pfTrackEvent(&#039;9th Circuit Court Smacks Down California Law Unmasking ICE Agents For Violence-Hungry Leftists&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">A federal appellate court shot down a California law on Wednesday that sought to require ICE agents to show identification while conducting immigration operations in the state.<\/p>\n<p class=\"wp-block-paragraph\">In its <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca9.167d6a39-64cf-42f7-809c-23622d5495f4\/gov.uscourts.ca9.167d6a39-64cf-42f7-809c-23622d5495f4.45.1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unanimous ruling<\/a>, a three-judge panel for the 9th Circuit Court of Appeals held that Section 10 of the state\u2019s No Vigilantes Act violates the U.S. Constitution\u2019s <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artVI-C2-1\/ALDE_00013395\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supremacy Clause<\/a>, which specifies that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/missouri-will-defend-its-citizens-state-shoots-back-at-doj-over-gun-laws\/\" title=\"\u2018Missouri Will Defend Its Citizens\u2019: ... Shoots Back At DOJ Over Gun ...s\">federal law supersedes state law<\/a>. The panel was comprised of Judge Jacqueline Nguyen, an Obama appointee, and Judges Mark Bennett and Daniel Collins, both Trump appointees.<\/p>\n<div id=\"fdrlst__b89e9-2828116484\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">According to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/6148426-california-immigration-enforcement-id-law-appeals-court-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Hill<\/a>, the Justice Department sued the Golden State last year after Democrat Gov. Gavin Newsom signed the No Vigilantes Act, \u201cwhich demands that plainclothes law enforcement officers operating in California \u2018shall visibly display identification.&#8217;\u201d In conjunction with California\u2019s No Secret Police Act \u2014 \u201cwhich <a href=\"https:\/\/amzn.to\/3YuVZYV\" >banned federal law enforcement officers<\/a> from wearing masks while carrying out operations in the state\u201d \u2014 \u201cthe law took effect on Jan. 1 and required officers to show identification while performing their duties.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The 9th Circuit previously granted the Trump administration\u2019s emergency request to block the contested statute while the court considered the merits of the issue.<\/p>\n<p class=\"wp-block-paragraph\">In affirming that blockade, Bennett and his colleagues concluded that the Trump administration is \u201ccertain to succeed\u201d on the merits of its supremacy clause argument because Section 10 of the No Vigilantes Act \u201cattempts to directly regulate the United States in its performance of governmental functions, and Congress has not authorized such regulation.\u201d The Supremacy Clause, the Trump appointee noted, explicitly bars states \u201cfrom directly regulating federal operations even when regulating <em>state<\/em> operations in the same manner.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cIn sum, if a state law directly regulates the governmental conduct of the United States without congressional authorization, it is void irrespective of whether the regulated activities are essential to federal functions or operations, and irrespective of the degree to which the state law interferes with such functions or operations,\u201d Bennett wrote. <\/p>\n<p class=\"wp-block-paragraph\">The 9th Circuit\u2019s decision reverses the district\u2019s denial of a preliminary injunction and remands the case back to the lower court to enter such an injunction prohibiting California from enforcing the challenged law against federal officials. <\/p>\n<p class=\"wp-block-paragraph\"><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/10\/01\/lets-track-every-lie-dems-and-media-invented-to-demonize-immigration-agents\/\" target=\"_blank\" rel=\"noreferrer noopener\">Let\u2019s Track Every Lie Dems And Media Invented To Demonize Immigration Agents<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">The appellate court\u2019s ruling comes amid Democrat activists\u2019 <a href=\"https:\/\/thefederalist.com\/2026\/01\/07\/deadly-anti-ice-car-ramming-is-latest-of-more-than-100-attacks-on-immigration-agents\/\" target=\"_blank\" rel=\"noreferrer noopener\">attacks<\/a> against ICE agents performing their duties in the field. <\/p>\n<p class=\"wp-block-paragraph\">Last November, for example, a man with \u201canti-ICE\u201d engravings on his bullet casings <a href=\"https:\/\/thefederalist.com\/2025\/09\/24\/after-gavin-newsom-targeted-ice-on-colbert-shooter-tries-to-murder-ice-agents-in-dallas\/]\" target=\"_blank\" rel=\"noreferrer noopener\">opened fire<\/a> on an ICE transportation vehicle in Dallas, leaving two individuals dead. The shooting occurred shortly after Newsom called ICE\u2019s operations \u201cauthoritarian\u201d and called for people to \u201cpush back\u201d during an appearance on <em>The Late Show with Stephen Colbert<\/em>. <\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/thefederalist.com\/2026\/06\/16\/15-militants-indicted-for-forcefully-obstructing-ice-in-minnesota-in-antifa-cell-bust\/\" target=\"_blank\" rel=\"noreferrer noopener\">Other<\/a> anti-ICE <a href=\"https:\/\/thefederalist.com\/2026\/07\/21\/propaganda-press-hides-anti-ice-motive-behind-latest-act-of-left-wing-violence\/\" target=\"_blank\" rel=\"noreferrer noopener\">attacks<\/a> and <a href=\"https:\/\/thefederalist.com\/2026\/06\/01\/anti-law-enforcement-riots-like-new-jerseys-will-escalate-without-stronger-deterrence\/\" target=\"_blank\" rel=\"noreferrer noopener\">ops<\/a> have continued in the months since the Dallas incident. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
