The charges come amid an ongoing legacy media <a href=\"https:\/\/thefederalist.com\/2026\/10\/20\/28-charged-in-noncitizen-voting-bust-hours-after-leslie-stahl-says-its-not-an-issue\/\" target=\"_blank\" rel=\"noreferrer noopener\">campaign<\/a> to undermine enforcement of voting laws, in part by claiming noncitizen voting rarely or never occurs.<\/p>\n<p class=\"wp-block-paragraph\">Indiana Attorney General Todd Rokita announced alongside Vigo County Prosecutor Terry Modesitt that Francisco Aguilar Romero, a Mexican national who is \u201cin the United States illegally, and holds DACA status,\u201d is being <a href=\"https:\/\/image.subscription.in.gov\/lib\/fe2e11747364047b721071\/m\/1\/0c50ac6c-d846-4bd2-ad93-b8feaeacb5fc.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">charged<\/a> with felony violations for false or fraudulent voter registration, perjury, and voting by an ineligible person.<\/p>\n<div id=\"fdrlst__b89e9-1921233995\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">According to the affidavit of probable cause, Romero \u201cfreely admitted\u201d to both registering to vote and voting in Indiana elections. Records show Romero registered to vote at a department of motor vehicles location \u201cby completing the Voter Registration (VRG) form\u201d in 2018 and later resubmitted, reverified, or amended it in 2023. The form only asks prospective voters to check a square box attesting under penalty of perjury that they are telling the truth about their citizenship status. On both forms the \u201cYES\u201d box was checked. <\/p>\n<p class=\"wp-block-paragraph\">Romero claims he \u201cwas not provided with the information on the form and he did not fill out any of the information himself.\u201d The <a href=\"https:\/\/image.subscription.in.gov\/lib\/fe2e11747364047b721071\/m\/1\/83c67278-e120-4a6e-b88d-d460c002c315.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">affidavit of probable cause<\/a> states the fields on both of Romero\u2019s forms were \u201csystem generated\u201d and \u201cnot handwritten.\u201d Romero also claims DMV workers informed him he was eligible to vote, though DMV workers deny that they ever interacted with Romero.<\/p>\n<p class=\"wp-block-paragraph\">Romero further attests that upon receiving a voter registration card, he went and voted successfully after \u201cpresent[ing] his ID and voter registration card.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Romero allegedly voted in the 2018, 2020, 2022 and 2024 general elections, as well as a handful of off-year municipal elections.<\/p>\n<p class=\"wp-block-paragraph\"><strong>[READ: <a href=\"https:\/\/thefederalist.com\/2026\/05\/04\/wapo-admits-many-democrat-voters-cant-prove-theyre-citizens\/\" target=\"_blank\" rel=\"noreferrer noopener\">WaPo Admits Many Democrat Voters Can\u2019t Prove They\u2019re Citizens<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Current federal law does not require <a href=\"https:\/\/thefederalist.com\/2026\/10\/21\/lawsuit-l-a-officials-accept-any-voters-citizenship-claims-despite-records-of-illegal-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">proof of citizenship<\/a> to register to vote. Early this year Republicans in the House passed the Safeguard American Voter Eligibility (SAVE) America Act, which would amend the 1993 National Voter Registration Act to require documentary proof of citizenship to register to vote and voter ID to cast a ballot. The legislation has stalled in the Senate, where a few RINOs joined forces with Democrats to prevent the legislation from passing. Notably, the Supreme Court <a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">has interpreted<\/a> federal law to prohibit states from asking for documentary proof of citizenship for federal registration forms.<\/p>\n<p class=\"wp-block-paragraph\">And while the current system allows prospective voters to use a Social Security number or driver\u2019s license identification number to confirm a prospective voter\u2019s identity, neither guarantees citizenship since noncitizens \u2014 like Romero\u2013 can obtain both of those items.<\/p>\n<p class=\"wp-block-paragraph\">The Department of Homeland Security <a href=\"https:\/\/thefederalist.com\/2026\/07\/16\/dhs-more-than-250000-noncitizens-are-registered-to-vote-in-four-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> in July that there are more than 250,000 noncitizens illegally registered to vote in just four states alone: California, Pennsylvania, New Jersey, and Nevada.<\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">   Brianna Lyman is an elections correspondent at The Federalist.
