Like, what are these guys up to now? How much Call of Duty are they playing? Have they recently DMed a girl \u2018Hey\u2019 30 times?\u201d<\/span><\/p>\n<p><span>\u201cOr how about this,\u201d Jost added, moving to the subject of gun control, \u201cif you want a gun, the gun store has to talk to at least five people from your life who agree it\u2019s a good idea for you to have a gun.\u201d<\/span><\/p>\n<p><span>\u201cIt\u2019s not really that much to ask,\u201d he said. \u201cYou\u2019ve got to list three references on an application to work at Foot Locker.\u201d<\/span><\/p>\n<p><span>\u201cAnd Republicans, please stop pretending this is a Second Amendment issue and just admit you love guns more than people you don\u2019t know,\u201d showing political advertisements from a handful of Republican figures which include firearms.<\/span><\/p>\n<p><span>\u201cIf you actually cared about the Second Amendment, you\u2019d also care about the well-regulated militias part. And I don\u2019t know if you noticed when they almost hung you two months ago, but our militias aren\u2019t super well regulated,\u201d he concluded.<\/span><\/p>\n<p>\n<iframe loading=\"lazy\" title=\"Weekend Update: Biden Calls for Gun Control - SNL\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/h8oTJN6PDrI?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/p>\n<p><span>Unsurprisingly, the political analysis from Saturday Night Live is entirely ignorant. Let\u2019s break it down.<\/span><\/p>\n<p><b>Biden called for far more than \u201cuniversal background checks.\u201d<\/b><\/p>\n<p><span>Jost applied the classic \u201cover simplification\u201d tactic used by the Left when conservatives oppose their policy positions by cherry-picking the least extreme element of broader legislative objectives and presenting them as indicative of their entire position. <\/span><\/p>\n<p><span>In this case, Jost implies that Biden just called for universal background checks, when in<\/span><span>&nbsp;fact, Biden\u2019s policy suggestions included far more than the expansion of background checks.<\/span><\/p>\n<p><span>As The Daily Wire <\/span><a href=\"https:\/\/www.dailywire.com\/news\/president-biden-pushes-ban-on-assault-weapons-high-capacity-magazines-following-colorado-mass-shooting\"><span>reported<\/span><\/a><span>, \u201cPresident Joe Biden made a brief statement, Tuesday morning, addressing the mass shooting in Boulder, Colorado, and pledging to press forward with gun \u2018reform\u2019 measures, including a ban on so-called \u2018assault weapons,\u2019 and a ban on \u2018high capacity magazines.\u2019\u201d<\/span><\/p>\n<p><span>The argument used by Jost is the logical equivalent of a political party rejecting criticism of a national \u201cCocaine and Ice Cream for Children Day\u201d by accusing their opponents of hating ice cream.<\/span><\/p>\n<p><b>\u201cCurrent checks\u201d already exist<\/b><\/p>\n<p><span>While Jost used some apparently humorous examples of \u201ccurrent checks\u201d that could be applied, such as \u201cHow much Call of Duty are they playing?\u201d and \u201cHave they recently DMed a girl \u2018Hey\u2019 30 times?\u201d he ignored the fact that some form of \u201ccurrent checks\u201d already exist.<\/span><\/p>\n<p><span>Currently, 19 states and the District of Columbia have enacted some form of red-flag law which permits police departments or family members to file for the temporary removal of firearms from a person who may present a danger to themselves or others.<\/span><\/p>\n<p><span>These red-flag laws are known as <\/span><span>Extreme Risk Protection Orders (ERPOs) in Oregon, Washington, Maryland, Vermont and Colorado; Extreme Risk Firearm Protection Orders (ERFPO) in New Mexico; Risk Protection Orders in Florida; Gun Violence Restraining Orders (GVROs) in California; risk warrants in Connecticut; and Proceedings for the Seizure and Retention of a Firearm in Indiana.<\/span><\/p>\n<p><span>Given that such \u201ccurrent checks\u201d in the form of \u201cred-flag laws\u201d already exist in Colorado \u2014 the location of one of the mass shootings discussed by Jost \u2014 it seems like his suggestions are redundant.<\/span><\/p>\n<p><b>References for gun purchases<\/b><\/p>\n<p><span>This suggestion is absurd for many reasons. For example, it is obscenely easy to bypass \u2014 references could be fabricated, selected based on likelihood to remain supportive, or chosen based on their willingness to lie. It also applies a popularity layer upon an inalienable right \u2014 what happens if you don\u2019t have any friends? Are your Constitutional rights invalid?<\/span><\/p>\n<p><b>Republicans care about the Second Amendment <em>and<\/em> people they don\u2019t know<\/b><\/p>\n<p><span>The argument Jost used \u2014 asking Republicans to \u201c<\/span><span>please stop pretending this is a Second Amendment issue and just admit you love guns more than people you don\u2019t know\u201d \u2014 is more despicable than most will acknowledge. He is implying that Republicans are pretending the debate over gun control has anything to do with the U.S. Constitution, and is instead motivated by a physical love for guns, which are then viewed as more valuable than human beings.<\/span><\/p>\n<p><span>This is absurd. The gun control debate is based entirely on the Second Amendment, without which this \u201cdebate\u201d would already have been decided in a similar fashion to the rest of the Western world. Hand-picking a few controversial Republican figures to mischaracterize all conservatives as \u201cgun nuts\u201d is dishonest and cynical, and is designed to dilute the debate down to the \u201cintelligent Left\u201d and the comparatively \u201cunintelligent Right.\u201d<\/span><\/p>\n<p><span>Jost desperately wants to drag the debate away from the Second Amendment because he knows that he can only win in the arena of insult and emotion.<\/span><\/p>\n<p><b>Well-regulated militias<\/b><\/p>\n<p><span>Jost referenced another lazy anti-gun argument when it comes to the Second Amendment, which reads, <\/span><span>\u201c<\/span><span>A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.\u201d<\/span><\/p>\n<p><span>The Second Amendment is divided into two parts: its prefatory clause (\u201cA well regulated Militia, being necessary to the security of a free State\u201d) and its operative clause (\u201cthe right of the people to keep and bear Arms shall not be infringed\u201d). The \u201cindividual rights\u201d thesis emphasizes the operative clause, while the \u201cstates\u2019 rights\u201d thesis focuses on the prefatory clause.<\/span><\/p>\n<p><span>In 2008, the Supreme Court definitively ruled in favor of the \u201cindividual rights\u201d theory in <\/span><i><span>District of Columbia v. Heller<\/span><\/i><span>. According to Cornell Law School\u2019s <\/span><a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/amendment-2#:~:text=The%20Second%20Amendment%20is%20naturally,shall%20not%20be%20infringed%E2%80%9D).\"><span>Legal Information Institute<\/span><\/a><span>, \u201cThe Court reached this conclusion after a textual analysis of the Amendment, an examination of the historical use of prefatory phrases in statutes, and a detailed exploration of the 18th century meaning of phrases found in the Amendment. Although accepting that the historical and contemporaneous use of the phrase \u2018keep and bear Arms\u2019 often arose in connection with military activities, the Court noted that its use was not limited to those contexts.\u201d<\/span><\/p>\n<p><i>Ian Haworth is an Editor and Writer for The Daily Wire.
