However,the actual legal language reveals broader implications: it would establish reproductive freedom as a fundamental right,possibly undermine existing parental notice protections,and limit Virginia\u2019s capacity to enforce restrictions on late-term abortions,especially when physicians determine they are medically indicated.<\/p>\n<p>Critics highlight that the ballot language omits important details, such as the absence of explicit recognition of unborn life as a state interest and broad protections for abortion if deemed necessary for physical or mental health. They warn that the amendment\u2019s language could <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/il-bill-creates-prison-pipeline-for-homeschoolers-critics-say\/\" title=\"IL Bill Creates &#039;Prison Pipeline&#039; For Homeschoolers, Critics Say\">jeopardize parental rights<\/a>,as it does not specify that minors require parental involvement,threatening existing consent laws. The ambiguity around the phrase \u201cindirectly\u201d burdening reproductive rights could also pose challenges to religious liberty and free speech, potentially targeting faith-based organizations and pro-life advocates.<\/p>\n<p>supporters argue the amendment preserves the right to abortion and reproductive decision-making, but opponents contend it could significantly weaken Virginia\u2019s ability to restrict third-trimester abortions and address issues like coercion or abuse related to abortion. The proposed language effectively bars the state from prohibiting certain late-term procedures when doctors consider them medically necessary, making meaningful restrictions challenging.<\/p>\n<p>opponents urge voters to consider the broad and complex legal implications, emphasizing the potential erosion of parental rights, religious freedoms, and protections for unborn children. They advocate for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/shaun-mccutcheon-directtvs-attack-on-free-speech\/\" title=\"Shaun McCutcheon: DirectTV\u2019s Attack on ...\">informed decision-making<\/a> before the language becomes part of Virginia\u2019s Bill of Rights,emphasizing the importance of defending the right to life and ensuring protections against coercion and harm.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>This November, Virginia voters will decide whether to place a fundamental right to abortion into the Virginia Constitution.<\/p>\n<p>Proposed <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">Constitutional Amendment Question 1<\/a> is being presented to voters as protecting \u201creproductive freedom.\u201d But the actual amendment goes much further than the language on the ballot suggests. It would establish abortion as a fundamental right, make existing protections for parental notice vulnerable to constitutional challenge, and significantly limit Virginia\u2019s ability to protect unborn children, including during the third trimester.<\/p>\n<p>The American Center for Law and Justice has long fought to protect the sanctity of life. We believe every unborn child has value and is entitled to protection. That principle is consistent with the foundation of our nation itself. The <a href=\"https:\/\/www.archives.gov\/founding-docs\/declaration-transcript\" target=\"_blank\" rel=\"noreferrer noopener\">Declaration of Independence<\/a> recognizes that all people are endowed by their Creator with unalienable rights, beginning with life. Government does not create that right. Its responsibility is to protect it.<\/p>\n<p>If Virginia voters approve Question 1, it would move the commonwealth in the opposite direction.<\/p>\n<h2><strong>The Ballot Does Not Tell Virginians Everything They Are Voting On<\/strong><\/h2>\n<p>The ballot <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">question<\/a> asks Virginians whether the state constitution should be<\/p>\n<blockquote>\n<p>amended to (i) protect the freedom to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; (ii) protect doctors, nurses, and patients from being punished for these decisions; and (iii) allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient\u2019s health is at risk or the pregnancy cannot survive?<\/p>\n<\/blockquote>\n<p>However, that description leaves out important provisions contained in the actual amendment.<\/p>\n<p>The proposed constitutional text <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a> that \u201cevery individual has the fundamental right to reproductive freedom.\u201d It then <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">provides<\/a> that this right \u201cshall not be, directly or indirectly, denied, burdened, or infringed upon\u201d unless Virginia satisfies a demanding constitutional standard. The amendment also narrowly defines what qualifies as a compelling state interest.<\/p>\n<p>What is noticeably missing is that the protection of unborn human life is not identified as a compelling state interest.<\/p>\n<p>The <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">ballot<\/a> also tells Virginians that third-trimester restrictions could apply unless the patient\u2019s \u201chealth is at risk.\u201d The actual constitutional language specifically protects abortions that a physician determines are medically indicated to protect the woman\u2019s \u201c<a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">physical or mental health<\/a>\u201d \u2014 \u00a0an extremely broad standard.<\/p>\n<p>Voters are not being asked to approve the abbreviated description on the ballot. They are being asked to place the amendment language, which the voter may never actually read, into Virginia\u2019s Bill of Rights.<\/p>\n<h2><strong>Parents Should Be Alarmed<\/strong><\/h2>\n<p>The threat to parental rights is another major concern.<\/p>\n<p>Virginia law currently <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-left-unmasks-its-desire-to-destroy-families-and-the-nation-with-sexual-chaos\/\" title=\"The Left Unmasks Its Desire To Destroy Families \u2014 And The Nation \u2014 With Sexual Chaos\">requires parental consent<\/a> or judicial authorization before an abortion, generally, can be performed on an unemancipated minor, subject to specified exceptions.<\/p>\n<p>The <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment<\/a> contains no parental-rights protection. Instead, it states \u201cevery individual\u201d possesses the fundamental right to reproductive freedom, and not every \u201cadult.\u201d<\/p>\n<p>If Question 1 passes, Virginia\u2019s parental involvement requirements could immediately become vulnerable to a constitutional challenge. A minor seeking an abortion could argue that requiring parental consent, notification, or judicial authorization \u201cdirectly or indirectly\u201d burdens the fundamental right that Virginia voters placed in the constitution.<\/p>\n<p>The amendment\u2019s use of \u201cevery individual,\u201d rather than \u201cevery adult,\u201d is significant because the text does not expressly exclude minors. Whether that language ultimately invalidates Virginia\u2019s existing parental-involvement requirements would be a question for the courts \u2014 but the amendment would give abortion-rights litigants a powerful new constitutional argument.<\/p>\n<h2><strong>Could This Amendment Threaten Religious Liberty and Pro-Life Speech?<\/strong><\/h2>\n<p>There is another phrase in the amendment that Virginians should examine carefully.<\/p>\n<p>Question 1 <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a> the Commonwealth may not \u201cdirectly or indirectly\u201d deny, burden, or infringe the newly created fundamental right to reproductive freedom.<\/p>\n<p>What constitutes an \u201cindirect\u201d burden? The amendment does not define that term. That ambiguity could matter when abortion rights come into conflict with religious liberty and free speech.<\/p>\n<p>Could a government-funded Christian organization face consequences because it refuses to facilitate or refer for abortions? Could a licensed Christian counselor face regulatory action for counseling a woman against abortion? Could a pregnancy resource center be targeted because its mission is to encourage women to choose life?<\/p>\n<p>We do know this. Question 1 cannot override the First Amendment. And the Supreme Court has already protected pro-life speakers when government crossed that constitutional line \u2014 in cases such as <a href=\"https:\/\/www.oyez.org\/cases\/2017\/16-1140\" target=\"_blank\" rel=\"noreferrer noopener\"><em>National Institute of Family and Life Advocates v. Becerra<\/em><\/a>  and <a href=\"https:\/\/www.oyez.org\/cases\/2013\/12-1168\" target=\"_blank\" rel=\"noreferrer noopener\"><em>McCullen v. Coakley<\/em><\/a>. The proposed amendment doesn\u2019t take into count legal precedent.<\/p>\n<p>Virginia cannot create a constitutional right to abortion that overrides the federal constitutional rights of those who oppose abortion. Virginians deserve an answer to these questions before the language becomes part of their constitution<em>.<\/em><\/p>\n<h2><strong>Late-Term Abortion Could Become Virtually Beyond the Reach of Virginia Law<\/strong><\/h2>\n<p>The amendment\u2019s treatment of third-trimester abortion is a red flag, and its language would be permanently enshrined in the constitution.<\/p>\n<p>Supporters say that Question 1 technically allows third-trimester regulation. But that does not tell the whole story. The amendment immediately restricts that authority \u2014 and one could argue effectively eliminates it.<\/p>\n<p>Under the actual <a href=\"https:\/\/www.elections.virginia.gov\/election-law\/proposed-constitutional-amendment-question-1\/?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noreferrer noopener\">text<\/a>, Virginia could not prohibit a third-trimester abortion when a physician determines, in their professional judgment, that the abortion is medically indicated to protect the pregnant woman\u2019s life, physical health, or mental health. Virginia also could not prohibit the abortion when the physician determines that the unborn child is not viable. The Virginia legislature could not simply change these standards through ordinary legislation.<\/p>\n<p>The result would be that meaningful prohibitions on a significant category of third-trimester abortions could be placed effectively beyond the commonwealth\u2019s reach. Even a third-trimester law enacted by the people\u2019s elected representatives would remain constitutionally subject to the physician-determined physical or mental health exception.<\/p>\n<p>Telling voters that Virginia will retain the ability to \u201crestrict\u201d third-trimester abortions is at best misleading.<\/p>\n<h2><strong>What About Women Coerced Into Abortions?<\/strong><\/h2>\n<p>There is another side of \u201creproductive freedom\u201d that deserves attention \u2014 abortion coercion.<\/p>\n<p>There have been numerous <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/feb\/08\/texas-man-sentenced-pregnant-wife-abortion-drug\" target=\"_blank\" rel=\"noreferrer noopener\">criminal cases<\/a> involving men who allegedly obtained abortion drugs and secretly administered them to pregnant women who wanted to carry their children. Abuse and coercion can also occur when a boyfriend, husband, trafficker, or the adult responsible for a minor\u2019s pregnancy pressures her to obtain an abortion.<\/p>\n<p>This should raise serious questions. How will Virginia determine whether a frightened minor is acting voluntarily? Will existing abuse reporting requirements for medical providers remain fully enforceable when they intersect with the potential new constitutional right? What happens when an adult who arranged or transported a minor for an abortion claims constitutional protection for assisting her? And will Virginia retain sufficient authority to investigate whether an abortion is being used to conceal abuse, statutory rape, or trafficking?<\/p>\n<p>The amendment does not answer those questions.<\/p>\n<h2><strong>The Right to Life Is Worth Defending<\/strong><\/h2>\n<p>The abortion industry has not stopped pursuing its objectives since <em>Dobbs<\/em>. It has changed strategies. We have seen expanded chemical abortion, interstate distribution of abortion drugs, litigation against pro-life laws, and efforts to establish broader abortion rights at the state level.<\/p>\n<p>The Virginia constitutional amendment question is another one of those battlegrounds.<\/p>\n<p><em>Take action with the ACLJ.
