Kristi Noem again passed on signing a bill to bar biological males from competing as transgender females in women\u2019s sports, instead issuing executive orders in the bill\u2019s place.<\/p>\n<p>The State Legislature <a href=\"https:\/\/www.dailywire.com\/news\/breaking-either-sign-or-veto-south-dakota-legislature-rejects-gov-noems-changes-to-womens-sports-bill\">voted<\/a> to reject Noem\u2019s \u201cstyle and form\u201d veto on Monday, but the House could not muster the two-thirds majority necessary to enact the bill without the governor\u2019s signature. Noem declined to sign the legislation without her proposed changes, instead issuing two executive orders to block biological males from participating in women\u2019s sports.<\/p>\n<p>\u201cOnly girls should play girls\u2019 sports. Given the legislature\u2019s failure to accept my proposed revisions to HB 1217, I am immediately signing two executive orders to address this issue: one to protect fairness in K-12 athletics, and another to do so in college athletics,\u201d Noem tweeted after the legislature sent H.B. 1217, dubbed the <a href=\"https:\/\/www.dailywire.com\/news\/conservatives-blast-gop-gov-noem-for-refusing-to-sign-bill-protecting-girls-sports\">Fairness in Women\u2019s Sports<\/a> act, back to her desk.<\/p>\n<p>\u201cAdditionally, I will be working with legislative leaders to schedule a special legislative session in late May or early June,\u201d Noem added. \u201cThe special session will address this important issue, as well others (medicinal marijuana and the latest federal spending package.)\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"11.475\">\n<p lang=\"en\" dir=\"ltr\">Additionally, I will be working with legislative leaders to schedule a special legislative session in late May or early June. (2\/3)<\/p>\n<p>\u2014 Governor Kristi Noem (@govkristinoem) <a href=\"https:\/\/twitter.com\/govkristinoem\/status\/1376653526357708804?ref_src=twsrc%5Etfw\">March 29, 2021<\/a><\/p>\n<\/blockquote>\n<p>Noem\u2019s first <a href=\"https:\/\/governor.sd.gov\/doc\/2021-05.pdf\">order<\/a> states that \u201conly females, based on their biological sex \u2026 shall participate in any girls\u2019 or women\u2019s athletic event sanctioned by a public school\u201d or school district. It says the South Dakota Department of Education \u201cshall establish a policy consistent\u201d with the order.<\/p>\n<p>The policy of the second <a href=\"https:\/\/governor.sd.gov\/doc\/2021-06.pdf\">order<\/a> is similar to the first but for college athletes. It differs in its directive, however, stating that the Board of Regents \u201cshould take any and all steps necessary within the law of the state to legally implement policies consistent\u201d with the order.<\/p>\n<p>Noem insists that her refusal to sign the bill does not amount to a veto. State lawmakers argue otherwise and assert she unconstitutionally used the \u201cstyle and form\u201d veto to remand the bill back to the legislature with significant changes that changed the meaning of the legislation, according to the <a href=\"https:\/\/www.argusleader.com\/story\/news\/2021\/03\/29\/lawmakers-odds-over-procedure-policy-transgender-girls-women-sports-bill-gov-kristi-noem-house\/7040522002\/\">Argus Leader<\/a>.<\/p>\n<p>\u201cHer letter back to the House said \u2018I have not vetoed the bill\u2019 but her actions said otherwise,\u201d GOP House Speaker Spencer Gosch said on Monday.<\/p>\n<p>Noem\u2019s refusal to sign the Fairness in Women\u2019s Sports act has undermined her reputation as a stalwart conservative governor earned during the coronavirus pandemic. The governor has defended herself against heavy criticism from the right by claiming that the bill would have invited legal challenges that South Dakota would have lost, and Noem claimed that the NCAA and other interest groups would have taken revenge on her state by pulling engagement and opportunities.<\/p>\n<p>On Wednesday,&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/noem-ripped-after-spox-suggests-shes-a-victim-of-conservative-cancel-culture-from-just-wrong-to-pathetic\">Noem<\/a>&nbsp;spokesman Ian Fury hit back at critics asserting that the governor was a victim of \u201ccancel culture\u201d from conservatives.<\/p>\n<p>\u201cGovernor Noem is very used to fighting off criticism from the left,\u201d Noem spokesman Ian Fury said in an email. \u201cAfter all, in the past year, she was the only governor in the entire nation to never order a single business or church in her state to close. The left bullied her incessantly, but she didn\u2019t cave.\u201d<\/p>\n<p>\u201cBut if any number of conservative pundits are to be believed, that same governor who refused to cave is now caving to the NCAA and Amazon on the issue of fairness in women\u2019s sports,\u201d Fury continued. \u201cWhat?
