The decision allowed the Trump management to continue its efforts to deport illegal aliens to countries other than their home country,despite ongoing legal challenges. The case involved a dispute over whether a district judge had the authority to halt such deportations, with the Supreme Court ultimately holding that the government\u2019s appeal was valid and that the lower court&#8217;s order should be blocked.<\/p>\n<p>This marks the third time the administration sought Supreme Court relief regarding this issue. Initially, the court stayed a preliminary injunction issued by Judge Murphy, who attempted to block the deportations. Murphy then issued a final ruling supporting the blockade, which the Supreme Court has now overturned. Justice Elena Kagan dissented, expressing skepticism about the lower court&#8217;s authority to defy the Supreme Court\u2019s rulings.<\/p>\n<p>The case will return to the lower courts, and the Supreme Court plans to hear arguments on the merits in December 2026. The order specifies that briefs are to address jurisdictional questions and the legality of the government\u2019s guidance on these deportations. The vote was 6-3, with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson in dissent.<\/p>\n<p class=\"wp-block-paragraph\">In its <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/092926zr2_1a7d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unsigned order<\/a>, the high court granted the Trump administration\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/09\/25\/doj-asks-scotus-to-stop-judicial-sabotage-of-deportations-again\/\" target=\"_blank\" rel=\"noreferrer noopener\">request<\/a> to pause a ruling issued by Massachusetts-based District Judge Brian Murphy. The Biden appointee\u2019s directive sought to block the government\u2019s deportation of illegal aliens to third countries \u2013countries not of their national origin.<\/p>\n<div id=\"fdrlst__b89e9-2341371196\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The ruling is the third instance in which the administration asked the Supreme Court for relief in the case. The first occurred last year, when the high court <a href=\"https:\/\/thefederalist.com\/2025\/06\/24\/scotus-agrees-trump-admin-can-carry-out-third-country-deportations\/\" target=\"_blank\" rel=\"noreferrer noopener\">stayed<\/a> (6-3) Murphy\u2019s preliminary injunction blocking third-country deportations.<\/p>\n<p class=\"wp-block-paragraph\">Murphy would go on to issue an order to the administration hours later, <a href=\"https:\/\/thefederalist.com\/2025\/06\/24\/rogue-federal-judge-openly-defies-supreme-court-ruling-on-deportation-of-violent-criminal-illegals\/\" target=\"_blank\" rel=\"noreferrer noopener\">claiming<\/a> that the Supreme Court\u2019s ruling did not affect his initial blockade on the policy. The government returned to the justices and asked them to clarify their order. This time, in a 7-2 decision, SCOTUS affirmed that its ruling did, in fact, cover Murphy\u2019s initial injunction.<\/p>\n<p class=\"wp-block-paragraph\">Murphy\u2019s refusal to follow the high court prompted stern criticism from Justice Elena Kagan. In a statement <a href=\"https:\/\/thefederalist.com\/2025\/07\/07\/if-justice-kagan-wants-respect-from-lower-courts-she-should-shut-down-their-judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">concurring<\/a> with the court\u2019s clarification, the Obama appointee noted that, although she disagreed with the majority\u2019s initial decision to block Murphy\u2019s injunction, she does \u201cnot see how a district court can compel compliance with an order that this Court has stayed.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Murphy ultimately issued a final judgment blocking the third-country deportations in February. While the 1st Circuit Court of Appeals <a href=\"https:\/\/thefederalist.com\/2026\/03\/12\/1st-circuit-halts-rogue-judges-bid-to-stop-trumps-third-country-deportations\/\" target=\"_blank\" rel=\"noreferrer noopener\">initially sided<\/a> with the administration in pausing that order, it later <a href=\"https:\/\/www.scotusblog.com\/2026\/09\/trump-administration-again-urges-justices-to-allow-deportations-to-third-party-countries\/?utm_source=Iterable&#038;utm_medium=email&#038;utm_campaign=campaign_20047903\" target=\"_blank\" rel=\"noreferrer noopener\">permitted<\/a> the Biden appointee\u2019s ruling to go into effect earlier this month.<\/p>\n<p class=\"wp-block-paragraph\">In addition to staying Murphy\u2019s ruling, the Supreme Court also agreed to take up and hear arguments in the case for its upcoming 2026 term. <\/p>\n<p class=\"wp-block-paragraph\">According to Tuesday\u2019s order, the government and challengers are instructed to file briefs addressing whether Murphy has jurisdiction over the latter\u2019s claims; whether Murphy \u201chad authority to enter classwide declaratory relief and [Administrative Procedures Act] vacatur\u201d under federal law; whether the administration\u2019s \u201cGuidance on third-country removals<br \/>is unlawful\u201d under various provisions of federal law and the due process clause; and \u201cother questions that the Government determines are appropriate for the proper disposition of the case.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court\u2019s pause on Murphy\u2019s injunction will terminate after it issues its ruling on the case\u2019s merits.
