Kathy Hochul has involved herself in the case <a href=\"https:\/\/www.westernjournal.com\/cornell-7-case-turns-political-kathy-hochul-gets-involved-executive-order\/\" target=\"_blank\" rel=\"noopener\">via executive order<\/a>, taking it out of the hands of the Tomkins County District Attorney\u2019s Office and appointing a special prosecutor.<\/p>\n<p>The special prosecutor is New York Attorney General Letitia James, a woman who not only established a national reputation for <a href=\"https:\/\/www.westernjournal.com\/insider-letitia-james-office-says-ordered-go-trump-linked-people-orgs-find-pursue\/\" target=\"_blank\" rel=\"noopener\">politically driven pursuit<\/a> of President Donald Trump, but who has also already made public her <a href=\"https:\/\/www.westernjournal.com\/watch-letitia-james-no-answer-reporter-points-big-problem-cornell-move\/\" target=\"_blank\" rel=\"noopener\">far-from-impartial opinion<\/a> about the guilt of the accused in the Cornell case.<\/p>\n<p>But text conversations between the woman \u2014 unidentified other than the alias \u201cJane Doe\u201d \u2014 and two of the men she accused \u2014 Jonathan Newell and Matthew Ingalls \u2014 show just how cloudy a criminal case is going to be, three years after the event began on Oct. 19, 2024.<\/p>\n<p>\u201cAt the end of the day non of the sexual stuff was illegal and honestly i really liked being w u and matt,\u201d she wrote to Newell in an Oct. 21, 2024, text, according to a <a href=\"https:\/\/www.nytimes.com\/2026\/10\/01\/nyregion\/cornell-rape-accusation-reporting.html\" target=\"_blank\" rel=\"noopener\">New York Times<\/a> report Friday.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">This text message alone, from Jane Doe to one of the Cornell 7, send just 2 days after the alleged SA renders any prosecution inviable https:\/\/t.co\/Cx1AmUXWJF<\/p>\n<p>\u2014 Phil Holloway (@PhilHollowayEsq) <a href=\"https:\/\/x.com\/PhilHollowayEsq\/status\/2106020394125672946?\">October 2, 2026<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>\u201cThis text message alone, from Jane Doe to one of the Cornell 7, send just 2 days after the alleged SA renders any prosecution inviable,\u201d Fox News legal analyst Phil Holloway wrote in a post on the social media platform X.<\/p>\n<p>And that wasn\u2019t all.<\/p>\n<p>In The New York Times report, the woman is described as becoming increasingly dismayed in the days after the event \u2014 particularly as word about it began to spread on campus.<\/p>\n<p>However, she was still \u201ceager\u201d to attend a Halloween party at the very same fraternity house, according to the report.<\/p>\n<p>\u201cText messages included in the investigation show Mr. Ingalls assuring Jane Doe that he and other fraternity members wanted her to be there,\u201d The New York Times reported.<\/p>\n<p>Supposedly relaying the views of the fraternity president, Ingalls texted the woman that \u201cchi phi is your house and you are welcome here,\u201d according to the report.<\/p>\n<p>The woman responded: \u201cthank u i really appreciate that. <3 i\u2019ll bring my cigs tomorrow.\u201d(for readers who grew up using rotary phones, the \u201c<3\u201d is <a href=\"https:\/\/linguaholic.com\/linguablog\/less-than-three-meaning\/\" target=\"_blank\" rel=\"noopener\">text slang<\/a>, indicating a heart shape, albeit sideways.)<\/p>\n<p>But the invitation was rescinded by the fraternity\u2019s president \u2014 who is not accused in the case.<\/p>\n<p>He told her it was for her own good, according to the report. And she took that badly.<\/p>\n<p>\u201cI knew this was going to happen,\u201d she wrote in text to Ingalls. \u201cThe woman will always get the short end of the stick. Yall aren\u2019t my friends. Yall are covering your asses.\u201d<\/p>\n<p>Then the New York Times report included an understated segue:<\/p>\n<p>\u201c<strong>By Nov. 3,<\/strong> Jane Doe appears to have concluded that she was assaulted at the October party.\u201d [Emphasis added.]\n<p>So, it wasn\u2019t really a sexual assault until Nov. 3? Days after the alleged victim had been disinvited from a Halloween party she was<em> eager to attend<\/em> at the same location with the same people where she was supposedly raped less than two weeks earlier?<\/p>\n<p>By the time the young woman did give a statement to the Cornell Police Department (the campus police), it was Nov. 8, according to <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2026\/09\/30\/cornell-7-jane-doe-rape-case-timeline\/92003702007\/\" target=\"_blank\" rel=\"noopener\">USA Today<\/a>, more than three weeks after the incident (but only a week after Halloween).<\/p>\n<p>A six-page summary of her interview with the police \u2014 a summary Doe signed off on \u2014 was provided to the district attorney\u2019s office, which declined to bring criminal rape charges based on the fact that the woman had described her actions as \u201cvoluntary, conscious, and consensual,\u201d USA Today reported.<\/p>\n<p>She was obviously understandably unhappy with the results, but criminal law is criminal law, not a therapy session for sorority sisters.<\/p>\n<p>Could any prosecutor in good conscience attempt to bring a criminal case based on this kind of context? The answer, of course, is \u201cno.\u201d But we\u2019re not talking about a prosecutor with a conscience. We\u2019re talking about New York Attorney General <a href=\"https:\/\/www.westernjournal.com\/4-words-long-time-dem-operative-dressed-letitia-james-anti-trump-antics\/\" target=\"_blank\" rel=\"noopener\">Letitia James<\/a>, who has a demonstrated record of warping the law for her own political purposes.<\/p>\n<p>None of this is to defend the men who are accused in the case \u2014 and could well face at least the potential for severe criminal penalties. By all accounts, they behaved appallingly. Some were expelled from Cornell as a result of the event. Some were suspended.<\/p>\n<p>(The woman reportedly left the university on her own.)<\/p>\n<p>It is a question of how far liberals are willing to twist the law in the service of politics.<\/p>\n<p>Decent men and women can feel sympathy for this young woman but be disgusted by her behavior.<\/p>\n<p>Decent men and women can be disgusted by the behavior of the men, but still oppose the abuse of criminal law because liberals want another soapbox to jump on. (New York Rep.
