Dan Sullivan loses next month.<\/p>\n<p>The <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.akd.80263\/gov.uscourts.akd.80263.1.0.pdf\" target=\"_blank\" rel=\"noopener\">complaint\u00a0<\/a>argues that the presence on the ballot of another candidate named Daniel J. Sullivan is a purposeful attempt to mislead voters and thwart the will of the electorate.<\/p>\n<p>\u201cGiven the substantial likelihood that the inclusion of Daniel J. Sullivan will confuse or mislead voters looking to cast a vote for Senator Sullivan, and thus distort the will of Alaskan voters, there is a substantial likelihood that a certification of the election will reflect an electoral process that lacked integrity,\u201d DOJ wrote.<\/p>\n<p>\u201cThe United States has a substantial and legally cognizable interest in maintaining the integrity of elections,\u201d the complaint states. \u201cThe United States likewise suffers an injury when the certification of the election for a federal office is tainted by a frivolous candidacy because that undermines confidence in the make-up and workings of the federal government.\u201d<\/p>\n<p>Alaska has rank-choice voting, which permits the top four vote-getters in the primary to advance to the general election. If no candidate receives an outright majority in the general election, voters\u2019 second-choice selections are factored in until someone reaches over 50 percent of the tally.<\/p>\n<p>It is a process anticipated to take weeks, <a href=\"https:\/\/www.cnn.com\/2026\/10\/23\/politics\/doj-sues-alaska-dan-sullivan-us-senate?\" target=\"_blank\" rel=\"noopener\">CNN<\/a> reported.<\/p>\n<p>Alaska\u2019s Division of Elections <a href=\"https:\/\/www.elections.alaska.gov\/wp-content\/uploads\/2026\/06\/Final-Determination-6.15.2026-DOE.pdf\" target=\"_blank\" rel=\"noopener\">removed<\/a> Daniel J. Sullivan from the primary ballot in June, determining his was not an \u201cactual good-faith candidacy, but was instead filed with a purpose to confuse or mislead, thereby compromise the ballot\u2019s fairness or neutrality.\u201d<\/p>\n<p>However, Alaska\u2019s Supreme Court <a href=\"https:\/\/s3.documentcloud.org\/documents\/28830911\/s19935-2026-06-29-o0.pdf\" target=\"_blank\" rel=\"noopener\">overruled<\/a> the agency, determining he could appear as a Republican candidate. <a href=\"https:\/\/www.westernjournal.com\/court-looks-decide-fate-decoy-candidate-name-senator\/\" target=\"_blank\" rel=\"noopener\">Daniel J. An election result may be impacted by voter confusion if: (1) Senator Sullivan does not win the election; and (2) had all votes cast for Daniel J. Sullivan been cast instead for Senator Sullivan and Alaska\u2019s rank-choice process played out accordingly, Senator Sullivan would have won the election.\u201d<\/p>\n<p>The ballot lists Sen. Dan Sullivan as the incumbent to prevent confusion, so likely most of those seeking to make him their first choice will do so, but even a small bleed-off of votes could prevent him from receiving the majority needed before rank-choice voting kicks in.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">This is how the candidates are listed on Alaska\u2019s ballots. Sullivan is in a tight re-election race with former Democrat U.S. Rep. Mary Peltola, who is up by approximately 1 percent, according to <a href=\"https:\/\/www.realclearpolling.com\/polls\/senate\/general\/2026\/alaska\/peltola-vs-sullivan\" target=\"_blank\" rel=\"noopener\">Real Clear Polling<\/a>. But as CNN data expert Harry Enten recently noted, Republicans tend to<a href=\"https:\/\/www.westernjournal.com\/cnn-data-guru-hidden-gop-vote-easily-keep-senate-republican-hands\/\" target=\"_blank\" rel=\"noopener\"> underpoll<\/a> by about 3.5 percent.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/trump-puts-money-mouth-announces-spending-400-million-important-midterm-elections-ever\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> posted Wednesday on <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/117482201426939709\" target=\"_blank\" rel=\"noopener\"><\/a>, \u201cI am very concerned about the Dan S. Sullivan Race for the U.S. Senate in Alaska in that it is totally confusing, with the Dumocrats putting up another man, totally unrelated to Politics, named Daniel J. Sullivan, Jr. It\u2019s ridiculous that the Court didn\u2019t stop this SCAM. Even 1, 2, or 3% could make the difference.\u201d<\/p>\n<p>\u201cDan S. Sullivan is leading by a lot, but this is CHEATING in an Election, and the Judge that allowed this to happen should be ashamed of himself. We are looking at powerful legal options to remove the fraudulent Daniel J. Sullivan Jr. from the Ballot, and holding the Democrats accountable for their Election Interference, in the pursuit of Justice and Fairness.\u201d<\/p>\n<p>The president also addressed the issue at a rally in Wasilla, Alaska, earlier this week, with Sen. He should not even BE on the ballot.<\/p>\n<p>DOJ says the candidacy\u2019s \u201csole purpose\u201d is to help Peltola. Sullivan received about <a href=\"https:\/\/www.elections.alaska.gov\/enr26\/results\/ElectionSummaryReportRPT.pdf\" target=\"_blank\" rel=\"noopener\">2.5 percent<\/a> of the vote.<\/p>\n<p>CNN reported that the DOJ\u2019s case has been assigned to federal district court Judge Sharon L.
