Hagerty criticized Smith as a partisan actor whose actions damaged constitutional principles, notably highlighting his use of subpoenas to seize phone records of Congress members without proper disclosure or legal basis. The complaint asserts that Smith violated federal law and the Tennessee Bar\u2019s professional conduct rules by lacking candor, especially in how he handled subpoenas and non-disclosure orders that concealed the targeting of congressional officials. Hagerty also claims Smith\u2019s conduct infringed on legislative privileges protected by the First Amendment and should be investigated for potential disbarment. Bill Hagerty, R-Tenn., filed a bar complaint against former Special Counsel <a href=\"https:\/\/thefederalist.com\/tag\/jack-smith\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jack Smith<\/a> on Wednesday for his \u201cserious misconduct\u201d in running the Biden-era <a href=\"https:\/\/thefederalist.com\/tag\/arctic-frost\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arctic Frost<\/a> lawfare against Donald Trump and other Republicans. <\/p>\n<p class=\"wp-block-paragraph\">Jack Smith is \u201ca blatantly partisan actor and his prosecutorial misconduct damaged our constitutional order. He should never be able to practice law again,\u201d Hagerty <a href=\"https:\/\/x.com\/SenatorHagerty\/status\/2105312989058310144?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in an X post announcing his filing. <\/p>\n<div id=\"fdrlst__b89e9-2258520054\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The complaint filed with the Tennessee Supreme Court\u2019s Board of Professional Responsibility takes aim at Smith\u2019s use of subpoenas to obtain the phone toll records of <a href=\"https:\/\/www.foxnews.com\/politics\/hagerty-presses-verizon-over-fbis-access-his-phone-records-during-jack-smith-probe\" target=\"_blank\" rel=\"noreferrer noopener\">Hagerty<\/a> and <a href=\"https:\/\/thefederalist.com\/2025\/12\/01\/new-docs-reveal-jack-smith-intentionally-violated-congressional-republicans-constitutional-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">other<\/a> Republican members of Congress. Not only did Smith and his team seek and obtain non-disclosure orders to prevent the phone companies from notifying the GOP officials that their records were being subpoenaed, but they also <a href=\"https:\/\/www.nytimes.com\/2026\/07\/16\/us\/politics\/judge-unseals-jack-smith-subpoena-filings.html\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> did not disclose to the court approving the NDOs that the subpoenas targeted members of Congress. <\/p>\n<p class=\"wp-block-paragraph\">Hagerty alleged that Smith\u2019s \u201clack of candor was a violation of federal law, and an invasion of the very constitutional privileges that ensure a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >fully free legislative process<\/a>.\u201d He more specifically contended that a senator\u2019s \u201ccommunications with other members of Congress \u2018and staff about legislation, votes, committee assignments, and caucus affairs\u2019 are \u2018squarely \u201clegislative acts\u201d\u2018\u201d that the First Amendment\u2019s speech or debate clause \u201cabsolutely protects from compelled disclosure.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Nowhere in D.C. District Chief Judge <a href=\"https:\/\/thefederalist.com\/tag\/james-boasberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">James Boasberg<\/a>\u2018s non-disclosure order was there \u201cmention [of] the Speech or Debate Clause \u2026 or that the records sought pertained to members of Congress,\u201d Hagerty wrote. \u201cHow could that be, given the body of case law substantiating an argument that these very records were subject to legislative privilege? Because Smith\u2019s motion omitted the facts and law that would lead the judge to realize what he was ruling on.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe defects in Smith\u2019s motion are only heightened by the fact that the order was apparently <em>also<\/em> written by Smith, and rubber-stamped by the judge,\u201d he added. <\/p>\n<p class=\"wp-block-paragraph\">The Tennessee senator went on to claim that Smith\u2019s \u201cunethical\u201d antics violated the Tennessee Bar\u2019s Rule of Professional Conduct. For this \u201clack of candor,\u201d Hagerty said, the former special counsel must be investigated and potentially disbarred.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe [Tennessee Supreme Court\u2019s] Board of [Professional Responsibility] should investigate and pursue the most serious remedy possible \u2014 disbarment \u2014 in light of the gravity of Smith\u2019s intentional conduct; the effect of totally depriving members of Congress of legal recourse and appeal; the broader harm to our constitutional order; including the chilling effect of legislative communications; and his lack of remorse,\u201d the complaint reads. <\/p>\n<p class=\"wp-block-paragraph\">The complaint was filed a day after Smith testified before the Senate Judiciary Committee, during which he defended his lawfare against Trump and other Republicans. The more notable bombshell to come out of the hearing came when Chairman Chuck Grassley, R-Iowa, revealed that Smith and his team <a href=\"https:\/\/thefederalist.com\/2026\/09\/29\/breaking-jack-smith-spied-on-and-targeted-the-federalist-during-bidens-anti-trump-witch-hunt\/\" target=\"_blank\" rel=\"noreferrer noopener\">acquired<\/a> the communications of more than <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utm_sourcerssutm_mediumrssutm_campaignblackburn-takes-jack-smiths-unlawful-phone-record-seizure-to-court\/\" title=\"Blackburn Sues ...
