And the damage done demands an anti-weaponization fund to compensate victims of a far-reaching Department of Justice, one victim of Smith\u2019s witch hunt says. <\/p>\n<h2>\u2018A Runaway Political Train\u2019<\/h2>\n<p>Last week, Senate Judiciary Committee Chair Chuck Grassley, R-Iowa, released a new <a href=\"https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/breaking-jack-smith-obtained-journalist-communications-with-government-sources\" target=\"_blank\" rel=\"noreferrer noopener\">tranche of documents<\/a> showing Smith \u2014 the <a href=\"https:\/\/thefederalist.com\/2024\/07\/19\/this-week-in-lawfare-land-dismissal-of-classified-docs-case-deals-major-blow-to-doj\/\" target=\"_blank\" rel=\"noreferrer noopener\">unconstitutionally-named<\/a> former special counsel \u2014 and his team grabbed up communications from 17 news outlets, including The Federalist, in the corrupt investigation to take out then-former President Donald Trump. Ron Johnson, R-Wis., chairman of the Senate Permanent Subcommittee on Investigations, <a href=\"https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/news-jack-smiths-investigative-team-secretly-obtained-text-messages-from-44-members-of-congress-amid-trump-probe\" target=\"_blank\" rel=\"noreferrer noopener\">called Smith\u2019s probe <\/a>\u201canother grotesque example of the Biden administration\u2019s weaponization of the Justice Department.\u201d Johnson, too, was spied on. <\/p>\n<p>As The Federalist reported, Sen. Marsha Blackburn, R-Tenn., on Wednesday filed a <a href=\"https:\/\/nclalegal.org\/filing\/complaint-for-declaratory-and-injunctive-relief-and-nominal-damages\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> alleging the disgraced former prosecutor unlawfully seized her cell phone records. Smith also obtained a non-disclosure order blocking Blackburn and her congressional colleagues from seeing what the spooks were up to. Blackburn\u2019s lawsuit alleges Smith and crew did not tell the presiding judge that the subpoenas they sought were aimed at a sitting senator\u2019s records. <\/p>\n<p>Blackburn also charges that Smith\u2019s appointment by then-Attorney General Merrick Garland was unconstitutional. Federal Judge Aileen Cannon said the same in <a href=\"https:\/\/thefederalist.com\/2025\/01\/27\/judge-cannon-body-slams-biden-dojs-last-ditch-lawfare-effort\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> that Smith was illegally appointed as special counsel to prosecute a bogus classified documents case against Trump.<\/p>\n<p>\u201cHe subpoenaed a sitting senator\u2019s tolling records in secret, a blatant violation of <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artI-S6-C1-3-1\/ALDE_00013300\/\" target=\"_blank\" rel=\"noreferrer noopener\">the Speech or Debate Clause<\/a>,\u201d Margaret Harker, senior Litigation Counsel at the New Civil Liberties Alliance, the public-interest law firm representing Blackburn, said during a recent episode of <a href=\"https:\/\/www.spreaker.com\/episode\/why-bringing-jack-smith-to-justice-should-matter-to-all-americans--75521164\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Federalist Radio Hour<\/em>.<\/a> \u201cHe obtained a nondisclosure order to ensure Sen. Blackburn would never find out about it\u00a0 \u2014 he did not disclose the relevant facts of the NDO.\u201d<\/p>\n<p>During the hearing, Smith said he stood by his decisions, including bringing four federal counts against Trump on allegations the president feloniously attempted to overturn the results of the rigged 2020 election. <\/p>\n<p>\u201cI made these decisions without regard to President Trump\u2019s political association, activities, beliefs, or candidacy in the 2024 presidential election,\u201d\u00a0 Smith said \u2014 with a straight face, nonetheless \u2014 in his <a href=\"https:\/\/www.politico.com\/f\/?id=000001a0-eaf4-d975-a9a5-faf7ecf30000\" target=\"_blank\" rel=\"noreferrer noopener\">opening statement.<\/a><\/p>\n<h2>\u2018Exploring All Legal Options\u2019 <\/h2>\n<p>The documents unveiled in congressional investigations show an overzealous, partisan actor who abused power he legally did not have to go after the Democrat\u2019s no. 1 political enemy and his allies, <a href=\"https:\/\/www.newsweek.com\/jack-smith-democrat-lawfare-complex-hit-man-opinion-1946504\" target=\"_blank\" rel=\"noreferrer noopener\">bastardizing laws and a using a phony \u201cinsurrection\u201d to do it.<\/a> <\/p>\n<p>Sean Davis, co-founder and CEO of The Federalist, said the shocking revelations make clear that Smith wasn\u2019t just trying to bankrupt and put Donald Trump in prison for the rest of his natural life. The Biden administration worked with Big Tech to censor the Federalist and The Daily Wire for their \u201cinconvenient\u201d coverage of Covid, vaccine mandates, election integrity, and harassment of pro-life protesters. Earlier this year year, the news outlets and Texas Attorney General Ken Paxton won a major First Amendment case when a federal district court <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-secures-major-win-alongside-daily-wire-and-federalist-defeating-media\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> government entities to stop \u201cknowingly censor constitutionally protected speech or lead third parties to do so.\u201d<\/p>\n<p>Davis said he is \u201cexploring all legal options\u201d in response to Smith and his investigators spying on The Federalist. He said Smith cannot be allowed to get away with what he did to the Constitution and to the fundamental rights of Americans. <\/p>\n<p>\u201cSomebody has to pay a price to make sure this isn\u2019t done again,\u201d he said. \u201cI\u2019m trying to get all the facts, find out the exact nature of what and who he was spying on and what he got, but I am absolutely exploring all options to make sure this never happens to us \u2014 or anyone else \u2014 again.\u201d<\/p>\n<h2>\u2018They Deserve Restitution\u2019 <\/h2>\n<p>The deeper scope of Smith\u2019s abuse of power underscores the need for an anti-weaponization fund for victims of federal prosecutorial abuse, The Federalist CEO said. Attorney General Todd Blanche put the settlement fund on ice following political pressure from Democrats who cheered on Biden administration witch hunts against conservatives and from weak-stomach Republicans constantly cuckolded by Democrats and their friends in the accomplice media. <\/p>\n<p>A Clinton-appointed federal district court judge and an appeals court led by two Obama appointees have <a href=\"https:\/\/www.washingtontimes.com\/news\/2026\/sep\/29\/appeals-court-wont-block-sanctions-trumps-lawyers-weaponization-fund\/?srsltid=AU7gw4UjbxU-2oDZ1hTwD0oRW_jK7OdBivyZ9iacMZgz58LZWc2Rc9ea\" target=\"_blank\" rel=\"noreferrer noopener\">agreed with critics<\/a> of the approximately $1.8 billion fund, arguing that Trump and the Justice Department colluded in creating it. <\/p>\n<p>The lawsuits and the rulings disregard some critical facts: That Americans were ground under the machinery of weaponized justice in the name of politics. Like the <a href=\"https:\/\/thefederalist.com\/2026\/10\/05\/report-biden-white-house-drove-doj-targeting-of-parents-who-protested-crt-covid-mandates\/\" target=\"_blank\" rel=\"noreferrer noopener\">parents harassed and intimidated<\/a> by law enforcement officials for speaking out at school board meetings against Covid-era and woke policies. Or the pro-life Americans <a href=\"https:\/\/www.ncregister.com\/cna\/six-pro-life-activists-convicted-of-federal-face-act-charges-face-over-a-decade-in-prison\" target=\"_blank\" rel=\"noreferrer noopener\">sentenced to lengthy prison sentences<\/a> for praying outside abortion factories. Or the government whistleblowers who brought Smith\u2019s and other corruption to light. <\/p>\n<p>Davis noted that the left \u2014 particularly in the Obama and Biden administrations \u2014 have established big payouts to their political allies under the guise of <a href=\"https:\/\/www.uschamber.com\/regulations\/sue-and-settle-regulating-behind-closed-doors\" target=\"_blank\" rel=\"noreferrer noopener\">\u201csue and settle\u201d actions.<\/a> The lawsuits, brought by special interest groups against federal agencies (with a wink and a nod from the agencies) are designed to create policies and initiatives and then use taxpayer funding to pay for them. Obama-era sue and settle actions were <a href=\"https:\/\/judiciary.house.gov\/media\/press-releases\/goodlatte-calls-on-doj-to-recover-taxpayer-money-obama-administration-funneled\" target=\"_blank\" rel=\"noreferrer noopener\">described as <\/a>\u201cengineered windfall(s) for special interests masquerading and a settlement.\u201d Leftist groups have been funded for decades through the schemes. <\/p>\n<p>\u201cSo I found it fascinating that after we all watched the government target and victimize innocent people, this was an instance [Smith\u2019s abuses] where restitution was absolutely necessary, where victims needed to be made whole, and instead you had a bunch of Democrats and completely worthless, feckless Republicans stop it and say, \u2018Whoa! Whoa! Whoa! Whoa!
