pfTrackEvent(&#039;Calls Grow For SCOTUS To Stop California\u2019s Barfare Against John Eastman&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">Calls are pouring in for the U.S. Supreme Court to take up and stop California\u2019s ongoing barfare against constitutional attorney <a href=\"https:\/\/thefederalist.com\/tag\/john-eastman\/\" target=\"_blank\" rel=\"noreferrer noopener\">John Eastman<\/a>. <\/p>\n<p class=\"wp-block-paragraph\">The Heritage Foundation\u2019s Oversight Project and the America First Policy Institute (AFPI) filed <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-336\/429400\/20261013171254756_26-336%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">amicus<\/a> <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-336\/429408\/20261013174652901_26-336%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">briefs<\/a> on Tuesday urging the nation\u2019s highest court to hear arguments in <em><a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/26-336.html\" target=\"_blank\" rel=\"noreferrer noopener\">Eastman v. State Bar of California<\/a><\/em>  during its 2026 term. At least four justices must agree to hear a case before it can be considered by the full court. <\/p>\n<div id=\"fdrlst__b89e9-2991751210\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">At issue is California\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/04\/16\/california-bar-strips-john-eastman-of-livelihood-for-representing-a-client-with-views-it-dislikes\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent decision<\/a> to strip Eastman of his law license over <a href=\"https:\/\/thefederalist.com\/2023\/10\/25\/democrats-campaign-to-disbar-john-eastman-is-designed-to-criminalize-republican-election-challenges\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal advice<\/a> he gave President Donald Trump regarding the latter\u2019s 2020 election challenges. The Claremont Institute senior fellow is one of several conservative attorneys targeted by the left\u2019s <a href=\"https:\/\/thefederalist.com\/tag\/barfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">barfare machine<\/a> for his 2020 election conduct, with other notable <a href=\"https:\/\/thefederalist.com\/2026\/08\/20\/leftists-wage-barfare-against-dhs-attorney-for-criticizing-rogue-judges\/\" target=\"_blank\" rel=\"noreferrer noopener\">victims<\/a> including Ken Paxton and <a href=\"https:\/\/thefederalist.com\/2026\/08\/26\/former-ags-blast-dc-bars-disciplinary-jihad-against-jeff-clark\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jeff Clark<\/a>, who <a href=\"https:\/\/x.com\/JeffClarkUS\/status\/2110124017478729969?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">signed<\/a> onto the Oversight Project\u2019s amicus filing as part of his role with the organization.<\/p>\n<p class=\"wp-block-paragraph\">In their briefs, the Oversight Project and AFPI laid out several arguments on why the Supreme Court should grant Eastman\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/09\/16\/john-eastman-asks-scotus-to-shut-down-californias-politicized-barfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">petition<\/a> to take up his case. <\/p>\n<p class=\"wp-block-paragraph\">The Oversight Project contended that the California Supreme Court\u2019s decision affirming Eastman\u2019s disbarment rules afoul of the Constitution\u2019s <a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/article-6\/clause-2\/supremacy-clause-current-doctrine\" target=\"_blank\" rel=\"noreferrer noopener\">supremacy clause<\/a> because the California Bar\u2019s Review Department \u201cconceded that <a href=\"https:\/\/www.law.cornell.edu\/wex\/strict_scrutiny\" target=\"_blank\" rel=\"noreferrer noopener\">strict scrutiny<\/a> governs Eastman\u2019s core political speech\u201d advising the president, \u201cthen announced that the standard mattered only \u2018[t]o the extent\u2019 it was \u2018relevant.&#8217;\u201d \u201cState tribunals,\u201d the group reasoned, \u201ccannot demote this Court\u2019s First Amendment holdings to optional reading.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Heritage-aligned organization further argued that the California Supreme Court\u2019s decision should be vacated because SCOTUS\u2019s precedents indicate that the issues at play are strictly federal matters. \u201cPut together, California had no authority to disbar Eastman on this record,\u201d the brief reads. <\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"pnDLc4\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\ud83d\udea8\ud83d\udea8\ud83d\udea8<\/p>\n<p>We&#39;ve just filed our Oversight Project amicus brief in support of John Eastman&#39;s petition for certiorari to the U.S. Supreme Court asking the Justices to take up, and hopefully reverse, his disbarment in California.<\/p>\n<p>Our position is that Dr. Eastman&#39;s advocacy for\u2026<\/p>\n<p>\u2014 Jeff Clark (@JeffClarkUS) <a href=\"https:\/\/x.com\/JeffClarkUS\/status\/2110124017478729969?ref_src=twsrc%5Etfw\">October 13, 2026<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p class=\"wp-block-paragraph\">Meanwhile, AFPI described Eastman\u2019s disbarment as \u201cthe culmination\u201d of the left\u2019s ongoing barfare campaign targeting conservative lawyers they disagree with. Allowing such a scheme to succeed against Eastman, they noted, \u201cthreatens attorney independence, the right to counsel, and public trust in the integrity of the profession.\u201d <\/p>\n<p class=\"wp-block-paragraph\">\u201cState bar regulated attorney discipline exists to protect the public and ensure that political influences present in everyday politics do not dictate attorney-client relationships or infect the integrity of the profession,\u201d the filing reads. \u201cHijacking attorney disciplinary processes for political vendettas harms not only attorneys and their clients, but also the public\u2019s trust in the fairness and impartiality of our judicial system.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cAmici call upon this Court, the Court of last resort for Petitioner and many others, to protect the independence and neutrality of state bar disciplinary proceedings from outside organizations and maligned actors who seek to weaponize those proceedings against their political and ideological opponents,\u201d it added. <\/p>\n<p class=\"wp-block-paragraph\">The AFPI brief was <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-336\/429408\/20261013174733312_26-336%20Appendix.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">signed<\/a> by Conservative Partnership Institute senior legal fellow Cleta Mitchell, Judicial Watch senior attorney Christina Bobb, former Trump Justice Department senior official Ed Martin, and numerous others. <\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court has not scheduled Eastman\u2019s petition for distribution at any of its upcoming conferences as of this article\u2019s publication, according to the <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/26-336.html\" target=\"_blank\" rel=\"noreferrer noopener\">case\u2019s docket file<\/a>. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
