damage to property if not properly restrained,\u2019\u201d the report adds.<\/span><\/p>\n<p><b>The charges leveled against Chauvin are hard to prove<\/b><\/p>\n<p><span>Chauvin is <\/span><a href=\"https:\/\/www.dailywire.com\/news\/the-charges-facing-derek-chauvin-and-what-it-will-take-to-convict-him\"><span>charged<\/span><\/a><span> with second degree murder, third degree murder, and second degree manslaughter.<\/span><\/p>\n<p><span>In order to find Chauvin guilty of second degree murder, the prosecution will need to demonstrate one of the following:<\/span><\/p>\n<ol>\n<li><span>That Chauvin caused the death of George Floyd intentionally but without premeditation.<\/span><\/li>\n<li><span>That Chauvin caused the death of George Floyd without intending to kill him while \u201ccommitting or attempting to commit a felony offense other than criminal sexual conduct in the first or second degree with force or violence.\u201d<\/span><\/li>\n<li><span>That Chauvin caused the death of George Floyd without intending to kill him \u201cwhile intentionally inflicting or attempting to inflict bodily harm upon the victim,\u201d while Floyd was \u201crestrained under an order for protection and the victim is a person designated to receive protection under the order.\u201d<\/span><\/li>\n<\/ol>\n<p><span>In order to find Chauvin guilty of third degree murder, the prosecution will need to demonstrate that \u201cChauvin\u2019s action (or actions) were \u2018eminently dangerous to others and evincing a depraved mind,\u2019 and displayed a disregard for human life.\u201d<\/span><\/p>\n<p><span>In order to find Chauvin guilty of second degree manslaughter, the prosecution will need to demonstrate that \u201cGeorge Floyd\u2019s death was the result of Chauvin\u2019s culpable negligence and that Chauvin created an unreasonable risk and consciously took chances of causing death or great bodily harm.\u201d<\/span><\/p>\n<p><span>Of these charges, second degree manslaughter is the only conviction which seems likely given the clear existence of reasonable doubt. Given that it appears that the knee hold in question was part of MPD training materials, the argument that Chauvin\u2019s actions were lawful \u2014 not moral \u2014 examples of culpable negligence is increasingly thin.<\/span><\/p>\n<p><b>The Left have constructed a \u201cwin-win\u201d scenario<\/b><\/p>\n<p><span>The brutal reality is that the Left have constructed a \u201cwin-win\u201d scenario regarding Derek Chauvin, by disregarding the facts of the case and billing it as a referendum on more than Chauvin\u2019s alleged crimes.<\/span><\/p>\n<p><span>If Chauvin is convicted, then Crump, Sharpton and the Black Lives Matter movement can celebrate a victory in the battle against systemic police violence.<\/span><\/p>\n<p><span>If Chauvin is acquitted, then this will be used as further evidence of the depth of the problem of systemic police violence and racism, providing figures like Sharpton with further ideological ammunition.<\/span><\/p>\n<p><span>***<\/span><\/p>\n<p><span>The purpose of the court system is to pursue and achieve justice. By ignoring these uncomfortable facts, true justice \u2014 both for George Floyd and Derek Chauvin \u2014 is becoming ever more unlikely.<\/span><\/p>\n<p><i><span>Ian Haworth is an Editor and Writer for The Daily Wire.
