Traditionally,companies use the H-1B visa to bring in foreign workers temporarily for specialized roles,with the process often used to convert these visas into permanent residency-a practice now being scrutinized and restricted. Vice President JD Vance announced the suspension of the PERM program for Microsoft,focusing on preventing abuse of the system. Microsoft responded by stating that most of their H-1B filings are extensions or internal transfers, not new hires, but critics argue that this still facilitates replacing American workers with foreign labor. Vance emphasized that foreign workers on H-1B visas should not be used as a backdoor for permanent immigration and reiterated that the U.S. should prioritize hiring American workers.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Trump administration acted this week to limit the ability of some H-1B visa holders to become permanent U.S. citizens by using a system that turns permission for temporary entry into a way to stay here forever. Predictably, the legacy media have botched the story.<\/p>\n<p>Vice President J.D. Vance, leading the <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/03\/establishing-the-task-force-to-eliminate-fraud\/\" target=\"_blank\" rel=\"noreferrer noopener\">White House Task Force to Eliminate Fraud<\/a>, announced on Thursday that the administration would be temporarily barring several corporations from seeking <a href=\"https:\/\/flag.dol.gov\/programs\/perm\" target=\"_blank\" rel=\"noreferrer noopener\">permanent labor certification<\/a> (PERM) for their H-1B workers. The PERM certification from the Department of Labor \u201callows an employer to hire a foreign worker to work permanently in the United States.\u201d<\/p>\n<p>The companies losing the ability to use PERM are Microsoft and the India-based \u201c<a href=\"https:\/\/www.reddit.com\/r\/cscareerquestions\/comments\/ueeq7c\/what_are_these_witch_companies_i_see_them_in\/\" target=\"_blank\" rel=\"noreferrer noopener\">WITCHes<\/a>,\u201d a slightly awkward acronym for Wipro, Infosys, Tata Consultancy Services, Cognizant, and HCL Tech. <\/p>\n<p>So a handful of giant corporations, including big India-based corporations that provide a flood of technical staff like software engineers to American tech companies, send tens of thousands of foreign laborers into the United States under the premise that they\u2019re coming temporarily: filling niches in the labor market that American workers are unable to fill, for a while, and then going home. <\/p>\n<p>But then, once the temporary guest workers arrive, those same corporations ask to convert the visa that allows a guest worker to visit the country into permission for permanent residency. <\/p>\n<p>Vance\u2019s announcement this week is that the administration is closing the door to companies that appear to have abused that pathway. For 180 days, with the possibility of an extension, it ends their ability to turn guest laborers into permanent residents.<\/p>\n<p>Remember what The Federalist <a href=\"https:\/\/thefederalist.com\/2026\/10\/02\/vance-slams-h-1b-visas-as-trump-scrutinizes-abuses-in-legal-immigration\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote a week ago<\/a>: When Congress created the H-1 category for guest workers \u201cof distinguished merit and ability,\u201d the 1952 law that established that category of visitors explicitly defined people working under H-1 status as \u201cnonimmigrant\u201d visitors. They were never supposed to be here to <em>stay<\/em>.<\/p>\n<p>You can read a detailed legislative history of the H-1B visa <a href=\"https:\/\/www.ilw.com\/immigrationdaily\/news\/2006,0403-crs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, and notice the opening description of the topic in the very first sentence: \u201cNonimmigrant temporary workers seeking employment in the United States \u2026\u201d When corporations use PERM to turn their H-1B workers into permanent residents, they\u2019re using a program for nonimmigrant temporary labor as a backdoor conduit for permanent lower-wage immigrant labor.<\/p>\n<p>You can watch Vance\u2019s entire press conference <a href=\"https:\/\/www.youtube.com\/live\/7QAu9FOEOv8\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, but here\u2019s an excerpt:<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Vice President JD Vance announces the suspension of the PERM Program for Microsoft:<\/p>\n<p>&#8220;Thanks to an ongoing investigation, we have decided to suspend the PERM program for Microsoft, which means they will no longer be able to take those H-1Bs and apply for permanent resident status\u2026 <a href=\"https:\/\/t.co\/xMSgLgcqTI\">pic.twitter.com\/xMSgLgcqTI<\/a><\/p>\n<\/div>\n<p>\u2014 Vice President JD Vance (@VP) <a href=\"https:\/\/x.com\/VP\/status\/2108215063702036519?ref_src=twsrc%5Etfw\">October 8, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Media coverage depicts Microsoft as \u201cpushing back\u201d on Vance\u2019s claims, but watch how they do it. Vance said that Microsoft laid off about 6,000 Americans while filing for visas to employ about 6,000 H-1B workers. The Seattle Times <a href=\"https:\/\/www.seattletimes.com\/business\/microsoft\/microsoft-pushes-back-on-vances-h-1b-visa-claims\/\" target=\"_blank\" rel=\"noreferrer noopener\">published this response<\/a> from the company:<\/p>\n<blockquote>\n<p>Of the roughly 6,000 H-1B visa applications the company filed during its 2026 fiscal year, 80% were to extend or change the status of Microsoft employees, according to the company. The rest were for foreign-born but U.S.-based workers of other companies who were joining Microsoft, which represent about 1% of the company\u2019s workforce.<\/p>\n<\/blockquote>\n<p>So they don\u2019t claim that they didn\u2019t lay off thousands of Americans while hiring thousands of foreign workers on H-1B visas, treating new visas for existing H-1B workers as being somehow unrelated to the point about laying off American workers while using nearly an equal number of foreign laborers. \u201cThey are not new arrivals to our country,\u201d Microsoft <a href=\"https:\/\/apnews.com\/article\/h1b-visa-program-vance-microsoft-e7b3a407f822702b269ee277d21343ea\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> the Associated Press. <\/p>\n<p>But that doesn\u2019t mean anything.
