He was later charged federally with assaulting, resisting, interfering with, or impeding a federal officer. according to an affidavit, Garces-Perez was identified by his Texas driver&#8217;s licence and initially complied with police commands but drove away after being ordered to exit his vehicle, striking an officer\u2019s torso mirror in the process. Body-camera footage captured the encounter,and Garces-Perez later claimed he thought he might be apprehended and sought permission to park his car for his wife&#8217;s pickup. His attorney disputes the circumstances, asserting Garces-Perez entered the U.S. legally in 2024 under a Biden-era program and had a valid work permit. The attorney also criticized the shooting, noting that Garces-Perez missed an immigration hearing due to a notice sent to an old address. Garces-Perez provided his Texas driver\u2019s license, which officers used to verify his identity, the affidavit says.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-1\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-1\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">The officers then ordered Garces-Perez to put his vehicle in park and get out. After receiving additional instructions in Spanish, Garces-Perez allegedly closed his window and drove away, according to the complaint.<\/p>\n<p class=\"wp-block-paragraph\">The affidavit said Garces-Perez\u2019s vehicle struck one of the ICE officers in the torso with the driver\u2019s-side mirror as he drove away. The complaint also says body-camera footage on one of the officers captured the initial encounter with Garces-Perez.<\/p>\n<p class=\"wp-block-paragraph\">The Department of Homeland Security special agent who wrote the affidavit detailed the interview with Garces-Perez as part of the investigation.
