RNC and state GOP lawyers and observers are monitoring counts and say affidavit validation rates are unusually high; they’re prepared to sue if provisional ballots aren’t segregated. Hyde‑Smith trailed Democrat Scott Colom by roughly 1,800 votes as thousands of provisional and about 3,000 mail‑in ballots remain; mail‑ins postmarked by election Day count if received within five business days. If they do, it would be a rare bright spot for the GOP in a bleak midterm election that already has cost Republicans control of Congress.

Mike Hurst, chairman of the Republican Party of Mississippi, told The Federalist in an exclusive interview Thursday that the brunt of the 17,000 affidavit, or provisional, ballots to be counted is coming from traditionally Republican or red-leaning areas of the state.

“We have a lot of hope that this is going to break our way,” said Hurst, who also serves as general counsel for the Republican National Committee.

“Usually affidavits are only proven correct about 25 percent of the time,” Hurst said. “We are seeing up to 75 percent or 80 percent validated. Incumbent Republican Sen.
