He said that the court\u2019s power depends on&nbsp;\u201ca trust that the court is guided by legal principle, not politics,\u201d according to his remarks, which were <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/justice-breyer-says-expanding-the-supreme-court-will-erode-trust\/2021\/04\/06\/cabc95c4-9730-11eb-a6d0-13d207aadb78_story.html\">obtained<\/a> by The Washington Post.&nbsp;\u201cStructural alteration motivated by the perception of political influence can only feed that perception, further eroding that trust.\u201d<\/p>\n<p>Breyer reportedly said that the purpose for his lecture was to \u201cmake those whose initial instincts may favor important structural or other similar institutional changes, such as forms of \u2018court-packing,\u2019 think long and hard before embodying those changes in law.\u201d<\/p>\n<p>\u201cIf the public sees judges as \u2018politicians in robes,\u2019 its confidence in the courts, and in the rule of law itself, can only diminish, diminishing the court\u2019s power, including its power to act as a \u2018check\u2019 on the other branches,\u201d he said. Breyer reportedly took issue with the perception that the court has a 6-3 conservative majority, noting that the court refused to overturn the results of the 2020 presidential election.<\/p>\n<p>\u201cThe court\u2019s decision in the 2000 presidential election case, Bush v. Gore, is often referred to as an example of its favoritism of conservative causes,\u201d Breyer said. \u201cBut the court did not hear or decide cases that affected the political disagreements arising out of the 2020 Trump v. Biden election.\u201d<\/p>\n<p>\u201cIt did uphold the constitutionality of Obamacare, the health care program favored by liberals,\u201d Breyer said in noting some of the things that court has sided with liberals on. \u201cIt did re-affirm precedents that favored a woman\u2019s right to an abortion. It did find unlawful certain immigration, census, and other orders, rules, or regulations, favored by a conservative president.\u201d<\/p>\n<p>Breyer, 82, said that it was \u201cwrong to think of the court as another political institution.\u201d<\/p>\n<p>Even former Supreme Court Justice Ruth Bader Ginsburg, who was arguably the most liberal justice on the court, warned against packing the court.<\/p>\n<p>\u201cI have heard that there are some people on the Democratic side who would like to increase the number of judges,\u201d Ginsburg <a href=\"https:\/\/www.dailywire.com\/news\/honor-her-wishes-rbg-blasted-democrats-for-proposing-bad-idea-of-packing-supreme-court\">said<\/a>. \u201cI think that was a bad idea when President Franklin Delano Roosevelt tried to pack the court, his plan was for every justice who stays on the court past the age of 70, the president would have the authority to nominate another justice.
