Democrats likely won a large House majority and about 54-56 Senate seats, enabling investigations, blocking Trump\u2019s executive and judicial nominations, and possibly preventing replacement of any future vacancies. Retirement rumors about Justices Clarence Thomas and Samuel Alito persist, but there\u2019s no evidence they\u2019ll step down; Alito saeid he\u2019ll serve through the current term. Republicans fear Democrats will delegitimize conservative justices and pursue court-packing-backed by leaders like Hakeem Jeffries and Jamie Raskin and groups such as Demand Justice-unless the GOP resists.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Supreme Court has long served as a vital and necessary institution in American government. That institution is now under threat more than ever following Tuesday\u2019s elections \u2014 and in more ways than one. <\/p>\n<p>In a complete bloodbath for Republicans, Democrats are expected to secure a sizeable House majority and <a href=\"https:\/\/www.nytimes.com\/interactive\/2026\/11\/03\/us\/elections\/results-senate.html\" target=\"_blank\" rel=\"noreferrer noopener\">at least<\/a> 54 Senate seats, a number that could potentially increase to 56 once all the ballots are counted. Not only will these majorities provide Democrats with the power <a href=\"https:\/\/thefederalist.com\/2026\/11\/05\/after-deeply-unpleasant-campaign-season-dems-promise-to-soothe-economically-anxious-americans-with-screeching-lawfare-jihad\/\" target=\"_blank\" rel=\"noreferrer noopener\">to target and investigate<\/a> their political enemies, but they will also give them the ability to block President Trump\u2019s nominees for executive positions and judgeships \u2014 including potential Supreme Court vacancies. <\/p>\n<p>That problem has predictably reignited <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nancy-pelosis-retirement-rumors-swirl-democrats-swarm-for-power\/\" title=\"Nancy Pelosi&#039;s Retirement Rumors Swirl, ... Swarm for Power\u00a0\">retirement rumors<\/a> surrounding Justices Clarence Thomas, 78, and Samuel Alito, 76, the court\u2019s oldest (and most reliably originalist) members. The theory among GOP commentators seems to be that, by retiring now, the senior justices would give Trump an opportunity to appoint younger successors before Democrats take control of the Senate for the foreseeable future. <\/p>\n<p>Despite this persistent speculation, there is <a href=\"https:\/\/www.nytimes.com\/2026\/11\/04\/us\/politics\/alito-trump-supreme-court-not-retiring.html\" target=\"_blank\" rel=\"noreferrer noopener\">no evidence<\/a> indicating either justice is planning to step down anytime soon. In fact, Alito <a href=\"https:\/\/www.foxnews.com\/politics\/alito-reiterates-not-retiring-committed-through-end-current-supreme-court-term\" target=\"_blank\" rel=\"noreferrer noopener\">confirmed<\/a> to Fox News on Thursday that he is not retiring and will continue to serve through at least the court\u2019s current term.<\/p>\n<p>Republican concerns about Thomas and Alito\u2019s age and future health aren\u2019t without merit. The abrupt 2020 death of liberal Justice Ruth Bader Ginsburg, 87, allowed Trump to appoint Amy Coney Barrett, a move that shifted the high court from a 5-4 conservative majority to a 6-3 supermajority. That conservative supermajority has since gone on to issue (with limited exceptions) numerous constitutional rulings in the years since.<\/p>\n<p>Trump\u2019s inability to fill a potential Supreme Court vacancy, however, seems minute when compared to the greater threats posed to the high court by the incoming Democrat Congress.<\/p>\n<p>Leading Democrats have openly <a href=\"https:\/\/thefederalist.com\/2026\/08\/17\/while-trying-to-avoid-court-packing-question-jeffries-all-but-admits-he-supports-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">forecasted<\/a> their plans to use their majorities to resuscitate their vile \u201cethics\u201d smears to target and harass the court\u2019s conservative justices. These grotesque attacks are based on dishonest hatchet jobs by leftist-funded propaganda firms like <a href=\"https:\/\/thefederalist.com\/2026\/10\/29\/propublica-spends-millions-from-left-wing-groups-writing-hit-pieces-on-democrats-favorite-targets\/\" target=\"_blank\" rel=\"noreferrer noopener\">ProPublica<\/a> and were employed by Democrats during the Biden era to denigrate Thomas and Alito. <\/p>\n<p>The years-long witch hunt \u2014 which was so <a href=\"https:\/\/thefederalist.com\/2025\/01\/07\/democrats-ethics-smears-against-thomas-and-alito-are-so-embarrassing-they-buried-their-own-report\/\" target=\"_blank\" rel=\"noreferrer noopener\">embarrassingly weak<\/a> that Democrats buried their own report on it \u2014 has had two primary goals. The first is to try and delegitimize the court in the eyes of the public by casting a dishonest cloud of impropriety over the conservative justices and their decisions. The second \u2014 and more concerning \u2014 is to use these false accusations of \u201ccorruption\u201d as a pretext to <a href=\"https:\/\/thefederalist.com\/tag\/court-packing\/\" target=\"_blank\" rel=\"noreferrer noopener\">pack<\/a> the high court with left-wing activists. <\/p>\n<p>Soon-to-be House Speaker <a href=\"https:\/\/thefederalist.com\/2026\/08\/17\/while-trying-to-avoid-court-packing-question-jeffries-all-but-admits-he-supports-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">Hakeem Jeffries<\/a>, likely House Judiciary Committee Chair <a href=\"https:\/\/thefederalist.com\/2026\/05\/21\/in-hearing-on-court-packings-partisan-perils-not-a-single-democrat-disavowed-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jamie Raskin<\/a>, and <a href=\"https:\/\/thefederalist.com\/2026\/10\/16\/vote-like-dems-court-packing-gambit-is-on-the-ballot-because-it-is\/\" target=\"_blank\" rel=\"noreferrer noopener\">numerous<\/a> <a href=\"https:\/\/thefederalist.com\/2026\/05\/01\/dems-revive-court-packing-threats-after-being-told-they-cant-do-racist-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">other<\/a> <a href=\"https:\/\/thefederalist.com\/2026\/10\/22\/heres-where-every-major-democrat-senate-candidate-stands-on-packing-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">Democrats<\/a> have openly <a href=\"https:\/\/thefederalist.com\/2026\/09\/01\/friends-dont-let-friends-vote-for-dems-gambit-to-destroy-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">touted<\/a> their support for increasing the number of justices. Despite claims to the contrary, these actors are seeking to appoint leftist yes-men (sorry, \u201cyes-peoples\u201d) who will rule based on what\u2019s favorable for Democrats instead of what the Constitution and law actually call for.<\/p>\n<p>While President Trump can block such efforts in for the next two years, Republicans would be foolish to rest easy. Democrats have made it abundantly clear that they intend to use their majorities to attack the conservative justices and continue laying the groundwork for packing the court if they win the White House in 2028. Leftist groups like <a href=\"https:\/\/thefederalist.com\/2026\/04\/07\/unraveling-the-far-left-group-seeking-to-derail-future-republican-scotus-nominees\/\" target=\"_blank\" rel=\"noreferrer noopener\">Demand Justice<\/a> and <a href=\"https:\/\/www.influencewatch.org\/non-profit\/fix-the-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fix the Court<\/a>, both of which have participated in Democrats\u2019 anti-SCOTUS campaigns, all but said as much in fundraising emails distributed after Tuesday\u2019s elections.<\/p>\n<p>\u201cLast night, voters showed they\u2019re with us. Court reform isn\u2019t a fringe idea anymore. It\u2019s a winning position,\u201d the Demand Justice PAC email reads. <\/p>\n<p>So much for that whole \u201caffordability\u201d thing. <\/p>\n<p>Tuesday\u2019s dominating victories have given Democrats all the confidence they need to take their war against SCOTUS to the next level. Which means the onus falls on Republicans to fight the battles the justices can\u2019t.
