Barbara<\/em> decision. That \u201cmistake[n]\u201d ruling, as Justice Samuel Alito called it, codified so-called \u201cbirthplace citizenship\u201d into the U.S. Constitution. <\/p>\n<p>The junior justice appeared for a sit-down discussion with University of Virginia Law School Professor John Jeffries Jr. to talk about her recently released book <em>Listening to the Law<\/em>. The literary work provides insight into the inner workings of the Supreme Court, such as the opinion-writing process and how justices go about interpreting the law. <\/p>\n<p>\u201cI wanted to teach both lawyers and law students and non-lawyers about the court,\u201d Barrett said. \u201cMany friends, including professors in other departments at Notre Dame when I was teaching, asked me questions about the court. Everybody was very curious, and it was the same kinds of questions that you [Jeffires] and I would take for granted \u2014 just because of our long experience in the law \u2014 that people just didn\u2019t understand how the court functioned.\u201d<\/p>\n<p>One of these core functions raised by Jeffries is the Supreme Court\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/03\/12\/heres-how-leftists-weaponize-their-anti-trump-judicial-coup-to-attack-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">emergency or interim docket<\/a>, which deals with cases still undergoing litigation in the lower courts. The Trump administration has been forced to seek relief at the docket due to the overreaching antics of rogue judges and their willingness to greenlight leftists\u2019 lawfare against the government. <\/p>\n<p>Acknowledging the change in the docket\u2019s activity, Barrett noted how \u201cpeople have different theories for why it\u2019s becoming more active.\u201d She later added that she thinks one possibility could be that \u201cwe have a lot more executive orders than we used to 20 years ago.\u201d<\/p>\n<p>Jeffries also pressed Barrett on whether she has \u201cany ideas about the source of the anxiety that pervades the judiciary.\u201d The law professor more specifically highlighted Trump and his administration\u2019s criticisms of rogue judges, as well as the president\u2019s <a href=\"https:\/\/www.foxbusiness.com\/politics\/trump-slams-supreme-court-justices-he-appointed-bad-our-country-after-tariff-ruling\" target=\"_blank\" rel=\"noreferrer noopener\">pointed<\/a> <a href=\"https:\/\/www.yahoo.com\/news\/politics\/articles\/trump-lashes-supreme-court-justices-140142780.html\" target=\"_blank\" rel=\"noreferrer noopener\">jabs<\/a> at Barrett (and her fellow Trump appointees) for siding against his policy agenda in some cases. <\/p>\n<p>\u201cDo you think that contributes to the security problem?\u201d Jeffries asked, seemingly ignoring the that the real <a href=\"https:\/\/thefederalist.com\/2026\/06\/10\/warnocks-violence-smears-against-scotus-invite-more-leftist-attacks-on-its-justices\/\" target=\"_blank\" rel=\"noreferrer noopener\">wave<\/a> of threats against SCOTUS is <a href=\"https:\/\/thefederalist.com\/2026\/07\/15\/the-real-threats-against-scotus-are-not-bipartisan-theyre-coming-from-the-left\/\" target=\"_blank\" rel=\"noreferrer noopener\">coming from the left<\/a>. <\/p>\n<p>While declining to address Trump\u2019s attacks against her, Barrett pointed to the existence of social media, and how it \u201callows to reverberate whatever thought someone is thinking that would never have been publicly said or circulated to a wide audience before.\u201d She further observed that threats to personal safety are not exclusive to the judges, but impact other public officials as well. <\/p>\n<p>\u201cWe certainly live in a time and in a climate where people are equipped to say things that I certainly wish you know that they wouldn\u2019t,\u201d Barrett said. With the rise of social media, \u201cI think public officials, including judges and justices, are more easily recognizable, which also heightens the security risk.\u201d<\/p>\n<p>Barrett and her conservative colleagues were forced to endure vile death threats from unhinged leftists following the 2022 leak of the court\u2019s <em>Dobbs<\/em> draft decision overturning <em>Roe v. Wade<\/em>. As a result, Barrett had to a wear a bulletproof vest around her children, as The Federalist\u2019s Mollie Hemingway documented in her bestselling book <em><a href=\"https:\/\/www.barnesandnoble.com\/w\/alito-mollie-hemingway\/1147952913\" target=\"_blank\" rel=\"noreferrer noopener\">Alito<\/a><\/em>.<\/p>\n<p>The junior justice recently <a href=\"https:\/\/thefederalist.com\/2026\/07\/14\/democrat-responds-to-threats-against-scotus-families-by-accusing-justices-of-taking-bribes\/\" target=\"_blank\" rel=\"noreferrer noopener\">testified<\/a> about such security issues and Supreme Court Police funding before Congress alongside Justice Elena Kagan. The hearings came shortly after an attempted swatting incident at Barrett\u2019s residence. <\/p>\n<p>Following a conversation about different methodologies and judicial interpretation, Jeffries pivoted to an ongoing issue threatening the Supreme Court\u2019s independence: court-packing. <\/p>\n<p>Since releasing its decision nuking race-based redistricting earlier this year, Democrats have revived their calls to <a href=\"https:\/\/thefederalist.com\/tag\/court-packing\/\" target=\"_blank\" rel=\"noreferrer noopener\">pack<\/a> the Supreme Court with more justices to shift the court\u2019s ideological makeup in their favor and achieve partisan outcomes in cases. Some leading Democrats have also <a href=\"https:\/\/thefederalist.com\/2026\/09\/01\/friends-dont-let-friends-vote-for-dems-gambit-to-destroy-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> for 18-year term limits that would apply retroactively. <\/p>\n<p>When pressed by Jeffries on the calls for term limits, Barrett said that she has \u201cthoughts\u201d on the subject but declined to publicly profess them. She reasoned, in part, that it could ultimately come before SCOTUS at some point in the future, and that to opine on it now would be imprudent. <\/p>\n<p>\u201cIt might come before me,\u201d Barrett said with a laugh. \u201cWhen it\u2019s a matter of active public debate [in Congress], then \u2026 I can\u2019t weigh in on that.\u201d <\/p>\n<p>One topic not raised during Thursday\u2019s discussion, however, was the Supreme Court\u2019s <em>Barbara<\/em> decision. <\/p>\n<p>Barrett was one of six justices to <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/scotus-says-babies-of-illegal-aliens-ccp-birth-tourists-are-us-citizens-because-of-magic-dirt\/\" target=\"_blank\" rel=\"noreferrer noopener\">rule<\/a> that Trump\u2019s executive order cracking down on the practice of giving U.S. citizenship to children of illegal aliens and foreign \u201cbirth tourists\u201d was unlawful. The Trump appointee went a step further by joining Chief Justice John Roberts and the liberal justices in declaring that such \u201cbirthplace citizenship\u201d is guaranteed by the 14th Amendment. <\/p>\n<p>The court\u2019s decision prompted <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/thomas-alito-in-birthplace-citizenship-ruling-john-roberts-imposes-feudal-darkness\/\" target=\"_blank\" rel=\"noreferrer noopener\">stinging dissents<\/a> from Justices Clarence Thomas (joined by Justice Neil Gorsuch) and Alito. While the former <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/scotus-says-babies-of-illegal-aliens-ccp-birth-tourists-are-us-citizens-because-of-magic-dirt\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> that the majority opinion \u201cdevalues [American] citizenship,\u201d the latter characterized it as a \u201cserious mistake.\u201d <\/p>\n<p>Barrett and her colleagues are expected to return for the Supreme Court\u2019s upcoming 2026 term in the coming weeks.
