The article warns that future Democrat-controlled Congresses could continue these tactics,using subpoenas and investigations to harass dissenters,emphasizing the importance of voting in upcoming elections to counter this trend.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Sunday marked five years since then-Attorney General Merrick Garland issued a <a href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/justice-department-addresses-violent-threats-against-school-officials-and-teachers\" target=\"_blank\" rel=\"noreferrer noopener\">memorandum<\/a> that instructed his Department of Justice (DOJ) to help investigate and prosecute parents who showed up at school board meetings to complain about far-left initiatives or Covid policies. Five years later we now know that the Biden White House was behind Garland\u2019s effort to target parents, The Federalist\u2019s Matt Kittle reported. <\/p>\n<p>The anniversary and new finding also come on the heels of former Special Counsel Jack Smith\u2019s testimony before Congress last week, in which his lawfare efforts to keep President Donald Trump out of office faced further scrutiny. With the midterms less than a month away, both instances serve to remind Americans of what Democrats will do with power given the chance: wage a lawfare campaign against their political opponents.<\/p>\n<h2>Parents Became Public Enemy No. 1<\/h2>\n<p>Back in September of 2021, the National School Boards Association (NSBA) sent a letter to the Biden administration asking it to take on the \u201cimmediate threat\u201d that parents posed to their children\u2019s schools. The \u201cthreat\u201d stemmed from parents who were voicing their concerns and criticisms about critical race theory curriculum, mask mandates, and vaccine mandates. The NSBA <a href=\"https:\/\/thefederalist.com\/2026\/10\/05\/report-biden-white-house-drove-doj-targeting-of-parents-who-protested-crt-covid-mandates\/\" target=\"_blank\" rel=\"noreferrer noopener\">wanted the Biden administration<\/a> to treat the parents speaking out as \u201cequivalent to a form of domestic terrorism.\u201d Notably, the NSBA later apologized and acknowledged \u201cthere was no justification for some of the language included in the letter.\u201d<\/p>\n<p>Nonetheless, Garland had issued a memo entitled \u201cPartnership Among Federal, State, Local, Tribal, and Territorial Law Enforcement to Address Threats Against School Administrators, Board Members, Teachers, and Staff.\u201d The memo instructed the FBI to meet with federal, state, and local law enforcement to focus on the alleged threats and how to respond to them. As a result of this memo, the federal government opened 25 preliminary assessment files regarding alleged \u201cschool board threats.\u201d<\/p>\n<p>In other words, a Democrat-led \u201cjustice\u201d department decided that questioning or <a href=\"https:\/\/amzn.to\/3YuVZYV\" >opposing left-wing thought orthodoxy<\/a> like CRT justified the investigation of ordinary Americans with the intent of prosecution.<\/p>\n<p>Nonetheless, the NSBA claimed that an <a href=\"https:\/\/www.k12dive.com\/news\/nsba-independent-review-finds-no-biden-administration-collusion-in-controve\/624281\/\" target=\"_blank\" rel=\"noreferrer noopener\">independent review<\/a> found that there was no collusion with the Biden administration.\u00a0But a new report from the DOJ reveals, as Kittle put it, \u201cthe Biden White House was squarely behind Garland\u2019s effort to find a federal \u2018hook\u2019 to prosecute parents and school policy protesters with federal crimes.\u201d<\/p>\n<p>According to the new report, DOJ senior officials and loyalists Biden put in place there \u201cinitially pushed back\u201d on the NSBA\u2019s request to target parents, \u201cquestioning the constitutionality of the request.\u201d In fact, one email shows Kevin Chambers, then-associate deputy attorney general, calling the effort to enlist federal law enforcement and the claim that parents were domestic terrorists \u201cridiculous.\u201d But the DOJ ultimately \u201cmoved ahead with issuing the Garland Memorandum based on pressure from Biden Administration officials in the White House and leadership at the Office of the Deputy Attorney General (\u2018ODAG\u2019) at the Department of Justice.\u201d<\/p>\n<p>The Biden administration also coordinated with the NSBA on \u201ctalking points\u201d to counter parents and other opponents of critical race theory and transgender ideology, Kittle reported.<\/p>\n<h2>Jack Smith\u2019s Lawfare Escapades <\/h2>\n<p>In addition to these further revelations of Biden administration overreach, Special Counsel Jack Smith, an appointee of Garland, and the anti-Trump lawfare he led during the 2024 election cycle again took center stage last week. Sen. Chuck Grassley, R-Iowa, revealed during a Senate Judiciary Committee hearing that Smith <a href=\"https:\/\/thefederalist.com\/2026\/09\/29\/breaking-jack-smith-spied-on-and-targeted-the-federalist-during-bidens-anti-trump-witch-hunt\/\">obtained comm<\/a><a href=\"https:\/\/thefederalist.com\/2026\/09\/29\/breaking-jack-smith-spied-on-and-targeted-the-federalist-during-bidens-anti-trump-witch-hunt\/\" target=\"_blank\" rel=\"noreferrer noopener\">unications<\/a> from more than a dozen media outlets, including those of The Federalist\u2019s Editor-in-Chief Mollie Hemingway. Smith obtained the messages as part of his \u201cArctic Frost\u201d witch hunt, which was an unconstitutional effort to get Trump that resulted in Smith\u2019s team spying on members of Congress and the media.<\/p>\n<p>Smith\u2019s team<a href=\"https:\/\/thefederalist.com\/2026\/09\/29\/jack-smith-spying-on-trump-donors-is-latest-dem-ploy-to-chill-americans-political-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\"> also target<\/a><a href=\"https:\/\/thefederalist.com\/2026\/09\/29\/jack-smith-spying-on-trump-donors-is-latest-dem-ploy-to-chill-americans-political-speech\/\">ed<\/a> nearly 5,000 Americans who made political donations to President Donald Trump, Grassley announced. One Iowan who donated $10 to the president just months before the 2020 election had his home address, bank information, and other personal information handed over to the Biden administration\u2019s weaponized FBI and DOJ.<\/p>\n<p>Democrats targeted parents who challenged what their children were being taught, journalists who scrutinized the Biden administration, and Americans who gave Trump as little as $10. They used regular acts of political participation as justification for government investigation and overreach. With each abuse of power, Democrats sent the American people a stark message: Speaking up or disagreeing with the narratives of the regime could put them on the government\u2019s target list.<\/p>\n<p>That\u2019s the legacy voters need to remember this November. A Democrat-controlled Congress would give the same party subpoena power, committee leadership roles, and resources to do what it\u2019s done in the past: investigate and harass its opponents. Democrats don\u2019t need to get back into the White House to haul Americans before committees or demand their records.
