A group of Muslim doctors similarly have sought protection from the state mandate. The state has <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/becketfund.org\/media\/illinois-yields-again-on-assisted-suicide-this-time-for-muslim-doctors\/___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6NzozOTJkOjBmMTE5ZTcxYWY2ZGEzY2ZkOWVkMDNkMDQ1ZDY5OTRkYmYwMjYyNzYyZTczMmJjOWE5YmE2YjcwMTE3ZTcwNTY6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\">yielded<\/a> temporarily. In July, a federal judge shielded the Little Sisters of the Poor from New York\u2019s version. The message from the state in each case is the same: you may care for the dying, but you must also be ready to help kill them.<\/p>\n<p>The Supreme Court will <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/major-abortion-groups-assemble-file-lawsuit-over-unthinkable-texas-law-allowing-americans-to-sue-abortion-clinics-doctors\/\" title=\"Major Abortion Groups Assemble, File Lawsuit Over \u2018Unthinkable\u2019 Texas Law Allowing Americans To Sue Abortion Clinics, Doctors\">hear oral argument<\/a> on Nov. 3 in <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/becketfund.org\/case\/st-mary-catholic-parish-v-roy\/___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6Nzo4YmQ4OjI1OGYzOGIxNGI4M2Y5MTM1OGQ4M2FiNTk1ZjMwNDk5YjI2MWJmYmE0MWE5ZTEwYTk1ZThmZmE4ZDkyMGQxMmQ6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\"><em>St. Mary Catholic Parish v. Roy<\/em><\/a>. Colorado\u2019s universal preschool program requires participating schools to agree to operate at odds with Catholic teaching on marriage and sexuality. Parishes in the archdiocese of Denver could not agree to state requirements, so the state shut them out of the preschool program paying $6,000 per eligible child, along with the families who wanted their children taught there. Colorado says it has no problem with the preschools being Catholic, it just doesn\u2019t want them to operate as if they are.<\/p>\n<p>Catholicism is just one example of a religion whose exercise does not end at the sanctuary door. Catholics pray at Mass and live that prayer in the works of mercy: feeding the hungry, sheltering the homeless, visiting the sick, burying the dead, and instructing the ignorant. Faith asks to be lived coherently, in belief and in service to one another. Jews, Muslims, and Protestants would recognize the pattern in their own traditions. No one is free if he must split himself into a Sunday self and a Monday self, and no community is free that must do the same.<\/p>\n<p>The trouble is the left\u2019s drive to secularize everything, and it does not stop at who gets access to the public square. It demands secularization of religion itself, and of religious people. The nuns may care for the elderly and infirm, but they should also be willing to assist in their suicide. The Catholic preschool may teach four-year-olds, but it must \u201cget with the times\u201d on sex and gender. Charity is welcome so long as religion is nowhere near it. That is not neutrality. It is hostility.<\/p>\n<h2><strong>Scalia\u2019s Views<\/strong><strong><\/strong><\/h2>\n<p>New work from Donald Drakeman of Notre Dame may inadvertently offer an additional false argument from the secular left. While he hasn\u2019t mentioned these current controversies in commentary previewing a new <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/www.hup.harvard.edu\/books\/9780674299801___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6Nzo2NWJiOjU1MGEwMDA0NzQ3ZmZmNmQ1YzlkZGI3Nzc0MzVmMjYwZDJkNDAwOGJjYjVlMWJiMTlkZDIwZjhjZDg4NWQwZTQ6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\">book<\/a>, his theory would decide them. He argues that new archives show the founding-era understanding of \u201cfree exercise of religion\u201d was limited to public worship services. With that theory, the Constitution protects the nun kneeling in a chapel during Mass but says nothing about the same nun at a dying patient\u2019s bedside. Faith is a Sunday event. The rest of the week belongs to the state. That is a dangerous theory, and religious Americans and faith-based institutions should recognize it for what it is: an easy path toward muzzling them. <\/p>\n<p>Justice Antonin Scalia, whom Drakeman invokes, did not read the clause so narrowly.  <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/supreme.justia.com\/cases\/federal\/us\/540\/712\/___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6NzpiZGI1OmI2OTEwNjgwMTFiOTNjMjkzMWVmM2UxMTA2YmM3ZDIyYmFmMTdjNGE5ZWY2MDVkZGFkY2U1ZWFlMjU1MDYxZmM6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\">Dissenting<\/a> in <em>Locke v. Davey<\/em>, he would have held that Washington state could not deny a scholarship to a student because he chose to study theology, which is to say he treated the study of theology as religious exercise. He also joined the unanimous <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/supreme.justia.com\/cases\/federal\/us\/565\/171\/___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6NzoxMzY4OjZiODZmYTQ3MTQwMzIyMmVkNTRmNGExMzE1YmJjMzgxY2I5MWNlMWFkMTliYTNhYmZkNDhhZmRiNGRlODQ3MmU6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Hosanna-Tabor<\/em><\/a>  opinion interpreting the religion clauses as protecting a church\u2019s choice of ministers. Neither case involved a worship service. In <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/supreme.justia.com\/cases\/federal\/us\/494\/872\/___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6Nzo5OWFjOjg2MWRkMDk2NzU1NWFhMjQ5N2VlYzk4YWQ1ZjIwOTYxMzMwYWE1M2Q1MDU3YWJmNDk2NzA3ODU5NjQyMDY3N2Q6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Employment Division v. Smith<\/em><\/a>, Scalia wrote that the exercise of religion often involves not just belief but physical acts, and he listed assembling for worship, proselytizing, and abstaining from certain foods. He never confined the clause to the sanctuary. His argument was about accommodations, not whether religious exercise reaches beyond worship.<\/p>\n<p>Worship is the easiest thing to shut down, which is why government hostility often shows up there first.<\/p>\n<h2>The History of Free Exercise<\/h2>\n<p>Stanford\u2019s Michael McConnell, the preeminent originalist voice for robust religious exemptions, has yet to weigh in publicly on these new archival findings. Nevertheless, his vast body of work stands as the natural intellectual fortress against any attempt to shrink the free exercise clause to the sanctuary door. <\/p>\n<p>His <a href=\"https:\/\/protect.checkpoint.com\/v2\/r01\/___https:\/scholarship.law.wm.edu\/cgi\/viewcontent.cgi?article=1608&#038;context=wmlr___.YXAzOmNyY2E6YzpvZmZpY2UzNjVfZW1haWxzX2F0dGFjaG1lbnQ6OGJhY2JjNjUzOTk1ZWZkNjU2NTg4MmMzNTNhZTY0YzA6NzpjMWU3OjhkOWMzZGQxNWJlMTVhNjU3MjVkNjkxOWU1MDNmMjI5MTFhMTUzZDljZGE3ZjRmZjJkMGU2NDk2MWE5ZDBjYWY6cDpUOkY\" target=\"_blank\" rel=\"noreferrer noopener\">1998 article on the history of free exercise<\/a>, for example, supports the view that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utm_sourcerssutm_mediumrssutm_campaignmassachusetts-court-says-town-cant-build-statues-of-christian-heroes-because-theyre-christian\/\" title=\"Massachusetts Court: Town Can&#039;t Build Statues Of Christian Heroes\">founding generation understood<\/a> the right to reach conduct, not just worship. New York\u2019s 1777 constitution, like others of the era, protected religious liberty, but carved out acts of \u201clicentiousness\u201d and \u201cpractices inconsistent with the peace or safety\u201d of the state, a caveat that would have been pointless if the right ended at the church door. James Madison\u2019s \u201cMemorial and Remonstrance Against Religious Assessments\u201d goes further, calling each person\u2019s duty to the Creator \u201cprecedent, both in order of time and in degree of obligation, to the claims of Civil Society.\u201d<\/p>\n<p>A faith that may be freely exercised only within the church is a faith the state has already succeeded in controlling. The nun at the bedside and the families hoping to send their children to their parish preschool are not asking for special favors.
