Eric Schmitt, a Missouri Republican, has introduced a bill to protect parents from <a href=\"https:\/\/gvwire.com\/2025\/09\/13\/california-mother-says-daughter-killed-herself-after-being-transitioned-by-school\/\" target=\"_blank\" rel=\"noreferrer noopener\">state-sponsored kidnapping<\/a> by social workers when the parents refuse to agree to a child\u2019s identification as transgender. The Yaeli Martinez Child Protection Act of 2026 is named after a 19-year-old California woman who committed suicide after being socially transitioned by her public school as a minor and <a href=\"https:\/\/gvwire.com\/2025\/09\/13\/california-mother-says-daughter-killed-herself-after-being-transitioned-by-school\/\" target=\"_blank\" rel=\"noreferrer noopener\">taken from her family home<\/a> by child protection caseworkers.<\/p>\n<p class=\"wp-block-paragraph\">\u201cRaising a child according to his or her sex is not abuse,\u201d the bill declares. \u201cRemoval from fit parents is contrary to the best interests of children, creates trauma for the child, damages familial bonds, and exposes the child to well-documented risks in state custody. Children have suffered great harm and even have died after being removed from loving families by the state for sex-rejecting interventions.\u201d<\/p>\n<div id=\"fdrlst__b89e9-913881827\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The bill would block federal funding administered under the Child Abuse Prevention and Treatment Act for states, tribes, and organizations that participate in the removal of children from the homes of parents who don\u2019t affirm the supposed transgender identity of children.<\/p>\n<p class=\"wp-block-paragraph\">The bill would add to federal law the declaration that a parent \u201chas the right to affirm a child\u2019s sex,\u201d including the refusal of \u201cthe provision, facilitation, funding, authorization, or permission of any sex-rejecting intervention for the child.\u201d It would also codify the right of parents to refuse \u201cthe use of pronouns or titles that do not correspond to the child\u2019s sex.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Finally, the bill would create a private right of action for parents to sue in federal court over the limitation of parental rights by any entity that attempts to socially \u201ctransition\u201d children or perform surgical or hormonal interventions without parental consent, including the use of \u201cpronouns or titles that do not correspond to the child\u2019s sex.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The parental rights organization Our Duty has <a href=\"https:\/\/x.com\/OurDutyUSA\/status\/2104170303836287451\" target=\"_blank\" rel=\"noreferrer noopener\">argued that<\/a> preventing the state removal from family homes of children who declare transgender identity is an urgent task: \u201cEnding the ideological weaponization of child protective services is one of our most important fights.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In a sign of how far we\u2019ve wandered from a normal understanding of the parent-child relationship, the bill explicitly declares the obvious: \u201cA parent, legal guardian, caregiver, foster parent, prospective foster parent, or prospective adoptive parent has a right to be free from discrimination or adverse State action for affirming or intending to affirm a child\u2019s sex.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In a statement provided by his office, Schmitt condemned \u201cradical gender ideology\u201d and the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >ongoing blue state attack<\/a> on family relationships. <\/p>\n<p class=\"wp-block-paragraph\">\u201cThis ideology is inflicting irreversible treatments and procedures on children, but parents in blue states who disagree are punished and even torn from their own kids they are trying to protect,\u201d he said. \u201cIt\u2019s disgusting these states want to use the welfare state to separate families and we must defend parents\u2019 right to choose what\u2019s best for their own children.\u201d<\/p>\n<p class=\"wp-block-paragraph\">A video from the Daily Signal discusses the deeply sad example of Yaeli Martinez and her encounter with \u201cchild protection\u201d caseworkers that destroyed her life:<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"aRy6BEOct1BqxZxmTrG0nr88IbpsChUM9HvKjds0VZtqD7yHnPMbGI5CXaAwjvSlhF9UDwkQ5RWk\"><\/p>\n<div class=\"ratio ratio-16x9\"><iframe loading=\"lazy\" title=\"The Transgender Movement Took Her Daughter\u2019s Life\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/M58PqUjezdM?feature=oembed&#038;enablejsapi=1\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<p><\/span> <\/div>\n<\/figure>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Chris Bray is a senior correspondent at The Federalist and a former infantry sergeant in the U.S. Army.
