Doug Ducey (R) Tuesday signed into law <a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/1r\/bills\/hb2111h.htm\">HB 2111<\/a>, which would prevent state and local governments from implementing any new gun control laws coming out of Washington, D.C. Those who support the bill say law-abiding gun owners are protected from potential laws that would be a violation of the Second Amendment.<\/p>\n<p>According to the bill, the Arizona State Constitution allows state legislators to exercise their \u201csovereign authority.\u201d The <a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/1r\/bills\/hb2111h.htm\">text of the bill<\/a> specifically cites Article II Section 3 of the Arizona State Constitution, <a href=\"https:\/\/www.azleg.gov\/const\/arizona_constitution.pdf\">which says<\/a>, \u201cThe Constitution of the United States is the supreme law of the land.\u201d<\/p>\n<p>\u201cArizona stands with law-abiding gun owners. The Second Amendment guarantees vital liberties, just like the First Amendment protects the freedom of speech and the Fourth Amendment prevents unreasonable searches and seizures,\u201d state Rep. Leo Biasiucci (R), the bill\u2019s sponsor, said in a<a href=\"https:\/\/twitter.com\/AZHouseGOP\/status\/1377021092431192066?s=20\"> statement<\/a>. \u201cIf the zealous gun-grabbers in Washington try to disarm citizens in the name of political posturing, we\u2019re not going to allow it in Arizona.\u201d<\/p>\n<p>Pinal County Sheriff Mark Lamb <a href=\"https:\/\/arizonadailyindependent.com\/2020\/03\/11\/pinal-county-becomes-2nd-amendment-preservation-county\/\">backed<\/a> a similar Second Amendment sanctuary policy when his county\u2019s board of supervisors contemplated a similar resolution.<\/p>\n<p>\u201cI\u2019m out amongst the constituents every day and I get more questions about the Second Amendment and our support and questions about our support for the Second Amendment, more than I do anything else,\u201d he explained. \u201cI reiterated to them that as a sheriff I took an oath to support and defend the Constitution of the United States and I\u2019m going to do that at every turn.\u201d<\/p>\n<p>While many people believe the Second Amendment applies only to hunter purposes, Lamb said that is entirely false.<\/p>\n<p>\u201cThe Second Amendment was put in place for the key reason of avoiding another tyrannical government. The Second Amendment is what allows us to keep government in check and voice our opinions, whether we disagree or agree with something.\u201d<\/p>\n<p>Maricopa County Sheriff Paul Penzone, however, is not thrilled with the new law because it \u201cput[s] law enforcement in an awkward position.\u201d<\/p>\n<p>\u201cI think \u2026 there\u2019s political motivation. It\u2019s one of those emotional issues but as far as the impact on law enforcement, it will create confusion or challenges more than benefits or protecting the Second Amendment,\u201d Penzone told <a href=\"https:\/\/ktar.com\/story\/4246579\/maricopa-county-sheriff-penzone-questions-purpose-of-arizona-gun-bill\/\">KTAR Radio<\/a> last week. \u201cThe people who wrote it really didn\u2019t sit down and have a thoughtful conversation as to the application.\u201d<\/p>\n<p>\u201cI\u2019m just a little bit confused as to what value it offers. It\u2019s arbitrary,\u201d he explained.&nbsp;\u201cYou could make the easy argument saying it\u2019s a state practice \u2013 the person has a right to bear arms, therefore you\u2019re in conflict with that. Now you\u2019re putting officers or deputies in this position where they\u2019re questioning whether or not some other entity will determine if it\u2019s in conflict with the Second Amendment, therefore do we act on it? And that\u2019s where it creates problems.\u201d<\/p>\n<p>Other <a href=\"https:\/\/okcfox.com\/news\/local\/state-senate-declares-oklahoma-a-second-amendment-sanctuary-state\">states<\/a> and<a href=\"https:\/\/www.kgw.com\/article\/news\/local\/the-story\/yamhill-county-becomes-second-amendment-gun-sanctuary\/283-e8b943f9-6675-4873-aae9-2d3959a00768\"> local governments<\/a> across the country have passed similar legislation, making them \u201cSecond Amendment sanctuaries.\u201d It is a move that is gaining steam, particularly in red states, like <a href=\"https:\/\/thetexan.news\/second-amendment-sanctuary-bill-approved-by-texas-house-committee\/\">Texas<\/a> and Oklahoma.<\/p>\n<p>Gun rights activists have applauded Second Amendment sanctuaries because it is a figurative way of saying \u201cwe will not back down from this fight.\u201d After all, the right to keep and bear arms is a God-given, Constitutionally protected right.<\/p>\n<p>At the end of the day, the federal government relies on state and local law enforcement to enforce its gun control agenda. That burden ultimately falls on the shoulders of county sheriffs, many of whom <a href=\"https:\/\/www.krem.com\/article\/news\/local\/kootenai-county-second-amendment-sanctuary-commissioner-sheriff-support\/293-23ad3795-a469-42ce-a45a-ea2ae38bdf41\">believe<\/a> gun control laws are unconstitutional. These declarations are local elected officials\u2019 way of saying they will not enforce something they believe violates the Constitution.<\/p>\n<p>President Joe Biden has vowed to take up the <a href=\"https:\/\/www.dailywire.com\/news\/psaki-biden-considering-executive-action-on-guns\">gun control agenda<\/a>, with a push for a ban on \u201cassault weapons,\u201d \u201chigh capacity\u201d magazines, and universal background checks.<\/p>\n<p><em>Beth Baumann is a Political Reporter at The Daily Wire.
