It should exist to enrich the American economy.&#8221; <a href=\"https:\/\/t.co\/7bunZ97u5Z\">pic.twitter.com\/7bunZ97u5Z<\/a><\/p>\n<\/div>\n<p>\u2014 Vice President JD Vance (@VP) <a href=\"https:\/\/x.com\/VP\/status\/2104269134741831909?ref_src=twsrc%5Etfw\">September 27, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>In 1952, the <a href=\"https:\/\/www.govtrack.us\/congress\/bills\/82\/hr5678\/text\" target=\"_blank\" rel=\"noreferrer noopener\">McCarran-Walter Act<\/a> reorganized the American immigration system over President Harry Truman\u2019s overridden <a href=\"https:\/\/history.state.gov\/milestones\/1945-1952\/immigration-act\" target=\"_blank\" rel=\"noreferrer noopener\">veto<\/a>. Among the features of the new law was a provision allowing for the temporary entry of \u201can alien having a residence in a foreign country which he has no intention of abandoning \u2026 who is of distinguished merit and ability and who is coming temporarily to the United States to perform temporary services of an exceptional nature requiring such merit and ability.\u201d That law created the H nonimmigrant classification for guest workers, which included a new H-1 category for highly skilled visitors.<\/p>\n<p>In 1990, Congress amended those requirements, replacing the language about \u201cdistinguished merit\u201d with a \u201cspeciality occupation\u201d category for work that requires \u201ctheoretical and practical application of a body of highly specialized knowledge.\u201d (You can read a detailed legislative history of the H-1B visa <a href=\"https:\/\/www.ilw.com\/immigrationdaily\/news\/2006,0403-crs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.)<\/p>\n<p>The thing we know as the H-1B visa was born in that definition, and you can see the implication: America was opening its doors to the finest minds in the world, allowing brilliance to flow to our shores. How could we turn away the extraordinary gifts of the German physicist, the deep skill of the Scandinavian chemist, the exquisite professional expertise of the Taiwanese materials engineer?<\/p>\n<p>From the most recent <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/data\/fy25_h1b_characteristics_congress_signed_04242026.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">annual report<\/a> of the Department of Homeland Security on the \u201cCharacteristics of H-1B Specialty Occupation Workers,\u201d here\u2019s what we got:<\/p>\n<figure><figcaption>\n<div>\n<p>         <span>Image Credit<\/span>Screenshot       <\/p>\n<\/div>\n<\/figcaption><\/figure>\n<p>The H-1B visa has become a pipeline to India for cheap software guys, sitting under florescent lights in Palo Alto and fixing the glitches on the app you just used to order a burrito delivery. The much-noticed crisis in H-1B visas is a topic of both political controversy and growing scholarly scrutiny, all of which was recently <a href=\"https:\/\/cityjournal.substack.com\/p\/the-troubles-with-the-h-1b-program\" target=\"_blank\" rel=\"noreferrer noopener\">discussed at length<\/a> by Robert Verbruggen at City Journal. Among other conclusions, Verbruggen writes, \u201cManhattan Institute senior fellow George Borjas made waves with his <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=6200366\" target=\"_blank\" rel=\"noreferrer noopener\">finding<\/a> that H-1B holders are underpaid relative to similar Americans.\u201d<\/p>\n<p>You can click on the link to that paper from Borjas to find this conclusion: \u201cOn average, H-1B workers earn 16 percent less than comparable natives.\u201d <\/p>\n<p>A category of nonimmigrant temporary labor that was designed to bring scientific and technical knowledge to the United States has become a tool to lower American wages and replace American workers. As the Wall Street Journal <a href=\"https:\/\/archive.ph\/zdGHN#selection-1631.0-1631.215\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> in 2025, \u201cAmazon, the largest H-1B sponsor in the U.S., won approval for more than 14,000 H-1B visas in fiscal 2025 \u2014 the most of any company \u2014 even as it has announced layoffs affecting tens of thousands of jobs in recent years.\u201d Americans leave with a pink slip, foreign workers arrive with a visa, and \u201con average, H-1B workers earn 16 percent less than comparable natives.\u201d<\/p>\n<p>Software engineers arriving from India on H-1B visas are mostly not the huddled masses yearning to breathe free, taking their shot in America like your grandma who paid her own way to Ellis Island with a steerage-class ticket. Rather, they mostly come from India-based body farms like <a href=\"https:\/\/www.infosys.com\/about.html\" target=\"_blank\" rel=\"noreferrer noopener\">Infosys<\/a>, which sell cheap tech labor by the box lot. <\/p>\n<p>Last year, the Trump administration <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/restriction-on-entry-of-certain-nonimmigrant-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">imposed<\/a> a $100,000 fee on many new H-1B visas, though the collection of that fee has been <a href=\"https:\/\/www.reuters.com\/legal\/government\/second-judge-blocks-trumps-100000-fee-new-h-1b-worker-visas-2026-10-01\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked by federal judges<\/a>. <\/p>\n<p>In a new order issued this month, Trump explicitly <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2026\/09\/fact-sheet-president-donald-j-trump-further-enhances-program-integrity-and-interagency-coordination-in-the-h-1b-visa-program\/\" target=\"_blank\" rel=\"noreferrer noopener\">required<\/a> federal agencies \u201cto consider petitioner employers\u2019 recent or planned layoffs of similarly situated U.S. workers when considering H-1B visa applications,\u201d pursuing a reduction of new applications under conditions of increased scrutiny.<\/p>\n<p>Though he framed it this week as his own position rather than a policy statement from the administration, Vance is becoming more explicit about his view that the specialty occupation visa needs more than tinkering and may be beyond salvation: \u201cMy view is the H1-B program is completely broken.\u201d<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Vice President JD Vance on H1-B visas:<\/p>\n<p>&#8220;If you\u2019re going to bring in an accountant making $45,000 a year to replace an accountant who is an American making $60,000 a year, that\u2019s not you using the program to bring in a genius. That\u2019s you destroying American jobs and defrauding\u2026 <a href=\"https:\/\/t.co\/2yhrBzrnT8\">pic.twitter.com\/2yhrBzrnT8<\/a><\/p>\n<\/div>\n<p>\u2014 Vice President JD Vance (@VP) <a href=\"https:\/\/x.com\/VP\/status\/2105732496897855711?ref_src=twsrc%5Etfw\">October 1, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>The appearance of debate inside the administration suggests the possibility of a growing crackdown, but real action to sharply limit H-1B visas would require congressional action. <em>Many<\/em> bills on that topic are parked in committee, right now, and here\u2019s one example as a closing thought: The \u201cHigh-skilled Immigration Reform for Employment Act,\u201d <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/6305\/text\" target=\"_blank\" rel=\"noreferrer noopener\">H.R.6305<\/a>, was introduced in November by <a href=\"https:\/\/krishnamoorthi.house.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep.\u00a0Raja Krishnamoorthi<\/a>, an Illinois Democrat. It would sharply <em>increase<\/em> the annual cap on new H-1B visas, from 65,000 a year to 130,000.<\/p>\n<p>As Krishnamoorthi notes in his <a href=\"https:\/\/krishnamoorthi.house.gov\/media\/press-releases\/congressman-krishnamoorthi-reintroduces-hire-act-bolster-us-competitiveness\">press release<\/a> on the bill, \u201cThe legislation is supported by ITServe Alliance, the nation\u2019s largest association of IT services organizations.\u201d<\/p>\n<p>Elections matter.<\/p>\n<hr>\n<p>      Chris Bray is a senior correspondent at The Federalist and a former infantry sergeant in the U.S. Army.
