Pro-life states like Louisiana, Arkansas, and alabama are demanding the Supreme Court to uphold their laws and prevent out-of-state states, such as California, Massachusetts, and New York, from enacting &#8220;shield laws&#8221; that protect and facilitate illegal prescriptions and distribution of abortion drugs across state lines. The pro-life states argue that these shield laws undermine federal authority and the Supreme Court\u2019s decision in Dobbs v. Jackson, which returned abortion laws to individual states&#8217; authority. they contend that mail-order abortion pills are widely accessible, sometimes easily ordered by anyone, and may cause severe health issues, with some recipients ending up in emergency rooms. The lawsuit accuses out-of-state entities of deliberately violating laws and misleading consumers about the safety and legality of the pills, contributing to thousands of abortions each month in pro-life states. The legal action aims to preserve state laws and sovereignty, highlighting tensions between differing state policies on abortion.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>There are <a href=\"https:\/\/thefederalist.com\/2026\/05\/15\/women-babies-at-risk-after-scotus-authorizes-mail-order-abortion-for-now\/\" target=\"_blank\" rel=\"noreferrer noopener\">many facets<\/a> to the mail-order abortion fight, but the next battle comes in the form of a filing from the attorneys general of three pro-life states who are asking the Supreme Court to restore the constitutional equality disrupted by at least three blue states\u2019 \u201cshield laws.\u201d <\/p>\n<p>Democrat states\u00a0California, Massachusetts, and New York have all enacted abortion-for-all policies designed to prevent punishment for doctors who illegally prescribe abortion drugs to people in pro-life states where they are banned.<\/p>\n<p>In their <a href=\"https:\/\/d31hzlhk6di2h5.cloudfront.net\/20260930\/c7\/c4\/d2\/ce\/1d0e158709ba1419115d735a\/_as_filed__Louisiana_v._New_York_-_Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">motion filed on Sept. 30<\/a>, Republican Attorney General Liz Murrill of Louisiana, Tim Griffin of Arkansas, and Steve Marshall of Alabama warned that these shield laws \u201chave nothing to do with ensuring the availability of abortion within the borders of New York, Massachusetts, and California \u2014 they exist only to perpetuate abortions outside of those borders.\u201d<\/p>\n<p>The U.S. Food and Drug Administration claims its hands are tied until it <a href=\"https:\/\/thefederalist.com\/2026\/05\/13\/as-makary-steps-down-pro-lifers-await-movement-from-trump-fda-on-abortion-drugs\/\" target=\"_blank\" rel=\"noreferrer noopener\">concludes its mifepristone review<\/a>, even though no <a href=\"https:\/\/www.fda.gov\/media\/128651\/download\" target=\"_blank\" rel=\"noreferrer noopener\">review is required<\/a> for the regulatory agency to reinstate some of the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >common-sense abortion pill safeguards<\/a>, including an in-person doctor visit, that were stripped at President Joe Biden\u2019s behest. <a href=\"https:\/\/lailluminator.com\/2025\/07\/31\/liz-murrill-republican-ags-ask-congress-to-counter-abortion-pill-shield-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">Congress also previously failed to act to curb mail-order mifepristone,<\/a> even after Murrill and several other attorneys general asked legislators to address shield laws.  As a result, the GOP legal officers want the high bench to examine their case in light of the \u201cfull faith and credit and the equal-sovereignty doctrine.\u201d <\/p>\n<p>Murrill, who is leading a separate <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/woman-coerced-into-abortion-asks-fda-to-stop-shielding-abusers-and-their-drug-dealers\/\" target=\"_blank\" rel=\"noreferrer noopener\">federal lawsuit<\/a> again the FDA over its mail-order mifepristone scheme, <a href=\"https:\/\/thefederalist.com\/2026\/02\/24\/despite-promise-to-be-pro-life-ally-trump-admin-wont-regulate-abortion-drug-endangering-women\/\" target=\"_blank\" rel=\"noreferrer noopener\">told The Federalist in February<\/a> that shield laws and the governors using them to block extraditions \u201care essentially facilitating criminal conduct in our state and they are nullifying our laws in our state simply because they disagree with our policy.\u201d <\/p>\n<p><a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/ny-gov-hochul-rejects-louisiana-extradition-doctor-abortion-pill-case-rcna192156\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> and <a href=\"https:\/\/www.theguardian.com\/world\/2026\/jan\/15\/abortion-pill-california-doctor-louisiana\" target=\"_blank\" rel=\"noreferrer noopener\">California<\/a> specifically have <a href=\"https:\/\/www.governor.ny.gov\/news\/video-audio-photos-rush-transcript-governor-hochul-makes-reproductive-freedom-announcement\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a> Louisiana\u2019s efforts to extradite and hold out-of-state doctors accountable for illegally prescribing mifepristone to residents of the Pelican State. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Louisiana plans to sue me because I won\u2019t extradite a doctor for providing an abortion.<a href=\"https:\/\/x.com\/AGLizMurrill?ref_src=twsrc%5Etfw\">@AGLizMurrill<\/a>: Go fuck yourself. California will never help you criminalize healthcare. <a href=\"https:\/\/t.co\/1CPMAWwCNU\">pic.twitter.com\/1CPMAWwCNU<\/a><\/p>\n<p>\u2014 Gavin Newsom (@GavinNewsom) <a href=\"https:\/\/x.com\/GavinNewsom\/status\/2019587611921379772?ref_src=twsrc%5Etfw\">February 6, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Louisiana, Alabama, and Arkansas are asking the Supreme Court to let them impose their abortion bans on New York and punish our doctors for providing legal health care.<\/p>\n<p>I&#8217;ll fight with everything in my power to defend our shield law and protect every provider and patient.<\/p>\n<\/div>\n<p>\u2014 NY AG James (@NewYorkStateAG) <a href=\"https:\/\/x.com\/NewYorkStateAG\/status\/2105354931427590196?ref_src=twsrc%5Etfw\">September 30, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>\u201cIt is also a real attack on the entire constitutional structure that presumes that states are going to give full faith and credit to other states\u2019 laws,\u201d she warned. <\/p>\n<p>The SCOTUS motion similarly argues that California, New York, and Massachusetts have \u201cundermined\u201d the high bench\u2019s <em>Dobbs v. Jackson<\/em> decision and \u201cclaimed the right to make abortion policy \u2014 their abortion policy \u2014 for the entire Nation by overriding democratically enacted laws in pro-life states like Louisiana, Arkansas, and Alabama.\u201d<\/p>\n<p>\u201cThis lawsuit also seeks to restore the promise of Dobbs \u2014 and to vindicate this Court\u2019s authority to say what the law is. Dobbs is no more than a parchment promise if shield-law states can defy this Court by unilaterally decreeing that abortions must flourish in pro-life states,\u201d the motion argues.<\/p>\n<p>These states aren\u2019t acting alone. <a href=\"https:\/\/d31hzlhk6di2h5.cloudfront.net\/20260930\/0e\/5e\/75\/88\/531c13711f4dfe3f88e2f2ae\/_file-stamped__Louisiana_v._Nouhavandi_-_Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">A separate lawsuit<\/a> filed in the Western District of Louisiana by the Alabama, Arkansas, and Louisiana attorneys general on the same day names 30 individuals and organizations who, through \u201ca sweeping, coordinated scheme,\u201d illegally prescribe and mail abortion drugs to pro-life states where they are banned. <\/p>\n<p>\u201cThis is not accidental or incidental: They acknowledge that their conduct is illegal \u2014 <br \/>some even do business only in states where their conduct is illegal, and others send 95% of their monthly shipments to such states,\u201d the complaint states.<\/p>\n<p>With<a href=\"https:\/\/thefederalist.com\/2025\/05\/05\/it-took-me-only-30-seconds-to-order-deadly-abortion-pills-in-a-state-where-theyre-illegal\/\" target=\"_blank\" rel=\"noreferrer noopener\"> just a few clicks<\/a>, anyone, including men, children, <a href=\"https:\/\/thefederalist.com\/2026\/09\/23\/the-only-thing-an-abortion-obsessed-culture-guarantees-is-abuse-and-suffering\/\" target=\"_blank\" rel=\"noreferrer noopener\">abusers, and traffickers<\/a>, can order dangerous abortion pills to their doorstep \u2014 sometimes for free. According to Murrill, all three attorneys general offices were able to obtain abortion pills through various mail-order mifepristone websites. The <a href=\"https:\/\/lailluminator.com\/2026\/09\/30\/ag-liz-murrill-sues-states-with-shield-laws-protecting-abortion-pill-providers\/\" target=\"_blank\" rel=\"noreferrer noopener\">bottle<\/a> Murrill\u2019s office possessed \u201cdid not include any information about the prescriber or information about the risks of the medication.\u201d<\/p>\n<p>According to the filing, the entities selling mifepristone \u201cmislead consumers\u201d by advertising it as <a href=\"https:\/\/thefederalist.com\/2025\/05\/28\/study-abortion-lobby-medias-claims-that-mifepristone-is-safer-than-tylenol-are-hogwash\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201csafer than Tylenol\u201d<\/a> even though some reports suggest the prolific abortion pills have an <a href=\"https:\/\/thefederalist.com\/2025\/05\/06\/exclusive-see-the-airtight-methodology-showing-11-of-pill-abortions-cause-maternal-injury\/\" target=\"_blank\" rel=\"noreferrer noopener\">11 percent serious adverse event rate<\/a>.<\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2026\/06\/15\/louisiana-man-faces-felonies-for-poisoning-teen-daughter-1-pound-grandbaby-with-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">[RELATED: Louisiana Man Faces Felonies For Poisoning Teen Daughter, 1 Pound Grandbaby With Abortion Pills]<\/a><\/p>\n<p>The result of this \u201cdirect and intended \u2026 nationwide scheme,\u201d the complaint notes, are thousands of abortions across all three states each month \u2014 approximately 1,000 in Louisiana, 300 in Arkansas, and 700 in Alabama. The filing also emphasizes that in some cases, these mail-order abortion drugs \u201csend women to emergency rooms with severe bleeding and excruciating pain\u201d that mifepristone traffickers <a href=\"https:\/\/thefederalist.com\/2025\/05\/30\/study-83-percent-of-er-visits-due-to-drug-induced-abortions-miscoded-as-miscarriages\/\" target=\"_blank\" rel=\"noreferrer noopener\">encourage deceiving<\/a> medical staff into believing is a miscarriage.<\/p>\n<p>The doctors and abortion drug dealers the complaint claims are knowingly yet illegally participating in the violation of pro-life states\u2019 laws don\u2019t simply have the protection of Democrat states.
