Barbosa da Cunha<\/em> during its 2026 term. The case deals with whether the federal government can detain certain categories of illegal aliens during their removal proceedings without a bond hearing. <\/p>\n<div id=\"fdrlst__b89e9-951377264\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">At issue is a revised Department of Homeland Security (DHS) policy adopted last year. As <a href=\"https:\/\/www.scotusblog.com\/2026\/10\/court-agrees-to-hear-arguments-in-important-immigration-case-religious-zoning-dispute\/\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by SCOTUSblog, the guidance relies \u201con a provision of federal immigration law indicating that noncitizens \u2018shall be detained\u2019 for a removal proceeding \u2018if the examining immigration officer determines that\u2019 they are \u2018not clearly and beyond a doubt entitled to be admitted\u2019 to the United States.\u201d <\/p>\n<p class=\"wp-block-paragraph\">\u201cUntil last year,\u201d the outlet noted, \u201cthe government had not applied that provision to noncitizens who already had entered the U.S. and spent years or even decades here.\u201d By applying this new policy, the administration aimed to detain these individuals without a bond hearing. <\/p>\n<p class=\"wp-block-paragraph\">According to the <a href=\"https:\/\/www.justice.gov\/d9\/2026-07\/barbosa_da_cunha_hold_pet_-_final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">government\u2019s brief<\/a>, the <em>Rhoney<\/em> case centers around Ricardo Aparecido Barbosa da Cunha, a Brazilian national who unlawfully entered America \u201caround 2004 or 2005\u201d and was arrested by immigration officials at a traffic stop last year. The Trump administration subsequently initiated removal proceedings against him \u201cfor being present in the United States without being admitted or paroled, and being inadmissible under [federal law], for not possessing valid immigration documents.\u201d<\/p>\n<p class=\"wp-block-paragraph\">As such, the agency concluded that Barbosa da Cunha would be detained throughout the rest of his removal proceedings. An immigration judge later denied his request for a bond hearing.<\/p>\n<p class=\"wp-block-paragraph\">Barbosa da Cunha filed a <a href=\"https:\/\/www.law.cornell.edu\/wex\/habeas_corpus\" target=\"_blank\" rel=\"noreferrer noopener\">habeas corpus<\/a> petition challenging his detention without a bond hearing, claiming that the administration had violated the Fifth Amendment\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-kraken-released-attorney-sidney-powell-files-104-page-bombshell-complaint-of-massive-fraud-in-georgia-election-update-michigan-too\/\" title=\"BREAKING: KRAKEN RELEASED! A federal district court later granted his request and ruled that the INA provision cited by the government \u201cdoes not apply to [Barbosa da Cunha], and that instead his detention is governed by [a separate INA provision], which permits release on bond or conditional parole while an alien\u2019s removal proceedings unfold.\u201d<\/p>\n<p class=\"wp-block-paragraph\">As a result, Barbosa da Cunha received a bond hearing and was subsequently released on bond in October 2025. The 2nd Circuit Court of Appeals later upheld the lower court\u2019s ruling.<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court\u2019s decision to take up the case likely stemmed from the circuit courts\u2019 split on the policy. According to <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-trump-mandatory-detention-policy-rhoney-v-barbosa-da-cunha\/\" target=\"_blank\" rel=\"noreferrer noopener\">CBS News<\/a>, two of them have sided with the administration, while nine have ruled against. <\/p>\n<p class=\"wp-block-paragraph\">A date for oral arguments in <em>Rhoney v.
