Newman and her legal team argued that her suspension and removal were unlawful and unconstitutional, violating federal judicial conduct laws. Despite her petition to the Supreme Court, which expressed concerns about dangerous precedents, her case was rejected without description. afterward, transfer of her case to the 11th Circuit Judicial Council was ordered, intended to maintain public confidence in judicial accountability. pfTrackEvent(&#039;Rogue Judges Handed Major Loss In \u2018Unconstitutional\u2019 Scheme To Remove Their Colleague&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">A 99-year-old federal judge scored a major win on Tuesday in her fight against an \u201cunconstitutional\u201d effort to remove her from the bench.<\/p>\n<p class=\"wp-block-paragraph\">According to a <a href=\"https:\/\/www.ca11.uscourts.gov\/sites\/default\/files\/courtdocs\/clk\/11-26-90237%20(Judge%20Newman)%20Order%20Making%20Proceeding%20Public.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">new court order<\/a>, Supreme Court Chief Justice John Roberts transferred the judicial misconduct case of Federal Circuit Court Judge <a href=\"https:\/\/thefederalist.com\/tag\/pauline-newman\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pauline Newman<\/a> from the Federal Circuit to the 11th Circuit Court of Appeals. Appointed by President Ronald Reagan, Newman has served on the Federal Circuit for more than 40 years and is currently the oldest serving federal judge in the country. <\/p>\n<div id=\"fdrlst__b89e9-3278795996\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The entire debacle began in March 2023, when Federal Circuit Chief Judge Kimberly Moore and the Federal Circuit Judicial Council <a href=\"https:\/\/thefederalist.com\/2026\/06\/10\/scotus-to-decide-whether-rogue-judges-can-sideline-constitution-to-oust-their-colleague\/\" target=\"_blank\" rel=\"noreferrer noopener\">suspended<\/a> Newman over alleged concerns regarding her mental and physical health. Despite protests from Newman and her counsel, the New Civil Liberties Alliance (NCLA), this indefinite suspension \u2014 which remains ongoing \u2014 has barred the Reagan appointee from partaking in cases brought before the court.<\/p>\n<p class=\"wp-block-paragraph\">Newman and NCLA challenged her suspension and the Judicial Council\u2019s actions as unlawful. They argued that the body\u2019s de-facto removal of Newman was unconstitutional and violated provisions of the 1980 Judicial Council Reform and Judicial Conduct and Disability Act (\u201c<a href=\"https:\/\/www.congress.gov\/bill\/96th-congress\/house-bill\/7974\" target=\"_blank\" rel=\"noreferrer noopener\">the Disability Act<\/a>\u201c), which governs the process for filing misconduct and disability complaints against federal judges.<\/p>\n<p class=\"wp-block-paragraph\">D.C.-based District Judge Christopher Cooper rejected Newman\u2019s claims in 2024. Citing a past decision by the D.C. Circuit Court of Appeals, the Obama appointee argued that federal courts are precluded from hearing her case and that she must seek relief from the <a href=\"https:\/\/www.uscourts.gov\/administration-policies\/governance-judicial-conference\/about-judicial-conference-united-states\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Judicial Conference<\/a>. Cooper is best known for <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/6090649-trump-kennedy-center-inscription-judge\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocking<\/a> President Trump\u2019s renaming of the Kennedy Center earlier this year.<\/p>\n<p class=\"wp-block-paragraph\">A three-judge panel on the D.C. Circuit \u2014 comprised of all Democrat appointees \u2014 upheld Cooper\u2019s ruling on similar grounds in August 2025.<\/p>\n<p class=\"wp-block-paragraph\">Newman petitioned the U.S. Supreme Court to take up her case earlier this year. In doing so, she warned that permitting her indefinite suspension to continue would set a dangerous precedent by permitting to federal judges to effectively remove their colleagues from the bench. <\/p>\n<p class=\"wp-block-paragraph\">\u201cThis administrative removal of a judge who is famous for dissenting from her colleagues, by those same colleagues, with judicial refusal to review the merits of the action, undermines the judicial independence that is a vital foundation of our constitutional design,\u201d the filing <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-1101\/400775\/20260312164901795_Petition.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">reads<\/a>. \u201cEvery judge who gets crosswise with her chief judge or her colleagues must now worry whether similar tactics could be used to remove them.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court <a href=\"https:\/\/thefederalist.com\/2026\/06\/15\/scotus-rejects-plea-from-judge-to-end-unconstitutional-efforts-to-remove-her\/\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a> Newman\u2019s petition without explanation on June 15. <\/p>\n<p class=\"wp-block-paragraph\">According to Tuesday\u2019s order by 11th Circuit Chief Judge William Pryor, Chief Justice Roberts \u2014 who presides over the U.S. Judicial Conference \u2014 transferred Newman\u2019s case to the 11th Circuit Judicial Council on Aug. 19. This included \u201cany pending or new complaints relating to the same subject matter.\u201d <\/p>\n<p class=\"wp-block-paragraph\">Pryor revealed the transfer at the request of Newman, who sought its disclosure \u201cto maintain public confidence in the judiciary\u2019s ability to redress misconduct or disability,\u201d according to the order. <\/p>\n<p class=\"wp-block-paragraph\">NCLA released a <a href=\"https:\/\/nclalegal.org\/press_release\/ncla-update-judge-pauline-newmans-matter-transferred-to-eleventh-circuit-judicial-council\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> Tuesday praising the transfer of Newman\u2019s case as \u201cwelcome news.\u201d <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
