Key findings include that 65% of likely voters believe the apportionment base should exclude non-citizens, with important majorities of Republicans, Democrats, and independents favoring this approach. Additionally, 75% support including a citizenship question on the census to facilitate excluding non-citizens from calculations.<\/p>\n<p>These findings align with proposals from the Commerce Department to revise census policies, such as excluding non-citizens from population counts used for apportionment and potentially adding a question about legal status, efforts spearheaded by the Trump administration but hindered by legal challenges and court rulings. Past attempts to reinstate a citizenship question and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-throws-out-challenge-to-president-trumps-bid-to-exclude-illegal-aliens-from-being-counted-in-determining-congressional-seats\/\" title=\"SCOTUS Throws Out Challenge to ...s Bid to ... ... from Being Counted in Determining Congressional Seats\">exclude illegal aliens<\/a> faced legal and procedural obstacles, though public opinion appears favorable toward these measures.<\/p>\n<p>The survey also highlights a lack of confidence (52%) in the accuracy of the upcoming 2030 census, with over 64% wishing for a count based solely on the actual population, opposing methods like differential privacy that introduce artificial data to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >protect confidentiality-methods critics claim undermine accurate enumeration<\/a>. the data underscores Americans\u2019 desire for a census process that accurately reflects the true U.S. citizen population, aligning with election integrity and constitutional principles.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Americans overwhelmingly believe congressional seats should be distributed solely based on the number of U.S. citizens in each state. They also think there should be a citizenship question on the census.<\/p>\n<p>Those are two of the key findings in a new survey, obtained exclusively by The Federalist, indicating significant public support for policies \u2014 long opposed by the left \u2014 that the Trump administration is <a href=\"https:\/\/thefederalist.com\/2026\/09\/17\/why-trumps-plan-to-stop-noncitizens-from-rigging-the-census-might-work-this-time\/\" target=\"_blank\" rel=\"noreferrer noopener\">pursuing<\/a> pertaining to the crucial decennial count.<\/p>\n<p>The survey, conducted by McLaughlin &#038; Associates on Sept. 23, shows that of 1,000 likely voters, nearly two-thirds, 65 percent, believe the congressional apportionment base should be comprised solely of U.S. citizens.<\/p>\n<p>Strikingly, not only four in five self-identified Republicans, but also 54 percent of Democrats and nearly 60 percent of independents polled also somewhat or strongly agree with a policy that would necessarily exclude illegal aliens and other noncitizens from the count.<\/p>\n<p>The poll also found that 75 percent of likely voters, including nearly two-thirds of Democrats, somewhat or strongly agree that census respondents should disclose whether they are U.S. citizens on the census form. Such a query could be used to facilitate efforts to exclude noncitizens from the apportionment base.<\/p>\n<h2>Current Policy Counts Non-Citizens<\/h2>\n<p>These findings come days after the Commerce Department, under which the Census Bureau sits, proposed a <a href=\"https:\/\/www.federalregister.gov\/d\/2026-18481\/page-57525\" target=\"_blank\" rel=\"noreferrer noopener\">rule<\/a> to exclude all but U.S. citizens and green card holders from the population numbers used to distribute congressional seats. That rule would modify the Census Bureau\u2019s \u201cresidence criteria,\u201d under which past administrations had distorted the apportionment base by counting \u201cresidents\u201d of each state irrespective of their immigration status \u2014 thereby including millions of illegal aliens. This has led to the disproportionate allocation of representatives and electoral college votes to states with large non-citizen populations, rewarded sanctuary jurisdictions with undue power, diluted the voting power of Americans, and entrenched foreign influence in our political system.<\/p>\n<p>The proposed rule also indicates that the bureau may add a question to the census to ascertain the \u201clegal status\u201d of respondents to implement the contemplated apportionment policy.<\/p>\n<p>As chronicled in reporting on President Trump\u2019s long-running battle over the census at <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2025\/06\/26\/who_counts_trump_poised_to_try_to_remove_noncitizens_from_census_1118884.html\" target=\"_blank\" rel=\"noreferrer noopener\">RealClearInvestigations<\/a>, the first Trump administration sought but failed to execute both policies. That administration attempted by executive action, rather than regulation, to exclude illegal aliens from the apportionment base. The effort ran up against left-wing lawfare efforts and delays associated with the coronavirus pandemic. Ultimately, the president was unable to implement the policy before the clock ran out on his term.<\/p>\n<p>The first Trump administration also sought to reinstate a census citizenship question \u2014 one that had been included frequently prior to 1960 and that the Census Bureau maintains on its \u201c<a href=\"https:\/\/www.census.gov\/acs\/www\/about\/why-we-ask-each-question\/citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">long-form<\/a>\u201d survey. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utm_sourcerssutm_mediumrssutm_campaignwhy-trumps-plan-to-stop-noncitizens-from-rigging-the-census-might-work-this-time\/\" title=\"Trump&#039;s Plan To Stop Noncitizens From Rigging The ... Might Work This Time\">left-wing lawfare apparatus challenged<\/a> that policy up to the Supreme Court. And in an <a href=\"https:\/\/thefederalist.com\/2019\/07\/15\/john-roberts-citizenship-decision-legally-politically-corrupt\/\" target=\"_blank\" rel=\"noreferrer noopener\">dubious June 2019 decision<\/a>, Chief Justice John Roberts, writing for a splintered majority, ruled that while reinstating a citizenship question was constitutional, the process the Trump administration used to do so was legally deficient, invalidating the effort.<\/p>\n<p>While unclear how the second Trump administration\u2019s renewed efforts will fare in the court of law, the polling provides evidence of bipartisan popularity for the initiatives in the court of public opinion.<\/p>\n<p>FAIR Election Fund, a 501(c)(3) led by conservative election lawyer Cleta Mitchell, commissioned the poll. Established in 2023, her organization\u2019s mission is to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-is-not-going-to-be-bullied-after-sending-billions-to-foreign-countries-mcconnell-digs-in-against-giving-americans-2000-video\/\" title=\"\u2018Senate is Not Going to be Bullied\u2019 \u2013 After Sending Billions to Foreign Countries, McConnell Digs in Against Giving ... ,000 (VIDEO)\">support election integrity<\/a>, including that only Americans \u201care engaged in registration, voting, and representation in our body politic,\u201d Mitchell said.<\/p>\n<p>\u201cFAIR commissioned this poll for the purpose of ascertaining where the American people stand on these important principles,\u201d Mitchell said in a written statement, \u201cand, not surprisingly, the vast majority of Americans agree with those of us in the election integrity movement.\u201d<\/p>\n<h2>Confidence in Census<\/h2>\n<p>The survey asked other questions relevant to Trump administration efforts to correct problematic aspects of prior decennial counts. One query concerned whether respondents would be confident in the accuracy of the 2030 census, given the fact that the 2020 census used \u201calgorithms and projections\u201d to complete the population count instead of an \u201cactual headcount\u201d and that the Census Bureau admitted to making errors leading to a misallocation of House seats. A majority, 52 percent of respondents, indicated they were \u201cNot Confident\u201d the 2030 count would be accurate. Sixty-four percent said they would have more confidence in the count if it the bureau were \u201crequired to simply count the actual U.S. population\u201d this time around.<\/p>\n<p>This question alluded in part to the practice of \u201cdifferential privacy,\u201d a <a href=\"https:\/\/www.census.gov\/content\/dam\/Census\/library\/factsheets\/2023\/dec\/differential-privacy.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">process<\/a> used in the 2020 census whereby the bureau introduced \u201cstatistical noise to protect confidentiality.\u201d Trey Mayfield, counsel to the director of the Census Bureau at the end of the first Trump administration, <a href=\"https:\/\/www.congress.gov\/event\/119th-congress\/house-event\/118665\/text\" target=\"_blank\" rel=\"noreferrer noopener\">testified<\/a> before a House Judiciary Committee panel last year that under the practice, the bureau \u201cadds fake people where they do not live and subtracts real people from where they do live. Thus, all the reported enumeration census data from 2020 below the state level is false.\u201d He and other authorities argue that the method is both unconstitutional, violating Congress\u2019 duty to conduct an \u201cactual enumeration,\u201d and illegal.<\/p>\n<p>Earlier this summer, the Commerce Department issued an <a href=\"https:\/\/www.commerce.gov\/opog\/disclosure-avoidance-statistical-products\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a> apparently meant to quell some of these concerns, declaring \u201cnoise infusion \u2026 inconsistent with the Department\u2019s policies\u201d and directing that it \u201cshall not be used for any statistical product.\u201d But the Center for Renewing America, a key critic of the practice, released a <a href=\"https:\/\/americarenewing.com\/issues\/primer-an-actual-enumeration-means-actual\/\" target=\"_blank\" rel=\"noreferrer noopener\">primer<\/a> indicating that the reform still \u201cleaves the underlying architectural problem unaddressed.\u201d<\/p>\n<p>\u201cWe want\u2026the Census Bureau to do what the Constitution requires: conduct an enumeration, an actual count, of the U.S. population,\u201d Mitchell said.<\/p>\n<p>\u201c[T]his data reflects that this is what the American people expect the Census Bureau to do,\u201d she added.<\/p>\n<hr>\n<p>      Ben Weingarten is editor at large for RealClearInvestigations.
