The case involves a directive by Judge Brian Murphy,a Biden-appointed judge,who sought to prevent the deportation of illegal aliens to third countries not of their origin. The Trump administration has <a href=\"https:\/\/amzn.to\/3YuVZYV\" >filed multiple emergency requests<\/a> to the Supreme Court, arguing that Murphy\u2019s orders are legally flawed and that enforcement of the policy should continue. Despite the Supreme Court\u2019s previous rulings favoring the administration, Murphy issued further rulings resisting those decisions, prompting strong criticism from Justice Elena Kagan. The case continues to escalate,with the administration asserting that Murphy\u2019s latest order is unjustified and requesting a stay of the lower court ruling. Justice Ketanji Brown Jackson has ordered responses from respondents by the upcoming Monday. The Biden appointee\u2019s directive seeks to block the government\u2019s deportation of illegal aliens to third countries (aka countries not of their national origin). <\/p>\n<div id=\"fdrlst__b89e9-3500228259\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">As noted by U.S. Solicitor General John Sauer, this is the \u201cthird time the government has been forced to seek emergency relief\u201d from SCOTUS in this case. The first instance occurred last year, when the high court <a href=\"https:\/\/thefederalist.com\/2025\/06\/24\/scotus-agrees-trump-admin-can-carry-out-third-country-deportations\/\" target=\"_blank\" rel=\"noreferrer noopener\">paused<\/a> (6-3) Murphy\u2019s preliminary injunction blocking third-country deportations. <\/p>\n<p class=\"wp-block-paragraph\">Not to be outdone, Murphy issued a directive to the federal government hours later, <a href=\"https:\/\/thefederalist.com\/2025\/06\/24\/rogue-federal-judge-openly-defies-supreme-court-ruling-on-deportation-of-violent-criminal-illegals\/\" target=\"_blank\" rel=\"noreferrer noopener\">claiming<\/a> that his initial hold on the policy was not affected by the Supreme Court\u2019s ruling. The administration subsequently asked the high court to clarify its order. This time, in a 7-2 decision, the justices affirmed that its ruling did, in fact, cover Murphy\u2019s initial injunction.<\/p>\n<p class=\"wp-block-paragraph\">Murphy\u2019s insubordination and refusal to follow SCOTUS prompted a stinging rebuke from Justice Elena Kagan. In a statement <a href=\"https:\/\/thefederalist.com\/2025\/07\/07\/if-justice-kagan-wants-respect-from-lower-courts-she-should-shut-down-their-judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">concurring<\/a> with the high court\u2019s clarification, the Obama appointee noted that while she disagreed with the Supreme Court\u2019s initial decision to block Murphy\u2019s injunction, she does \u201cnot see how a district court can compel compliance with an order that this Court has stayed.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Murphy would go on to issue a <a href=\"https:\/\/www.cbsnews.com\/news\/judge-third-country-deportations-trump-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">final judgement<\/a> blocking third-country deportations in February. While the 1st Circuit Court of Appeals <a href=\"https:\/\/thefederalist.com\/2026\/03\/12\/1st-circuit-halts-rogue-judges-bid-to-stop-trumps-third-country-deportations\/\" target=\"_blank\" rel=\"noreferrer noopener\">initially stayed<\/a> that ruling a month later, the appellate court <a href=\"https:\/\/www.scotusblog.com\/2026\/09\/trump-administration-again-urges-justices-to-allow-deportations-to-third-party-countries\/?utm_source=Iterable&#038;utm_medium=email&#038;utm_campaign=campaign_20047903\" target=\"_blank\" rel=\"noreferrer noopener\">released<\/a> a series of decisions over the past week effectively permitting the Biden appointee\u2019s blockade against the administration to resume. <\/p>\n<p class=\"wp-block-paragraph\">In its application to SCOTUS, the Trump administration argued that Murphy\u2019s latest order \u201crests on the same fundamentally flawed legal premises as the previous rulings, and the nominal new grounds that the lower courts added to try to buttress those prior decisions are even weaker than those that failed to sustain the originals.\u201d It further added that \u201cthe equities that supported this Court\u2019s intervention (twice) have, if anything, only grown stronger in favor of the government\u2019s continued enforcement of the challenged policy.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cA stay,\u201d the administration wrote, \u201cis thus once again warranted.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Justice Ketanji Brown Jackson \u2014 who oversees emergency applications from the 1st Circuit \u2014 has <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/26a406.html\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> respondents in the case to file a response to the government\u2019s request by 4 p.m. on Monday. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
