pfTrackEvent(&#039;John Eastman Asks SCOTUS To Shut Down California\u2019s \u2018Politicized\u2019 Barfare&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">Constitutional attorney John Eastman is asking the U.S. Supreme Court to stop the California Bar\u2019s \u201cpoliticized\u201d efforts to strip him of his ability to practice law. <\/p>\n<p class=\"wp-block-paragraph\">The Claremont Institute senior fellow filed a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26-336\/423876\/20260911094527982_USSC%20Petition%20for%20Writ%20of%20Certiorari.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">petition<\/a> on Friday requesting that the high court take up and hear arguments in his case, <em><a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/26-336.html?utm_source=Iterable&#038;utm_medium=email&#038;utm_campaign=campaign_19887298\" target=\"_blank\" rel=\"noreferrer noopener\">Eastman v. State Bar of California<\/a><\/em>. The matter deals with the Golden State\u2019s recent <a href=\"https:\/\/thefederalist.com\/2026\/04\/16\/california-bar-strips-john-eastman-of-livelihood-for-representing-a-client-with-views-it-dislikes\/\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a> to strip Eastman of his law license over legal advice he gave President Trump in the latter\u2019s 2020 election challenges. <\/p>\n<div id=\"fdrlst__b89e9-330065853\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">As <a href=\"https:\/\/thefederalist.com\/2026\/04\/16\/california-bar-strips-john-eastman-of-livelihood-for-representing-a-client-with-views-it-dislikes\/\" target=\"_blank\" rel=\"noreferrer noopener\">characterized<\/a> by the left-wing <a href=\"https:\/\/www.influencewatch.org\/non-profit\/states-united-democracy-center\/\" target=\"_blank\" rel=\"noreferrer noopener\">States United Democracy Center<\/a>, the California Bar \u201calleged Eastman tried to \u2018plan, promote, and assist then-President Trump in executing a strategy, unsupported by facts or law, to overturn the legitimate results of the 2020 presidential election by obstructing the count of electoral votes of certain states.\u2019\u201d The Federalist\u2019s Brianna Lyman noted, however, that \u201cthis had nothing to do with \u2018ethics\u2019 or even \u2018crime,\u2019 and a review of the 11 charges the bar filed against Eastman shows they boil down to one thing: punishing Eastman for representing Trump and raising legitimate questions about the 2020 election results.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The California Supreme Court affirmed Eastman\u2019s disbarment in April. The decision came after the constitutional scholar was forced to endure <a href=\"https:\/\/thefederalist.com\/2023\/10\/25\/democrats-campaign-to-disbar-john-eastman-is-designed-to-criminalize-republican-election-challenges\/\" target=\"_blank\" rel=\"noreferrer noopener\">repeated antagonism<\/a> from the lower court judge tasked with overseeing his trial. <\/p>\n<p class=\"wp-block-paragraph\">In their SCOTUS petition, Eastman and his legal team argued that California \u201cdisciplined Eastman for speech at the core of the First Amendment: legal advice, constitutional advocacy, public commentary, and petitioning directed to government officials on matters of extraordinary public concern.\u201d They noted that the California Bar\u2019s Review Department \u201cacknowledged that this speech required strict scrutiny, but then failed to apply that standard\u201d in the case.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThat error,\u201d they wrote, \u201clet California collapse the essential distinction between provably false factual assertions and disputed legal opinions, treating contested constitutional advocacy as knowing dishonesty simply because State authorities disagreed with the views advanced.\u201d<\/p>\n<p class=\"wp-block-paragraph\"><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/07\/20\/john-eastman-asks-scotus-to-protect-speech-rights-of-lawyers-doing-their-jobs\/\" target=\"_blank\" rel=\"noreferrer noopener\">John Eastman Asks SCOTUS To Protect Speech Rights Of Lawyers Doing Their Jobs<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Eastman and Co. went on to highlight the ramifications such \u201cerrors\u201d could have nationwide. They argued that if state bars are permitted to \u201ctarget a lawyer\u2019s license to practice because of the side he took on behalf of a client in a hotly debated matter,\u201d then \u201clawyers will be chilled from representing unpopular clients, testing unsettled constitutional questions, or urging government actors to act on disputed grievances.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis Court should grant review and overturn the revocation of Eastman\u2019s bar license, reaffirming that while States may regulate genuine attorney misconduct, they may not use disciplinary authority to punish protected advocacy by relabeling it as professional misconduct,\u201d the petition reads. <\/p>\n<p class=\"wp-block-paragraph\">Eastman is one of several conservative attorneys targeted by the left\u2019s <a href=\"https:\/\/thefederalist.com\/tag\/barfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">barfare<\/a> machine for his 2020 election conduct. Other notable <a href=\"https:\/\/thefederalist.com\/2026\/08\/20\/leftists-wage-barfare-against-dhs-attorney-for-criticizing-rogue-judges\/\" target=\"_blank\" rel=\"noreferrer noopener\">victims<\/a> include <a href=\"https:\/\/thefederalist.com\/2026\/08\/26\/former-ags-blast-dc-bars-disciplinary-jihad-against-jeff-clark\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jeff Clark<\/a>, Rudy Giuliani, and Ken Paxton.<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court will be returning for its upcoming October 2026 term in the coming weeks.
