The White House aims to remove Cook, a Biden appointee, by establishing a committee composed of officials from the President\u2019s economic advisory team, EEOC, and the Office of Government Ethics to examine the charges and determine if there is cause for her removal. Trump previously attempted to fire Cook in August 2025, but faced legal challenges that prevented her removal until the Supreme Court\u2019s recent decision, which emphasized that cause and due process must be established. the Court\u2019s majority opinion argued that Cook must be given an possibility to respond before a final decision, leading to a new procedural hearing scheduled for November 5. The hearing process includes presentations of evidence, Cook\u2019s opportunity to contest the allegations, and questioning by the committee, though it will not be publicly broadcast. The ruling also sparked dissent from several justices who argued that the president\u2019s removal powers should allow for her removal without notice or a hearing under certain conditions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President Trump has launched a probe into Federal Reserve Gov. <a href=\"https:\/\/thefederalist.com\/tag\/lisa-cook\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lisa Cook<\/a> over mortgage fraud allegations, the White House announced Friday. The move appears aimed at removing Cook from the post following an unfavorable Supreme Court ruling on the matter earlier this year.<\/p>\n<p>\u201cAs President, it is my job to ensure the laws are faithfully executed, including by firing subordinates who cannot be trusted to tell the truth and follow the law,\u201d Trump wrote in Friday\u2019s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/10\/establishment-of-a-committee-of-inquiry-to-investigate-allegations-of-false-statements-by-lisa-denell-cook\/\" target=\"_blank\" rel=\"noreferrer noopener\">presidential memoranda<\/a>.<\/p>\n<p>The directive establishes a committee comprised of the president\u2019s assistant for economic policy, the Equal Employment Opportunity Commission chair, and the director of the Office of Government Ethics that will investigate allegations that Cook, a Biden appointee, \u201cmade false statements in connection with one or more mortgage instruments.\u201d The group will subsequently report to the president \u201cwhether there is \u2019cause\u2019 for Governor Cook\u2019s removal within the meaning\u201d of federal law \u201cas construed\u201d in the Supreme Court\u2019s <em><a href=\"https:\/\/thefederalist.com\/2026\/06\/29\/supreme-court-allows-lower-court-blockade-on-trumps-federal-reserve-firing-to-remain-in-place\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump v. Cook<\/a><\/em>  (2026) decision.<\/p>\n<p>Trump first sought to fire Cook over these allegations in August 2025, but was <a href=\"https:\/\/thefederalist.com\/2025\/10\/01\/scotus-declines-to-halt-lower-court-blockade-on-fed-gov-lisa-cooks-removal-for-now\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> by D.C. District Judge Jib Cobb, a Biden appointee. The administration ultimately filed an emergency application asking the Supreme Court to temporarily permit Cook\u2019s removal while litigation over her firing continued. The high court rejected the government\u2019s request in <em>Trump v. Cook<\/em>. <\/p>\n<p>Writing for the 5-4 majority, Chief Justice John Roberts <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a312_5468.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> there must be \u201ccause\u201d to fire Cook, and she must be afforded an \u201copportunity to respond to the charges made against her \u2026 [before] a final decision [can] be made.\u201d The majority declined to rule on \u201cthe ultimate question\u201d of whether Trump can remove Cook \u201cfor cause,\u201d arguing such a decision \u201cwill depend in part on the underlying facts\u201d that must first \u201cbe found or analyzed under the relevant legal standards.\u201d<\/p>\n<p>The court\u2019s decision prompted stinging dissents from Justices Clarence Thomas, Samuel Alito (joined by Neil Gorsuch), and Amy Coney Barrett. Thomas noted \u201c[a]pparent mortgage fraud was a \u2019cause\u2019 to remove Cook\u201d and underscored a point he raised during oral arguments \u2014 that \u201cthe statute authorizing the President to remove Cook for \u2019cause\u2019 says nothing about notice or a hearing, so it does not require notice and a hearing.\u201d The senior justice also argued the federal courts lack the authority to \u201center the relief\u201d the <em>Cook<\/em> majority upheld with its decision and further admonished the majority for infringing on the president\u2019s executive removal powers.<\/p>\n<p>Alito (and Gorsuch) argued that Trump showed a likelihood of success on the preliminary questions of whether \u201cfor cause\u201d removal applies to pre-office conduct and whether he violated Cook\u2019s due process rights. Meanwhile, Barrett blasted the majority for deciding significant legal matters that had not been fully briefed or contested, as well as the \u201cdisconnect between its holding and its disposition line.\u201d<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/06\/29\/john-roberts-presidents-have-executive-power-also-john-roberts-no-they-dont\/\" target=\"_blank\" rel=\"noreferrer noopener\">John Roberts: Presidents Have Executive Power. Also John Roberts: No, They Don\u2019t<\/a>]<\/strong><\/p>\n<p>Following the constraints established in <em>Cook<\/em>, Trump has directed the newly formed committee to \u201cconduct an in-person hearing to consider the evidence and allegations against Governor Cook\u201d on Nov. 5. The hearing will last \u201cno longer than 4 hours,\u201d according to the memoranda. <\/p>\n<p>The directive also grants Cook the ability to file a written statement with the committee contesting the allegations, so long as it is submitted at least three days in advance. While the Biden appointee will be given the opportunity to \u201cpresent argument, written evidence, and written witness statements regarding the evidence and allegations,\u201d the committee will be afforded the chance to \u201cquestion Governor Cook about any representations she or her counsel make during the hearing, or it may authorize its representatives, including Department of Justice personnel, to conduct that questioning.\u201d<\/p>\n<p>Cook and her team will be presented the evidence against her prior to the hearing. The committee may also request Cook turn over \u201cdocuments or other evidentiary submissions \u2026 as appropriate,\u201d which Cook is instructed to comply with.
