If approved, the amendment would <a href=\"https:\/\/amzn.to\/3YuVZYV\" >broadly protect extensive reproductive rights<\/a>, including unfettered abortion access at any stage, removal of parental notification requirements for minors, and no obligation to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-lawmakers-pass-bill-that-would-make-blocking-emergency-vehicles-a-felony\/\" title=\"Texas Lawmakers Pass Bill That Would Make Blocking Emergency Vehicles a Felony\">provide life-saving care<\/a> to babies born alive during an abortion. The language of the amendment is vague and expansive, perhaps allowing unregulated clinics and broad legal protections for those performing or assisting with abortions, with no age limits specified. Critics argue it undermines parental rights, facilitates abuse and trafficking of minors, and promotes a profit-driven industry without oversight. Opposition groups-including medical professionals and Virginia\u2019s Catholic bishops-have challenged the legality of the ballot question and warn of serious consequences. Despite legal challenges and opposition, Democrats have pushed the amendment through a Democratic-controlled legislature, with critics describing the process as rushed, lacking clarity, and lacking bipartisan support. Many believe voters should oppose the amendment and scrutinize their legislators\u2019 support for it.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Early voting in Virginia\u2019s midterm elections opened Sept. 18, with the inclusion of a limitless abortion amendment on the ballot. If passed, the far-reaching, Democrat-backed amendment would enshrine unchecked abortions for minors of any age, abortionists leaving abortion survivors to die, and abortion until birth in the state\u2019s constitution.<\/p>\n<p>The stakes are high.<\/p>\n<p>The ballot asks voters, \u201cShould the Constitution of Virginia be amended to (i) protect the freedom to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; (ii) protect doctors, nurses, and patients from being punished for these decisions; and (iii) allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient\u2019s health is at risk or the pregnancy cannot survive?\u201d<\/p>\n<p>The obscure and broad language would provide expansive legal protections for undefined \u201creproductive health care.\u201d<\/p>\n<p>Abortion law in Virginia is already permissive, allowing for late-term abortions if three physicians conclude a pregnancy would cause the mother grave harm. The language of the amendment allows for the tearing apart of a fully formed baby in the womb if the sole profiting abortionist performing the surgery approves. The <a href=\"https:\/\/thefederalist.com\/2024\/07\/26\/no-abortion-is-never-medically-necessary\/\" target=\"_blank\" rel=\"noreferrer noopener\">misnomer<\/a> of lifesaving \u201cnecessary\u201d abortion would extend to mental health, per the abortionist\u2019s discretion.<\/p>\n<p>Under current law, abortionists may be prosecuted for performing a third-trimester abortion outside of the legal criteria, <a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title18.2\/chapter4\/section18.2-76\/\" target=\"_blank\" rel=\"noreferrer noopener\">failing to procure consent<\/a> from the mother for the procedure, or <a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title18.2\/chapter4\/section18.2-71.1\/\" target=\"_blank\" rel=\"noreferrer noopener\">performing a partial-birth abortion<\/a>.<\/p>\n<p>If passed, the amendment would provide sweeping protections for these death dealers. No professional licensing requirements are listed. Anyone \u201cassisting\u201d in a woman\u2019s \u201cright\u201d to an abortion is protected, as long as voluntary consent is procured.<\/p>\n<p>Shockingly, <em>no<\/em> age limit is included in the amendment\u2019s language. The terminology \u201cindividual,\u201d which carries a \u201cfundamental right to reproductive freedom,\u201d is used in lieu of \u201cadult\u201d in terms of abortion, and consensual sexual activity. The language undermines parental rights, including no notification or consent requirements. If that sounds radically dangerous for young Virginians, it is. This lack of clear legal boundaries for the person accompanying a minor would open the door for abuse, coercion, and trafficking.<\/p>\n<p>Furthermore, abortion industry bias would define legally protected \u201cclinical standards of care,\u201d inviting the potential for unregulated <a href=\"https:\/\/www.osvnews.com\/house-of-horrors-abortionist-dies-in-prison-pro-life-advocates-call-for-stronger-protections\/\" target=\"_blank\" rel=\"noreferrer noopener\">houses of horror<\/a> \u2014 a death-for-profit industry determining its own care standards is in no one\u2019s best interest.<\/p>\n<p>Finally, Democrats ensured the inclusion of one last atrocity: babies born alive during an abortion would have no right to life-saving care.<\/p>\n<h2>Legal Opposition<\/h2>\n<p>Radically reduced parental rights, taxpayer funding of abortion, lack of accountability for anyone pursuing a leftist cause in the name of \u201creproductive health care,\u201d increased sexual abuse and coercion of children, radical measures forced upon Christian ministries, and unregulated surrogacy and infanticide are just some of the grave and valid concerns of those opposing the bill.<\/p>\n<p>Since passing two consecutive sessions by Virginia\u2019s Democrat-majority legislature in January, <a href=\"https:\/\/www.liveaction.org\/news\/virginia-appeals-court-challenge-abortion-ballot-measure?utm_source=social&#038;utm_medium=LANFacebook&#038;utm_content=canvapost&#038;fbclid=IwY2xjawUdVcdwZG9mBGV4dG4DYWVtAjExAHNydGMGYXBwX2lkDzQwOTk2MjYyMzA4NTYwOQABHswMN5T5gockDLhq6PAEAJiPofYlMNY9DPhAv5HI6rMW5FnTLGMdYLuxwTa9_aem_nBRP3II1wPieqRBLihuRQg\" target=\"_blank\" rel=\"noreferrer noopener\">multiple<\/a> groups have contested the legality of the ballot questions and proposed amendment through lawsuits. <a href=\"https:\/\/virginiamedicalprofessionals.com\/?fbclid=IwY2xjawUIQtJwZG9mBGV4dG4DYWVtAjExAHNydGMGYXBwX2lkDzQwOTk2MjYyMzA4NTYwOQABHoZHnYM44C3XIObTgwcA7N2ugU-uIlXgGg2qt8i_EbG_hrJ_-OWj12nzdgw2_aem_FVioK0STgnamZZARxxBdeA\" target=\"_blank\" rel=\"noreferrer noopener\">Medical professionals<\/a> across the state have denounced the vague language and lack of safeguards, and in a historic move, Virginia\u2019s Catholic bishops instructed all priests to urge Catholics to vote \u201cno\u201d during Sunday homilies prior to early voting.<\/p>\n<p>Days before early voting opened, a lawsuit to remove the amendment from the ballot faced a major setback when a lower court denied its motion to circumvent an appellate hearing to be heard by the Supreme Court. The plaintiffs requested an expedited high-court hearing, but will have to wait until Oct. 19 to be heard in the Virginia Court of Appeals, more than a month after voting is underway.<\/p>\n<p>Although Democrats\u2019 attempt to secure new, illegally-drawn voting maps through a ballot measure was blocked by the state\u2019s supreme court earlier this year, abortion amendments have by and large been successfully passed into law in left-leaning states.<\/p>\n<h2>A Failed Process<\/h2>\n<p>Virginia\u2019s Democrat-majority legislature now leans <em>far<\/em> left.<\/p>\n<p>Sen. Glen Sturtevant described Virginia\u2019s abortion amendment as \u201cthe most expansive, extreme constitutional amendment that has been pushed around the country.\u201d<\/p>\n<p>\u201cWhen we were combatting this on the floor, we really focused on the fact that the amendment \u2026 would clearly cover minors seeking an abortion,\u201d Sturtevant said. \u201cThe amendment would trump state law, and effectively overturn parental consent laws we have on the books.\u201d<\/p>\n<p>But the Democratic majority voted Republicans down, also killing the inclusion of born alive care requirements.<\/p>\n<p>Although she ran as a moderate in 2025, Democrat Gov. Abigail Spanberger has championed the abortion amendment, and approved the incomplete, misleading language that now sits before voters on the ballot.<\/p>\n<p>\u201cConstitutional amendments should meet at least three standards \u2014 seriousness, clarity, and bipartisanship,\u201d said Mark Earley, attorney and former Virginia delegate. \u201cAmendment 1 fails on all three fronts.\u00a0It was rushed through committee while rebuffing serious witness testimony, the language is vague and undefined, and it passed without a shred of bipartisanship \u2014 not even one Republican vote.\u201d<\/p>\n<p>Lawmakers take an oath to serve and protect the public.
