Few items became a bigger symbol of that frustration than eggs.<\/p>\n<p style=\"font-weight: 400;\">When egg prices soared beginning in 2022, Americans were repeatedly told that avian flu and reduced supply explained the increases. But <a href=\"https:\/\/ers.usda.gov\/sites\/default\/files\/_laserfiche\/outlooks\/105645\/LDP-M-343.pdf\">U.S. Department of Agriculture (USDA) data<\/a> showed the egg-laying flock had declined only modestly compared with how dramatically prices had climbed.<\/p>\n<p style=\"font-weight: 400;\">In January 2023, Farm Action <a href=\"https:\/\/farmaction.us\/2023\/01\/19\/farm-action-calls-for-ftc-to-investigate-record-high-egg-prices\/\">called for a federal investigation<\/a>. Meanwhile, Cal-Maine Foods, the nation\u2019s largest egg company, <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/16160\/000156276223000145\/exhibit991.htm\">had not reported a single case of avian flu<\/a> at its facilities and was <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/16160\/000156276222000495\/exhibit991.htm\">reporting dramatically higher profits<\/a>.<\/p>\n<p style=\"font-weight: 400;\">When egg prices <a href=\"https:\/\/apnews.com\/article\/record-high-egg-prices-bird-flu-profits-1e3d66b4af9556a503125cf8259b1647\">surged again<\/a>, we kept digging. In February 2025, Farm Action <a href=\"https:\/\/farmaction.us\/farm-action-calls-for-an-investigation-into-skyrocketing-egg-prices-and-restricted-supply\/\">called for an investigation<\/a> a second time after our continued analysis raised new concerns about soaring prices and restricted supply. Three weeks later, President Trump\u2019s Department of Justice (DOJ) <a href=\"https:\/\/www.wsj.com\/business\/egg-prices-justice-department-probe-22d6a4f6\">opened an antitrust investigation<\/a> into the egg industry.<\/p>\n<p style=\"font-weight: 400;\">Now we know much more.<\/p>\n<p style=\"font-weight: 400;\">In June 2026, the DOJ <a href=\"https:\/\/www.justice.gov\/atr\/case\/us-and-plaintiff-states-v-cal-maine-foods-inc-et-al\">filed an antitrust lawsuit<\/a> alleging that Cal-Maine Foods, Hickman\u2019s Egg Ranch, and Versova coordinated for nearly three years to manipulate a benchmark used to help set egg prices across the country.<\/p>\n<p style=\"font-weight: 400;\">The allegations are remarkably direct.<\/p>\n<p style=\"font-weight: 400;\">According to the <a href=\"https:\/\/www.justice.gov\/atr\/case-document\/complaint-315\">DOJ\u2019s complaint<\/a>, in October 2022, a Cal-Maine executive told the CEO of Hickman\u2019s: \u201cWe are bidding up. Let\u2019s hold it today.\u201d<\/p>\n<p style=\"font-weight: 400;\">In December, Hickman\u2019s CEO instructed executives to place \u201cstrong bids, early and often\u201d before market reporters arrived for work. When Versova placed high bids and sellers actually tried to accept them, its executives discussed deleting those bids.<\/p>\n<p style=\"font-weight: 400;\">Later, executives arranged egg sales above the benchmark after discussing how the market reporter needed higher-priced sales to justify raising it.<\/p>\n<p style=\"font-weight: 400;\">Then, in December 2024, Cal-Maine\u2019s former CEO sent Hickman\u2019s CEO another message: \u201cLet it rip.\u201d<\/p>\n<p style=\"font-weight: 400;\">The DOJ alleges this was not harmless industry chatter. The companies coordinated bids and transactions to artificially inflate price quotations published by Urner Barry, a benchmark that influences what grocery stores, restaurants, and other businesses pay for billions of eggs. The <a href=\"https:\/\/www.justice.gov\/atr\/media\/1455881\/dl\">DOJ says the agreement increased prices<\/a> paid by retailers and consumers.<\/p>\n<p style=\"font-weight: 400;\">If the government\u2019s allegations are true, this is exactly the kind of conduct antitrust laws are supposed to stop. A free market only works when competitors actually compete.<\/p>\n<p style=\"font-weight: 400;\">Yet the DOJ wants to settle the case, and the proposed consequences raise a serious question: Are they strong enough to deter anyone?<\/p>\n<p style=\"font-weight: 400;\">Under the <a href=\"https:\/\/www.justice.gov\/atr\/case\/us-and-plaintiff-states-v-cal-maine-foods-inc-et-al\">proposed settlements<\/a>, the companies would face restrictions on communications with competitors, adopt antitrust compliance programs, and submit to monitoring. They would also face monetary obligations and egg donations.<\/p>\n<p style=\"font-weight: 400;\">For Cal-Maine, <a href=\"https:\/\/farmaction.us\/let-it-rip-the-egg-price-fixing-messages-every-grocery-shopper-should-see\/\">Farm Action estimates<\/a> the total obligation at approximately $2.8 million.<\/p>\n<p style=\"font-weight: 400;\">Compare that with the roughly <a href=\"https:\/\/investors.calmainefoods.com\/news-releases\/news-release-details\/cal-maine-foods-reports-financial-and-operational-results-fourth\">$1.22 billion in profit<\/a> Cal-Maine reported for fiscal year 2025. The proposed obligation amounts to about 0.23% of one year\u2019s profit.<\/p>\n<p style=\"font-weight: 400;\">The companies admit no wrongdoing. There would be no trial. And none of the executives whose communications appear throughout the DOJ\u2019s complaint have been criminally charged in this case.<\/p>\n<p style=\"font-weight: 400;\">That should concern anyone who believes in competitive markets and equal enforcement of the law.<\/p>\n<p style=\"font-weight: 400;\">Antitrust enforcement should not be anti-business. Quite the opposite. When the government fails to impose meaningful consequences for anticompetitive conduct, honest businesses, farmers, and consumers pay the price. Companies that play by the rules should not have to compete against companies that allegedly coordinate behind closed doors.<\/p>\n<p style=\"font-weight: 400;\">And penalties cannot deter illegal conduct if corporations can simply absorb them as another business expense.<\/p>\n<p style=\"font-weight: 400;\">Farm Action is formally opposing the proposed settlements.<\/p>\n<p style=\"font-weight: 400;\">Under federal antitrust law, a federal court must determine whether the proposed judgments are in the public interest. Through October 17, Americans can formally oppose the proposed settlements by <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/08\/07\/2026-16112\/united-states-et-al-v-cal-maine-foods-inc-et-al-proposed-final-judgment-and-competitive-impact\">submitting a public comment<\/a> to the DOJ.<\/p>\n<p style=\"font-weight: 400;\">Americans are tired of paying more for groceries. They are also tired of watching powerful institutions operate by a different set of rules.<\/p>\n<p style=\"font-weight: 400;\">If the DOJ believes its own allegations, it should pursue consequences commensurate with them.
