The case was based on a January 2025 executive order signed by former President Trump establishing DOGE to improve government efficiency, which included a termination date of July 4, 2026. The lawsuit argued that DOGE\u2019s access to the Treasury\u2019s Bureau of the Fiscal Services (BFS),responsible for federal payments and containing sensitive financial data,posed risks and violated federal law. Initially, a judge granted a preliminary injunction to block DOGE\u2019s access, but later eased restrictions with conditions for compliance. pfTrackEvent(&#039;Court Dismisses Democrat States\u2019 Lawsuit Against DOGE\u2019s Treasury Access&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">A federal judge dismissed a Democrat-led lawsuit on Wednesday challenging the Department of Government Efficiency\u2019s (DOGE) access to the Treasury Department\u2019s payment systems. <\/p>\n<p class=\"wp-block-paragraph\">In a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.636609\/gov.uscourts.nysd.636609.191.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">17-page order<\/a>, New York-based District Judge Jeannette Vargas, a Biden appointee, ruled that a legal challenge by the Empire State and other Democrat-led states against DOGE\u2019s Treasury access is <a href=\"https:\/\/www.law.cornell.edu\/wex\/moot\" target=\"_blank\" rel=\"noreferrer noopener\">moot<\/a> because the executive order establishing DOGE has since expired. The lawsuit was spearheaded by New York Attorney General <a href=\"https:\/\/thefederalist.com\/tag\/letitia-james\/\" target=\"_blank\" rel=\"noreferrer noopener\">Letitia James<\/a>, who has a history of targeting Donald Trump during his time as an individual citizen and as president.<\/p>\n<div id=\"fdrlst__b89e9-169980094\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The lawfare centers around a January 2025 <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/DCPD-202500125\/pdf\/DCPD-202500125.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> signed by Trump establishing the Elon Musk-led DOGE, which aimed to improve federal efficiency and root out agencies\u2019 waste, fraud, and abuse. The directive called for each department to assemble its own DOGE team to accomplish these objectives and included a termination date of July 4, 2026. <\/p>\n<p class=\"wp-block-paragraph\">In describing allegations from challengers\u2019 initial complaint, Vargas said that the Treasury granted its DOGE team access to the agency\u2019s Bureau of the Fiscal Services (BFS). The judge noted that BFS \u201cfunctions as the central payment clearinghouse for all payments to and from federal agencies,\u201d \u201cis responsible for providing reimbursement directly to the States for Congressionally mandated programs,\u201d and \u201cmaintains sensitive and confidential financial information, including the States\u2019 banking account numbers.\u201d<\/p>\n<p class=\"wp-block-paragraph\">James and co-plaintiffs <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/new-york-multistate-lawsuit-doge-access-personal-data-musk-rcna191302\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a> over DOGE\u2019s access to BFS in February 2025. They alleged, as described by Vargas, that the Treasury DOGE team\u2019s data access risked \u201cpotential . . . disruptions\u201d of BFS\u2019s operations and posed risks to \u201csensitive data elements\u201d and \u201csensitive IT systems.\u201d The states also claimed that these <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-shields-2200-usaid-employees-from-being-put-on-leave-washington-examiner\/\" title=\"Federal judge shields 2,200 USAID employees from being put on leave - Washington Examiner\">actions violated federal law<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">Vargas initially granted James and Co.\u2019s request to issue a preliminary injunction blocking the Treasury DOGE team from accessing the BFS system days after the states filed their challenge. The Biden appointee later softened her injunction months later, \u201cpermitt[ing]\u201d the DOGE team and related parties to access BFS, \u201cprovided that they complied with conditions that tracked the vetting, training, hiring, reporting, and mitigation procedures and protocols that [the administration] had described to the Court.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In her Wednesday ruling, Vargas determined that the Democrat states\u2019 claims regarding DOGE\u2019s BFS access to be moot because DOGE was dissolved, as specified in Trump\u2019s executive order. The Biden appointee also dismissed the states\u2019 challenge to the DOGE team\u2019s creation of an \u201cautomatic system capable of pausing federal funding otherwise due to the States,\u201d as well as their constitutional claims against the administration.<\/p>\n<p class=\"wp-block-paragraph\">\u201cFor the reasons stated herein, the Court dismisses the Access Claims as moot. The Court GRANTS the Government\u2019s motion to dismiss the remaining claims pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure,\u201d Vargas wrote. <\/p>\n<p class=\"wp-block-paragraph\">The Biden appointee concluded her ruling by ordering that the case be closed. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
