Despite claims that the law restricts medical care, experts argue it does not prevent doctors from treating complications like preeclampsia. The case of Tierra walker,a woman with multiple health issues who died in December 2024,has been used by abortion activists to allege that Texas laws contributed to her death.however, medical professionals state her care was mishandled and that her death resulted from medical negligence rather than the law itself. The lawsuit also criticizes Texas officials for creating a climate of fear among healthcare providers. Critics highlight that the law provides protections for emergency situations and that physicians have guidelines allowing intervention before imminent death. The case has been politically charged, with opponents blaming pro-life laws and lawmakers like Ken Paxton, but experts emphasize that proper medical care, not the law, was the key factor in Walker\u2019s outcome.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Five years ago, a Texas law that effectively banned abortion beyond six weeks gestation went into effect. Despite <a href=\"https:\/\/thefederalist.com\/2021\/09\/28\/the-texas-heartbeat-act-is-saving-100-babies-lives-every-single-day\/\" target=\"_blank\" rel=\"noreferrer noopener\">saving countless lives<\/a>, the statute continues to be vilified by the media and abortion activists months before midterm elections.<\/p>\n<p>The latest example comes in the form of a <a href=\"https:\/\/abortioninamerica.org\/wp-content\/uploads\/2026\/09\/Walker-Petition.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrongful death lawsuit<\/a> accusing Texas politician and medical professionals of \u201cdeliberate indifference, discrimination, and medical mistreatment\u201d that caused the \u201chorrific and tragic death\u201d of a 37-year-old San Antonio woman and her unborn baby.<\/p>\n<p>According to court filings from her family, Tierra Walker had a myriad of \u201cchronic health problems, including obesity, uncontrolled hypertension, asthma so severe she had required intubation, a seizure disorder called PNES (psychogenic nonepileptic seizures), Type 2 diabetes with hyperglycemia, gastroparesis, hyperlipidemia, and complicated prior pregnancies\u201d before she learned she was pregnant in September 2024.<\/p>\n<p>Opponents of Texas\u2019 heartbeat act claim that most women don\u2019t know they are pregnant until after a baby\u2019s heartbeat is detected. Court documents suggest that Walker, however, knew she was pregnant and already having health complications at five weeks gestation. <\/p>\n<p>For the months leading up to her December 2024 death, Walker was in and out of the hospital with complaints of seizures, nausea, vomiting, and other pain associated with high blood pressure. Doctors warned Walker was at a \u201chigh risk of death,\u201d but allegedly declined family\u2019s demands for an abortion because they did not believe pregnancy was the root cause of the pregnant woman\u2019s problems.<\/p>\n<p>The <a href=\"https:\/\/abortioninamerica.org\/wp-content\/uploads\/2026\/09\/Walker-Petition.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> accusing state officials and doctors of contributing to a \u201cpreventable death\u201d comes nearly two years after Walker\u2019s passing and a year after Pro Publica, the <a href=\"https:\/\/thefederalist.com\/2025\/05\/05\/propublica-awarded-pulitzer-after-blaming-georgia-womans-abortion-pill-death-on-pro-life-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">left-wing outlet<\/a> <a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/amber-thurman-died-from-the-abortion-pill-not-pro-life-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">known for smearing<\/a> pro-life politicians and laws, published an <a href=\"https:\/\/www.propublica.org\/article\/texas-abortion-ban-tierra-walker-preeclampsia\" target=\"_blank\" rel=\"noreferrer noopener\">article<\/a> alleging Walker died \u201cAfter She Couldn\u2019t Get an Abortion in Texas.\u201d The real rub comes just three pages into the lawsuit, when the plaintiffs suggest the Lone Star State\u2019s abortion limit is \u201cunconstitutional.\u201d<\/p>\n<p>Dr. Christina Francis, CEO of the American Association of Pro-Life Obstetricians and Gynecologists, told The Federalist that \u201cblaming Texas\u2019 law\u201d for Walker\u2019s death is \u201cnot only misplaced, but really has no basis in reality.\u201d<\/p>\n<p>\u201cMy concern with this lawsuit focusing on the Texas abortion law is that we\u2019re actually really missing the underlying root causes of what led to you know not only Tierra\u2019s health being in such poor condition at the beginning of her pregnancy, but also the the possibility of having prevented her death,\u201d she added.<\/p>\n<p>Francis was careful to note that she had not personally reviewed Walker\u2019s medical records. From the information included in the court filings, however, she identified \u201cmultiple instances where, at least from the available information, it appears that her care was just not handled appropriately.\u201d<\/p>\n<p>The autopsy included in court filings ultimately determined that Walker died on December 30, after being sent home from the hospital days before with a preeclampsia diagnosis, \u201cas a result of hypertensive cardiovascular disease with superimposed preeclampsia.\u201d Francis noted that preeclampsia can \u201cvery, very rarely, it be seen earlier\u201d than 20 weeks so \u201cif we see things prior to 20 weeks, usually those are not due to preeclampsia.\u201d<\/p>\n<p>Regardless of the timing of the preeclampsia diagnosis, the fact that Walker was discharged from the hospital multiple times \u201cis not consistent with any kind of medical standard whatsoever,\u201d Francis warned.<\/p>\n<p>The lawsuit maintains that Walker\u2019s doctors failed her by failing to give her the care she needed, but it doesn\u2019t stop there. Walker\u2019s family also blames the \u201cimmense culture of fear\u201d about abortion limits on the politicians who passed and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-state-senator-breaks-down-the-heartbeat-act-heres-how-its-enforceable\/\" title=\"... State Senator Breaks Down The ... Act: Here\u2019s How It\u2019s Enforceable\">enforce pro-life laws<\/a>. <\/p>\n<p>They specifically claim that Paxton and Texas Medical Board Executive Director Stephen Brint Carlton both \u201cimposed a merciless blanket prohibition on abortion that intimidates doctors into inaction and breeds extreme fear among Texas\u2019s medical establishment.\u201d <\/p>\n<p>In reality, it\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/06\/24\/four-years-post-dobbs-corporate-medias-abortion-fearmongering-proves-more-false-than-ever\/\" target=\"_blank\" rel=\"noreferrer noopener\">Democrats and the corporate media<\/a> who have spent the years since the Supreme Court\u2019s <em>Dobbs v. Jackson<\/em> decision deceiving Americans into believing that <a href=\"https:\/\/x.com\/DailyCaller\/status\/1541807746550571013?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cwomen will die\u201d<\/a> due to policies <a href=\"https:\/\/thefederalist.com\/2021\/09\/28\/the-texas-heartbeat-act-is-saving-100-babies-lives-every-single-day\/\" target=\"_blank\" rel=\"noreferrer noopener\">designed and proven to save lives.<\/a><\/p>\n<p>Texas\u2019 2021 heartbeat law already made exceptions for an abortion if a doctor believes \u201ca medical emergency necessitated the abortion\u201d and \u201cthe medical condition of the pregnant woman prevented compliance\u201d with the law. The Lone Star State further insulated itself in 2025 by enacting the <a href=\"https:\/\/gov.texas.gov\/news\/post\/governor-abbott-signs-life-of-the-mother-act-in-austin\" target=\"_blank\" rel=\"noreferrer noopener\">Life Of The Mother Act<\/a>, which reaffirms abortion is permitted in instances where women\u2019s lives are at risk for serious injury or death if their pregnancies continue.<\/p>\n<p>That act was explicitly designed to provide healthcare professionals <a href=\"https:\/\/gov.texas.gov\/news\/post\/governor-abbott-signs-life-of-the-mother-act-in-austin\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cwith additional clarity around Texas\u2019 pro-life laws.\u201d<\/a> Yet abortion activists, attorneys, and others consulted to commentate in corporate media stories about Walker\u2019s case continually claim that doctors are confused and hesitant to adequately treat their patients. <\/p>\n<p>\u201cFour and a half years out from the <em>Dobbs<\/em> decision, I don\u2019t know that there is any justification for any physician to to claim that they don\u2019t understand their their state\u2019s law for a number of reasons,\u201d Francis said. \u201cWe certainly have had plenty of time now for physicians to familiarize themselves if they\u2019re practicing in a state that has one of these laws. It certainly is inherent upon them to to understand their law.\u201d<\/p>\n<p>In Walker\u2019s case specifically, Francis \u201cdidn\u2019t see any clear indication in the court filing that any doctor had said to them, \u2018yes, we think that we should end her pregnancy, but we can\u2019t because of Texas\u2019s law.\u2019\u201d <\/p>\n<p>Even if that is true, Francis said it would not be a correct interpretation of Texas statute. Francis also noted that while pregnancy may have exacerbated some of Walker\u2019s conditions, her symptoms likely would not have been immediately solved if she had an abortion.<\/p>\n<p>\u201c[Walker] very clearly, especially once she had the diagnosis of preeclampsia at 20 weeks, very definitely would have qualified to have an early delivery under Texas law,\u201d Francis said.<\/p>\n<p>Francis emphasized that the Texas Medical Board in particular was \u201cvery clear in their guidance that they provided.\u201d <\/p>\n<p>\u201cThe Texas Supreme Court has already ruled that Texas law allows for doctors to intervene even when a woman isn\u2019t imminently facing death, but when she has a complication of her pregnancy that could potentially lead to her death, that that doctors can intervene. And that case, the Amanda Zurawski case was widely publicized nationwide, but certainly in the state of Texas.\u201d<\/p>\n<p>Walker\u2019s case is one of many tragedies hijacked by abortion propagandists to blame pro-life laws for the consequences of abortion and medical malpractice. None of the 50 states, including those with strict abortion limits,\u00a0prohibit doctors from <a href=\"https:\/\/thefederalist.com\/2022\/06\/29\/no-dobbs-doesnt-stop-doctors-from-treating-ectopic-pregnancies-or-miscarriages\/\" target=\"_blank\" rel=\"noreferrer noopener\">treating complications<\/a> like miscarriage, ectopic pregnancy, or preeclampsia. Yet, corporate media had no problem accusing Texas and its elected officials of indirectly killing Walker.<\/p>\n<p>The family filed the petition mere months before the statute of limitations for a wrongful death suit in Texas <a href=\"https:\/\/www.nmwlawfirm.com\/wrongful-death-statute-of-limitations-in-texas\/\" target=\"_blank\" rel=\"noreferrer noopener\">was set to expire<\/a>. Corporate media, however, used the timing of the lawsuit to target Republican Senate candidate Ken Paxton, who is named by the Walker family as a defendant and has a <a href=\"https:\/\/thefederalist.com\/2025\/08\/21\/paxton-to-abortion-pill-black-market-texas-will-not-tolerate-illegal-trafficking-of-fatal-drugs\/\" target=\"_blank\" rel=\"noreferrer noopener\">track record<\/a> of <a href=\"https:\/\/thefederalist.com\/2025\/03\/18\/3-arrested-in-texas-for-running-illegal-back-alley-abortion-ring\/\" target=\"_blank\" rel=\"noreferrer noopener\">pro-life enforcement<\/a> as Texas attorney general, just two months ahead of November midterm elections. <\/p>\n<p>Multiple outlets not only incorporated Paxton\u2019s <a href=\"https:\/\/www.salon.com\/2026\/09\/17\/tierra-walker-died-after-she-couldnt-get-an-abortion-her-family-is-suing-ken-paxton-partner\/\" target=\"_blank\" rel=\"noreferrer noopener\">name<\/a> in <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/6094214-texas-woman-family-suing-paxton\/\" target=\"_blank\" rel=\"noreferrer noopener\">their<\/a> <a href=\"https:\/\/www.houstonchronicle.com\/news\/houston-texas\/trending\/article\/tierra-walker-paxton-abortion-death-lawsuit-22434743.php\" target=\"_blank\" rel=\"noreferrer noopener\">headlines<\/a>, but also made him the featured image.<\/p>\n<figure><\/figure>\n<p>CBS concluded its article explaining the case with a quote from Tierra Walker\u2019s mother telling Paxton specifically to <a href=\"https:\/\/www.cbsnews.com\/news\/texas-abortion-death-lawsuit-tierra-walker-ken-paxton\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cgo to hell.\u201d<\/a><\/p>\n<p>\u201cThe fact that that Ken Paxton is named in the lawsuit makes it easy for political fodder. But I would certainly hope that people would not get distracted by the political fight that\u2019s going on right now, and rather look at what really was the root cause of Tierra\u2019s death. It was not the Texas law.
