The McLaughlin Associates survey found that nearly 64% support the &#8220;Keep Nine&#8221; amendment, which constitutionally guarantees nine justices, with only about 18% opposing it. Support among Democrats stands at 46%, while a majority of independents also back the idea. Despite public backing for a fixed Supreme court size, prominent Democrats like Rep. James Clyburn and Kamala Harris have proposed expanding the court, with discussions suggesting increases to 13 or more justices. Notably, nearly every single House Republican and one Democrat, Don Davis of North Carolina, supported the amendment during a Sept. 2 vote that came to 212-206. Fifteen members did not vote. The measure failed to get the two<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-led-kansas-legislature-passes-transgender-athlete-bill-sends-to-democrat-governor\/\" title=\"GOP-Led Kansas Legislature Passes Transgender Athlete Bill, Sends to Democrat Governor\">-thirds majority needed<\/a> to pass it.<\/p>\n<p class=\"wp-block-paragraph\"><strong>[READNEXT:[READNEXT:<a href=\"https:\/\/thefederalist.com\/2020\/10\/06\/when-fdr-tried-it-court-packing-backfired-big-time\/\">When FDR Tried It, Court-Packing Backfired Big Time<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">The new poll asked respondents: \u201cWould you support or oppose an Amendment to the U.S. Constitution, Called \u2018Keep Nine\u2019 Which States: \u2018The Supreme Court of the United States shall be composed of nine justices?&#8217;\u201d<\/p>\n<p class=\"wp-block-paragraph\">Amongst all respondents, nearly 64 percent supported the amendment while nearly 18 percent opposed it. When broken down among party lines, 46 percent of Democrats support the Keep Nine Amendment and 54 percent of independents support it. <\/p>\n<p class=\"wp-block-paragraph\">Yet despite the public favoring keeping the court at nine justices by a more than 3-1 margin, Democrats are promising to expand the court should they take back power.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThirteen is a pretty good number,\u201d <a href=\"https:\/\/www.breitbart.com\/clips\/2026\/08\/30\/clyburn-we-need-to-expand-the-supreme-court-to-a-bakers-dozen\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. James Clyburn<\/a>, D-S.C., said on NBC\u2019s <em>Meet the Press<\/em> in August. \u201cA baker\u2019s dozen would be a good number to have on the court.\u201d<\/p>\n<p class=\"wp-block-paragraph\">His calls for expanding the Supreme Court are among a cacophony of voices on the left who want to expand the bench should Democrats take back power. <\/p>\n<p class=\"wp-block-paragraph\">Former Vice President Kamala Harris <a href=\"https:\/\/ktvz.com\/politics\/cnn-us-politics\/2026\/07\/31\/kamala-harris-says-the-us-supreme-court-should-expand-to-13-justices\/\" target=\"_blank\" rel=\"noreferrer noopener\">advocated<\/a> for expanding the bench to 13 justices and has called for Supreme Court reform. Rep. <a href=\"https:\/\/www.newsmax.com\/us\/pramila-jaypal-democrats-surpeme-court\/2026\/06\/26\/id\/1261054\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pramila Jayapal<\/a>, D-Wash., said in June that Democrats are \u201cabsolutely\u201d going to try and expand the court after the Supreme Court\u2019s decision on Temporary Protected Status.<\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/keystonenewsroom.com\/news\/politics\/deluzio-supreme-court-expansion\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep.
