Kelly was not persuaded.<\/p>\n<p>\u201cThere is practically nothing national security-related in the record connected to the President\u2019s decision to revoke Plaintiffs\u2019 hard passes to which the Court can defer,\u201d he wrote in a 26-page opinion, according to NBC. \u201cStrikingly, there is just about no evidence in the record to explain or justify the \u2018ban\u2019 from a national security perspective.\u201d He called national security a post-hoc justification.<\/p>\n<p><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.296754\/gov.uscourts.dcd.296754.50.0.pdf\" target=\"_blank\" rel=\"noopener\">Kelly wrote<\/a> that Trump\u2019s own words showed the reason was content.<\/p>\n<p>\u201cPresident Trump likely banned Plaintiffs from the White House because he believes that their reporting is generally inaccurate and biased against him,\u201d the judge wrote, according to NBC.<\/p>\n<p>He cited Trump\u2019s remarks to <a href=\"https:\/\/time.com\/article\/2026\/10\/01\/donald-trump-2026-interview-transcript\/\" target=\"_blank\" rel=\"noopener\">Time magazine<\/a> about coverage of his White House, specifically calling out CNN and MS NOW. That was enough, Judge Kelly said, to show a likely causal link between the outlets\u2019 protected speech and the revoked passes.
