Teh campaign backing the amendment outraised it&#8217;s opponents by roughly three to one.<\/p>\n<p>the measure places virtually no limits on when abortions can be performed and sharply restricts the ability of future legislatures to regulate the practice, framing most restrictions as violations of a \u201cessential right to reproductive freedom.\u201d The Federalist argues the language would allow abortions up to birth &#8211; even for reasons such as maternal \u201canxiety\u201d &#8211; and could prevent prosecution in extreme cases. As many third-trimester infants can survive outside the womb, critics say the amendment effectively permits late-term killings.<\/p>\n<p>The amendment also removes age limits and parental-notification requirements, limits informed-consent rules, and could force unwilling doctors to provide abortions under threat of job loss. Critics warn it could let unlicensed or unqualified people perform abortions at facilities that don\u2019t meet medical inspection standards; a pro-life OB\/GYN group says similar laws elsewhere have led to podiatrists and optometrists doing surgical abortions.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/david-brock-launches-dark-money-effort-to-disbar-shame-impoverish-trump-election-lawyers-3\/\" title=\"David Brock Launches &#039;Dark Money&#039; Effort to Disbar, Shame, Impoverish Trump ... Lawyers\">post-election legal challenge<\/a> was allowed to proceed in Tazewell Circuit Court, with Judge Jack Hurley setting a hearing for nov. 13. The lawsuit contends the ballot language was deceptive and failed to inform voters that the amendment allows unrestricted, on-demand abortions while blocking regulatory and medical safeguards; it also raises procedural claims about how the amendment was placed on the ballot. pfTrackEvent(&#039;Virginia Enshrines Unregulated Abortion On Demand In Constitution&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">Virginia voters overwhelmingly approved a constitutional amendment that will allow abortion on demand, at any point in a pregnancy, for any or no reason at all in Tuesday\u2019s election.<\/p>\n<p class=\"wp-block-paragraph\">As of press time, <a href=\"https:\/\/x.com\/NBCNews\/status\/2117784449832140819?a=jkmgikAOU5gSGYQHZTw&#038;s=20\" target=\"_blank\" rel=\"noreferrer noopener\">approval<\/a> of the amendment <a href=\"https:\/\/www.vpap.org\/electionresults\/20261103\/referenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">received<\/a> about 62 percent of the vote, though final vote tallies are still being made and not all precincts have reported.<\/p>\n<div id=\"fdrlst__b89e9-1566702852\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The \u201cyes\u201d campaign for the amendment raised about three times more money than the \u201cno\u201d campaign.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"JNIdLXhxAytbaY3coejDRwpskHFv\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Finance reports that were due on Monday provide the final look at constitutional amendment fundraising before Election Day. Not only are there zero parameters regarding when one can obtain an abortion within the timeframe of her pregnancy, but the measure also forecloses essentially all opportunities for legislative regulation in the future.<\/p>\n<p class=\"wp-block-paragraph\">As The Federalist <a href=\"https:\/\/thefederalist.com\/2026\/10\/29\/doctor-serial-baby-murderer-kermit-gosnell-could-not-have-been-prosecuted-under-virginias-abortion-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the measure allows killing unborn babies for any reason (including the mother experiencing \u201canxiety\u201d) up to the moment of birth, but also categorizes the placing of any constraints on such late-term abortion as an infringement of a \u201cfundamental right to reproductive freedom.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Nearly all third-trimester babies can already survive outside the womb, but the amendment creates a glidepath to their murder anyway.<\/p>\n<p class=\"wp-block-paragraph\">The amendment strips any age restriction or parental notification requirement for abortion, meaning minors can obtain abortions without their parents\u2019 knowledge or consent. It also labels requirements to provide any kind of informed consent about what abortion truly involves and the associated risks an infringement on the \u201cright,\u201d while reportedly forcing doctors who do not want to perform the procedure to do so under threat of losing their jobs.<\/p>\n<p class=\"wp-block-paragraph\">The measure would ostensibly allow even unlicensed, unqualified people to perform abortions at facilities that are not subject to medical inspections. According to Dr. Christina Francis, a board-certified OB\/GYN hospitalist and CEO of the American Association of Pro-Life OBGYNs (AAPLOG), states with similar laws have seen podiatrists and optometrists conduct surgical abortions.<\/p>\n<p class=\"wp-block-paragraph\">In Virginia, the fight over the abortion amendment is not over. Last week, a judge in the Tazewell Circuit Court allowed a post-election challenge to move forward, provided the amendment was approved by voters.<\/p>\n<p class=\"wp-block-paragraph\">As The Federalist <a href=\"https:\/\/thefederalist.com\/2026\/10\/27\/virginia-judge-allows-post-election-challenge-to-late-term-abortion-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, Judge Jack Hurley set a Nov. 13 hearing date for the challenge, rejecting a request from the Democrat-run Virginia government to stop the challenge. Hurley is the same judge who consistently ruled against Democrats in their 10 Democrat-1 Republican gerrymandering scheme, which ultimately failed in the commonwealth\u2019s Supreme Court after voters approved the plan.<\/p>\n<p class=\"wp-block-paragraph\">Virginia has a <a href=\"https:\/\/thefederalist.com\/2026\/05\/08\/virginia-supreme-court-strikes-down-democrat-gerrymander\/\" target=\"_blank\" rel=\"noreferrer noopener\">longstanding practice<\/a> of not allowing challenges to the results of an election until after it has taken place.<\/p>\n<p class=\"wp-block-paragraph\">The challenge both addresses the \u201cdeceptive\u201d language used on the ballot, asserting that no normal voter would be able to understand that it would allow abortion on-demand, at any time, as well as block any regulatory or medical safeguards whatsoever.<\/p>\n<p class=\"wp-block-paragraph\">The lawsuit also makes procedural arguments that are similar to those made about the gerrymandering plan, related to how the proposal ended up on the ballot and other logistical issues concerning how it was pushed through the legislative process. Challengers are hopeful that the shoddy work of Democrats could tank their plan once again.<\/p>\n<p class=\"wp-block-paragraph\">\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Breccan F.
