That attention alone, however, doesn\u2019t rectify the moral, ethical, and even national security costs that come with a largely unregulated surrogacy industry. If you want proof that the problems with third-party reproduction persist, take one look at the surrogacy news cycle over the last two weeks.<\/p>\n<p>On September 9, an Alaskan surrogate who moved to Texas to protect the baby she was carrying from the abortion his parents demanded due to a <a href=\"https:\/\/thefederalist.com\/2026\/08\/12\/weve-reached-the-infanticide-stage-of-commercial-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">treatable heart condition<\/a> asked the <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26A325\/423610\/20260909162543949_2026%2009%2009%20Emergency%20Application.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> to intervene in her <a href=\"https:\/\/thefederalist.com\/2026\/08\/17\/baby-gabriels-surrogacy-nightmare-proves-her-body-her-choice-was-always-a-lie-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">legally complicated custody battle<\/a>. Questions about whether McKenna West should have any authority on the life and care of the baby she carried for nine months continue to swirl as courts in several states attempt to sort out who gets a say over the child\u2019s treatment. <\/p>\n<p>No judicial body so far has a great answer for the situation because the legal system isn\u2019t equipped to adequately address the fact that every surrogacy arrangement, even those that seemingly end well, involves commodifying human lives and violating natural rights. <\/p>\n<p>Mere days after West filed her emergency application, CBS <a href=\"https:\/\/www.cbsnews.com\/projects\/2026\/surrogacy-abuse\/\" target=\"_blank\" rel=\"noreferrer noopener\">published an article<\/a> exposing that \u201cLoopholes and shady practices taint U.S. surrogacy industry.\u201d The report highlighted the stories of several women who were paid to gestate babies for elderly couples and foreigners who had covertly commissioned the creation and carrying of multiple children by multiple surrogates.<\/p>\n<p>The Trump administration is <a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2026\/08\/state-department-establishes-task-force-to-end-birth-tourism\" target=\"_blank\" rel=\"noreferrer noopener\">enforcing<\/a> its <a href=\"https:\/\/x.com\/TheJusticeDept\/status\/2072055062600499269?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">promises<\/a> to protect the <a href=\"http:\/\/whitehouse.gov\/presidential-actions\/2026\/08\/continuing-to-protect-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cmeaning and value of American citizenship\u201d<\/a> by targeting birth tourism schemes exploited by foreigners \u2014 <a href=\"https:\/\/thefederalist.com\/2026\/07\/17\/after-birthplace-citizenship-ruling-china-wont-need-hackers-to-meddle-in-us-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">mostly people from China<\/a>. It was documents obtained by CBS, however, that <a href=\"https:\/\/x.com\/CBSNews\/status\/2099170927837602180?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">ultimately revealed<\/a> the purchaser was none other than Chinese billionaire Xu Bo.<\/p>\n<p>Bo might be known in China for his fantasy video game empire. In America, however, he\u2019s known as the noncitizen who allegedly purchased more than 100 children (<a href=\"https:\/\/www.wsj.com\/us-news\/chinese-billionaires-surrogacy-pregnancy-7fdfc0c3\" target=\"_blank\" rel=\"noreferrer noopener\">some reports say 300<\/a>) \u2014 all of whom entitled to American citizenship after being born on U.S. soil \u2014 by exploiting our nation\u2019s birth tourism weak spots. <\/p>\n<p>The Wall Street Journal <a href=\"https:\/\/www.wsj.com\/us-news\/chinese-billionaires-surrogacy-pregnancy-7fdfc0c3\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> last year that Bo granted nannies in the U.S. care of his freshly born children because he was too busy in China to be at their births. That factoid is alarmingly reminiscent of the story of Kyla Simpson, who<a href=\"https:\/\/thefederalist.com\/2026\/07\/22\/surrogate-mom-fights-for-custody-of-babies-she-raised-after-purchaser-abandoned-them\/\" target=\"_blank\" rel=\"noreferrer noopener\"> gestated three babies<\/a>, raised them for months, and even navigated one of their deaths, after the Chinese man who commissioned their creation failed to pick them up at birth.<\/p>\n<p>Bo disputes the exact number of babies he\u2019s commissioned. Yet he\u2019s repeatedly <a href=\"https:\/\/fortune.com\/article\/chinese-billionaire-xu-bo-fathered-100-children-dozens-us-born-take-over-business\/\" target=\"_blank\" rel=\"noreferrer noopener\">insisted<\/a> that \u201chaving more children can solve all problems.\u201d <\/p>\n<p>In past social media posts, Bo publicly expressed a desire for <a href=\"https:\/\/fortune.com\/article\/chinese-billionaire-xu-bo-fathered-100-children-dozens-us-born-take-over-business\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201c50 high-quality sons\u201d<\/a> and hoped his kids will marry Elon Musk\u2019s offspring.
