Glenn Youngkin, the DOJ report notes.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">The fallout from the rape case is widely viewed to have contributed to Youngkin\u2019s upset victory over Democratic former Gov. Terry McAuliffe in November 2021.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cScott Smith is a dedicated parent who\u2019s faced unwarranted charges in his pursuit to protect his daughter. Scott\u2019s commitment to his child despite the immense obstacles is emblematic of the parental empowerment movement that started in Virginia,\u201d Youngkin said in a <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.fox5dc.com\/news\/youngkin-pardons-va-dad-charged-for-speaking-out-at-school-board-meeting-following-daughters-sexual-assault\" target=\"_blank\" rel=\"noopener\">statement<\/a> to Fox News 5 in 2023.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cI am pleased to grant Scott Smith this pardon and help him and his family put this injustice behind them once and for all.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">The student who brutally attacked Mr. Smith\u2019s daughter was found guilty of sexual battery and forcible sodomy in October 2021.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Despite the DOJ report identifying him as transgender, the skirt-wearing assailant identified as male and just wanted to have sex in the bathroom, his mother claimed in a November 2021 <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.dailymail.com\/news\/article-10156749\/Mother-skirt-wearing-teen-raped-female-classmate-says-identifies-male.html?ito=social-twitter_dailymailus\" target=\"_blank\" rel=\"noopener\">interview<\/a> with the Daily Mail.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Just five days after the NSBA sent the letter to Biden, Attorney General Merrick Garland issued a memorandum weaponizing the FBI to investigate parents like Smith, creating a \u201cdedicated task force\u201d within the Biden-era DOJ to \u201cdetermine federal enforcement options for investigating and prosecuting parents\u201d who spoke out about policies impacting their children\u2019s health, safety, and education, the Trump administration DOJ\u2019s report alleges.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cThe initial skepticism of Department of Justice personnel proved well founded.
