Kristi Noem\u2019s <a href=\"https:\/\/www.dailywire.com\/news\/gov-kristi-noem-passes-on-south-dakota-womens-sports-bill-issues-executive-orders-instead?%3Futm_source=facebook&amp;utm_medium=social&amp;utm_campaign=fedup\">ongoing battle<\/a> over legislation that would ban biological males from participating in women\u2019s sports in her state. The <a href=\"https:\/\/www.cnn.com\/2021\/03\/30\/politics\/south-dakota-transgender-sports-kristi-noem\/index.html\">piece<\/a>, titled \u201cSouth Dakota\u2019s governor issues executive orders banning transgender athletes from women\u2019s sports,\u201d was written by breaking news reporter Devon Cole.<\/p>\n<p>Cole wrote:<\/p>\n<blockquote readability=\"16\">\n<p><em>Though the two executive orders signed by Noem do not explicitly mention transgender athletes, they reference the supposed harms of the participation of \u201cmales\u201d in women\u2019s athletics \u2013 an echo of the transphobic claim, cited in other similar legislative initiatives, that transgender women are not women. The orders also reference \u201cbiological sex,\u201d a disputed term that refers to the sex as listed on students\u2019 original birth certificates.<\/em><\/p>\n<p><em>It\u2019s not possible to know a person\u2019s gender identity at birth, and there is no consensus criteria for assigning sex at birth.<\/em><\/p>\n<\/blockquote>\n<p>CNN updated the article on Wednesday after it received blowback online \u201cto provide additional explanation as to the distinctions between gender and sex,\u201d according to an editor\u2019s note. The claim about \u201cno consensus for assigning sex at birth\u201d was removed from the new version of the article, and an explanation for why \u201cbiological sex\u201d is a disputed term was added.<\/p>\n<p>The new version reads:<\/p>\n<blockquote readability=\"28\">\n<p><em>Though the two executive orders signed by Noem do not explicitly mention transgender athletes, they reference the supposed harms of the participation of \u201cmales\u201d in women\u2019s athletics \u2013 an echo of the transphobic claim, cited in other similar legislative initiatives, that transgender women are not women. The orders also reference \u201cbiological sex,\u201d a disputed term that refers to the sex as listed on students\u2019 original birth certificates.<\/em><\/p>\n<p><em>It\u2019s not possible to know a person\u2019s gender identity at birth, and for some people, the sex listed on their original birth certificate is a misleading way of describing the body they have.<\/em><\/p>\n<p><em>While sex is a category that refers broadly to physiology, a person\u2019s gender is an innate sense of identity. The factors that go into determining the sex listed on a person\u2019s birth certificate may include anatomy, genetics and hormones, and there is broad natural variation in each of these categories. For this reason, the language of \u201cbiological sex,\u201d as used in this legislation, can be overly simplistic and misleading.<\/em><\/p>\n<\/blockquote>\n<p>CNN did not immediately return a request for comment.<\/p>\n<p>The original story\u2019s claims put forward as fact by CNN drew attention online as the network faced accusations of lying and idiocy.<\/p>\n<p>\u201cIf you believe CNN\u2019s last paragraph here, it is because you are an idiot,\u201d said Ben Shapiro, cofounder and editor emeritus of The Daily Wire. \u201cAll mammalian biology is sexually dimorphic. Small children can tell the difference between biological boys and girls accurately nearly 100% of the time. One minor note about language though: We don\u2019t \u2018assign\u2019 sex \u2013 we recognize and acknowledge a natural reality. I recognized my son is a boy \u2013 I didn\u2019t assign it. \u2018Assign\u2019 implies convention\/choice.\u201d<\/p>\n<p>\u201cOne reason this matters: The gender activists use \u2018sex assigned at birth\u2019 to create conceptual space for sex to be \u2018re-assigned\u2019 by hormones and surgery,\u201d Anderson added.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"8.5984848484848\">\n<p lang=\"en\" dir=\"ltr\">One reason this matters: The gender activists use &#8220;sex assigned at birth&#8221; to create conceptual space for sex to be &#8220;re-assigned&#8221; by hormones and surgery.
