Boulder, which involves Boulder, Colorado&#8217;s legal action against oil companies Suncor Energy and Exxon Mobil. Boulder claims these companies&#8217; activities contribute to climate change and harm residents,and seeks monetary damages. The case raises critical questions about whether <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-pennsylvania-state-sen-doug-mastriano-wanted-government-to-publicly-report-identities-of-everyone-who-got-coronavirus\/\" title=\"Report: Pennsylvania ... Legal analysts see this case as more than just climate litigation-it&#8217;s viewed by some as an attempt by Democrats and their allies to leverage the courts to achieve broad policy goals, potentially reshaping the U.S. economy and enabling localities to pursue similar lawsuits across various issues. <\/p>\n<p>Concerns are also raised about the potential expansion of &#8220;lawfare,&#8221; with critics warning that allowing such claims could enable leftist groups to target industries and social issues through local courts, bypassing legislative processes. Justice Samuel Alito has recused himself from the case amid pressure campaigns, though legal observers believe the recusal is unlikely to influence the outcome significantly. Other justices, including Justice Kagan, face similar calls for recusal. a ruling favoring Suncor and Exxon could weaken Democrats&#8217; legal strategies and prevent courts from using environmental litigation to drive policy changes. the supreme Court is scheduled to hear oral arguments on Monday at 10 a.m. ET.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Supreme Court will kick off its 2026 term next week with what will be one of its biggest cases of the year. And according to several legal specialists, there\u2019s much more to the dispute than meets the eye. <\/p>\n<p>The case in question is <em><a href=\"https:\/\/thefederalist.com\/tag\/suncor-energy-inc-v-county-commissioners-of-boulder-county\/\" target=\"_blank\" rel=\"noreferrer noopener\">Suncor v. Boulder<\/a><\/em>, which deals with the <a href=\"https:\/\/thefederalist.com\/2026\/02\/23\/scotus-takes-up-oil-companies-challenge-to-colorado-citys-climate-lawfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawfare<\/a> that Boulder, Colorado, launched against Suncor Energy companies and the Exxon Mobil Corporation. The city is seeking monetary damages based on claims that the oil giants\u2019 activities are contributing to \u201cclimate change\u201d and that such activities are harming Boulder residents.<\/p>\n<p>Before SCOTUS is the question of whether federal law prevents state-law claims \u201cseeking relief for injuries allegedly caused by the effects of interstate and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-takes-up-oil-companies-challenge-to-colorado-citys-climate-lawfare\/\" title=\"SCOTUS Takes Up Challenge To Colorado City&#039;s Climate ...\">international greenhouse-gas emissions<\/a> on the global climate.\u201d The justices will also consider whether they have jurisdiction to hear the case. <\/p>\n<p>During a Tuesday virtual press conference, Alliance for Consumers Executive Director O.H. Skinner said that Democrats and their allies are attempting to make the suit out to be nothing more than a \u201cbasic tort case\u201d that is \u201ctrying to hold people accountable for their actions.\u201d In reality, however, he noted that the lawsuit is effectively \u201ca Swiss Army knife for them to accomplish social change through a court system.\u201d<\/p>\n<p>\u201cIt\u2019s actually bigger than \u2018climate change,\u2019\u201d Skinner said. \u201cIt\u2019s about [Democrats\u2019] overall ability to weaponize courts to accomplish policy goals that are sweeping and that are multibillion-dollar in scale, and they could end up with an order that basically rewrites the American economy [if they prevail].\u201d<\/p>\n<p>Should the Supreme Court endorse Boulder\u2019s position that states and localities can pursue these types of state-based claims against Suncor and Exxon, the AFC executive director said, such a ruling would open up Pandora\u2019s box for leftists to advance similar lawfare against other industries they disfavor. He specifically noted that standard could apply \u201cacross all sorts of different social questions, all the way down to guns.\u201d<\/p>\n<p>\u201cIf this is allowed to proceed in the name of climate change, countless other things that are ills that the left has identified will become solvable via a local lawsuit by a crazy college town in a blue state, and all of a sudden, that will become the ticket to ride for the left in terms of fixing the ills that they see in the world,\u201d Skinner said. \u201cIt\u2019s not a fight about climate science. \u2026 It\u2019s a fight about whether we\u2019re going to allow this maneuver to be what reshapes American society, and that\u2019s why I think everybody should care, irrespective of their views on climate change or their views on how to fix this problem or that problem.\u201d<\/p>\n<p>Also in attendance at Tuesday\u2019s presser was former Alaska Acting Attorney General Stephen Cox.<\/p>\n<p>Cox detailed how Democrats and their allies have taken up state litigation against fossil fuel companies (like in the <em>Suncor<\/em> case) as a means of sidestepping the legislative process by advancing their agenda through the courts instead of at the ballot box. He further surmised that, should Boulder prevail, it would effectively allow states and localities to dictate the energy policy of other states and localities. <\/p>\n<p>\u201cI see this as federalism turning over on its head because \u2026 when it\u2019s the feds overreaching with the [the states] \u2026 we can work with our constituents, and elections have consequences, and we see the accountability play out, and that\u2019s how you deal with that,\u201d Cox said. \u201cBut with the [state] courts, [it\u2019s different]. If you\u2019re in Alaska \u2026 we take a snapshot in the spring and the fall in Alaska of the price of oil to set our state budget because of the amount of royalties and taxes that we receive based on it. We are an oil state. We depend on oil. But if we\u2019ve got \u2026 national energy policy being set in state courts outside of our state, where\u2019s the democratic accountability in that?\u201d<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/09\/01\/the-federalists-guide-to-the-2026-supreme-court-term\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Federalist\u2019s Guide To The 2026 Supreme Court Term<\/a>]<\/strong><\/p>\n<p>One factor looming over next week\u2019s oral arguments is the <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/425819\/20260928133032324_Letter%20to%20Counsel%20in%20No.%2025-170.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">late-breaking announcement<\/a> that Justice Samuel Alito has recused himself from the case. The move came months after leftist groups waged a pressure campaign against the Bush appointee to withdraw from <em>Suncor<\/em> due to his financial stakes in the fossil fuel sector. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2026\/08\/13\/propaganda-medias-latest-hit-job-against-justice-alito-is-a-total-joke\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, however, Alito does not hold any interests in the companies participating in <em>Suncor<\/em>. <\/p>\n<p>While noting that it\u2019s never \u201cgood\u201d or \u201ceasy\u201d for the Supreme Court to hear cases without \u201ctheir full complement,\u201d Skinner said that \u201cit is not something\u201d that he thinks \u201cwill be dispositive of the case, and it\u2019s not something that [he] think[s] is noteworthy, other than that [Alito] made that decision based on his own considerations.\u201d He also expressed confidence that there are at least five justices \u201cwho do not think that courts can do cross-border stuff like this,\u201d even with Alito\u2019s recusal.<\/p>\n<p>Alito is hardly the only justice to face calls to refrain from participating in <em>Suncor<\/em>.<\/p>\n<p>Conservative organizations have also <a href=\"https:\/\/www.foxnews.com\/politics\/conservative-groups-say-justice-kagan-cannot-be-impartial-upcoming-supreme-court-climate-litigation\" target=\"_blank\" rel=\"noreferrer noopener\">pressured<\/a> Justice Elena Kagan to recuse herself from the case due to a foreword she authored for a contested manual used to advise federal judges. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2026\/08\/10\/national-academy-of-sciences-pulls-biased-climate-guide-used-to-advise-judges\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the manual produced by the Federal Judicial Center and National Academies of Sciences contained a now-retracted \u201cclimate science\u201d guide littered with references to left-wing climate activists. Kagan told Congress in July that while she had \u201cbecome aware\u201d of the scandal over the manual, she \u201chadn\u2019t read\u201d the contested chapter prior to authoring the foreword and \u201cstill\u201d had not read it at that time.<\/p>\n<p>In terms of the case\u2019s outcome, Skinner predicted that a favorable ruling for Suncor and Exxon would likely \u201ckick the legs out\u201d from underneath Democrats\u2019 \u201cpublic nuisance\u201d lawfare strategy. While these left-wing actors will undoubtedly \u201ccome up with \u2018climate homicide\u2019 or some other workaround effort,\u201d he said, \u201ceach of those efforts is more tenuous than this one.\u201d<\/p>\n<p>A favorable ruling from the justices \u201cwould \u2026 conclusively end this type of attack by the left and state courts to reshape our energy industry and our nation,\u201d he added.<\/p>\n<p>The Supreme Court will hold oral arguments in <em>Suncor v.
