The rooftops of the tall university buildings overlooking the campus quad where the conservative icon and Turning Point USA co-founder was scheduled to address thousands left him an easy target for a would-be assassin. <\/p>\n<p>A TPUSA official texted, \u201cHello Chief Long \u2014 we received this message today from a student group \u2026 \u2018there is <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/charlie-kirk-security-team-warned-university-police-about-access-to-rooftop-days-before-assassination\/\" title=\"... ... Team Warned ... Police About Access to ...top ...s Before ...\">student roof access pretty close<\/a> to where [Charlie Kirk] will be set up at Utah Valley (The SorensenStudent center has a couple of stair cases that go up to the walkways on the roof),\u2019\u201d the letter states. The official followed up, telling the chief that \u201c\u2026 it would be nice to either have a controlled access or allow one of my guys to be there as well. If possible.\u201d<\/p>\n<p>Long, according to the letter, replied, \u201cI got you covered.\u201d <\/p>\n<p>But the chief and the university failed to properly secure the outdoor venue, alleges the notice of claim, filed by Kirk\u2019s estate and his heirs \u2014 his widow, Erika, and the couple\u2019s two young children. <\/p>\n<p>The letter, which preserves the right for the Kirk family to sue, was filed with the Utah Attorney General\u2019s office on Sept. 9 \u2014\u00a0 a day before the one-year anniversary of Charlie Kirk\u2019s assassination at the hands of an accused killer who, prosecutors say, fired his gun from one of the adjacent rooftops.  <\/p>\n<p>\u201cThrough a series of stunning failures and reckless decisions, the UVU Parties created a foreseeable danger to Charlie,\u201d the notice states. \u201cThose decisions ultimately rendered Mr. Kirk helpless to the rooftop shooter in an assassination that could have been avoided had the UVU Parties only taken reasonable steps to plan and oversee a safe event\u2026\u201d <\/p>\n<p>The claim names as \u201cprospective defendants\u201d the state of Utah, the university, the Utah Valley University Police Department, the police chief, former UVU President <a href=\"https:\/\/www.sltrib.com\/news\/education\/2026\/01\/14\/utah-valley-university-president\/\" target=\"_blank\" rel=\"noreferrer noopener\">Astrid Tuminez<\/a>, and \u201cother state actors known or unknown at this time.\u201d<\/p>\n<p>UVU and its police department, not Turning Point USA, had \u201cthe power and authority to block walkways or cordon off a part of campus and limit access, excluding other students and the public to create a safe event,\u201d the claim letter charges.<\/p>\n<h2>\u2018People Want to Murder Us\u2019<\/h2>\n<p>Earlier this month, a Utah judge <a href=\"https:\/\/thefederalist.com\/2026\/09\/01\/judge-rules-tyler-robinson-will-face-trial-for-assassination-of-charlie-kirk\/\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> that 23-year-old Tyler Robinson will stand trial on charges of aggravated murder in the assassination of Kirk, a national leader in the conservative movement and passionate advocate for the First Amendment, particularly on speech-policing college campuses. Robinson, who has <a href=\"https:\/\/roanoke.com\/news\/nation-world\/crime-courts\/article_28656980-22f4-580e-b419-fe3a21b25df2.html\" target=\"_blank\" rel=\"noreferrer noopener\">pleaded not guilty<\/a> to the charges, faces the death penalty. <\/p>\n<p>Prosecutors say <a href=\"https:\/\/www.youtube.com\/shorts\/VByQNvpjN-Y\" target=\"_blank\" rel=\"noreferrer noopener\">surveillance video<\/a> shows Robinson rolling onto the railing on top of UVU\u2019s <a href=\"https:\/\/www.foxnews.com\/politics\/what-know-about-utah-valley-universitys-losee-center-shooters-possible-sniper-perch-charlie-kirk-killing\" target=\"_blank\" rel=\"noreferrer noopener\">Losee Building<\/a> after noon local time on Sept. 10, 2025. It was there, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-details-emerge-about-what-police-allegedly-found-in-the-room-of-foo-fighters-taylor-hawkins-report\/\" title=\"New Details Emerge About What Police Allegedly Found In The Room Of Foo Fighters\u2019 Taylor Hawkins: Report\">law enforcement officials allege<\/a>, that Robinson fired off a single rifle shot, striking Kirk in the neck while he was speaking.  <\/p>\n<p>The accused, a <a href=\"https:\/\/nypost.com\/2025\/09\/14\/us-news\/charlie-kirk-assassination-suspect-had-furry-fixation-trans-boyfriend-proclaimed-support-for-bidden\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfurry fixated\u201d<\/a> leftist whose alleged lover was a <a href=\"https:\/\/nypost.com\/2026\/09\/10\/us-news\/inside-look-at-how-tyler-robinson-could-face-ultimate-gruesome-death-over-murder-of-turning-point-usas-charlie-kirk\/\" target=\"_blank\" rel=\"noreferrer noopener\">man pretending to be a woman<\/a>, allegedly shot Kirk because he hated the Turning Point USA co-founder\u2019s conservative\u2019s point of view and the wide influence he held, particularly among the hundreds of thousands of young Americans involved in Turning Point. <\/p>\n<p>As the notice of claim letter notes, Kirk had within less than a decade built the largest conservative campus and youth activist organizations in America. His social media footprint was massive, and his \u201cpolitical star was just rising.\u201d He was a friend and adviser to President Donald Trump, Vice President J.D. Vance, and many other powerful Republicans. <\/p>\n<p>He was also loathed by a left that has grown increasingly radical and violent in the Trump age. <\/p>\n<p>The claim notes that the university and campus law enforcement failed to keep top of mind the constant threat of violence Kirk faced. At a \u201cFreedom Night In America\u201d event a few months before he died, Kirk <a href=\"https:\/\/abcnews.com\/US\/charlie-kirk-spoke-publicly-receiving-death-threats-time\/story?id=125476056\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> that Americans \u201cshould not have to walk around with security for your entire family and for myself just because you support a politician or political candidate or certain values.\u201d He talked about how he and his family \u201cget death threats \u2014 people want to murder us.\u201d<\/p>\n<p>The year before Kirk\u2019s assassination, Trump, the Republican nominee for president, was shot by a gunman at a political rally in Butler, Pennsylvania. <\/p>\n<h2>\u2018Kirk\u2019s Tragic Death Could Have Been Avoided\u2019<\/h2>\n<p>According to the notice of claim, the university assigned \u201conly six campus police officers,\u201d or a quarter of the full UVU police force to the outdoor event attended by about 3,000 people. Long had sought approval for more officers from Tuminez, UVU\u2019s president at the time, but his request was denied, the notice states. <\/p>\n<p>\u201cFurther, the UVU Parties failed to ask for assistance from outside police forces, such as the Orem or Provo police. The Orem Police, with whom UVU has law enforcement cooperation agreements, did not receive a call for assistance until after the assassination,\u201d the document claims. \u201cIndeed, the UVU Parties\u2019 planning was so deficient that when Mr. Kirk was shot first responders were not available and Mr. Kirk was transported to Timpanogos Regional Hospital in a private vehicle, not an ambulance.\u201d<\/p>\n<p>The university failed to take other safety measures, like creating and maintaining a secure perimeter of physical barriers around the Turning Point USA event that would have limited points of entry and exit, the letter charges. UVU officials also could have used metal detectors around campus, or even moved the event indoors to a more controllable space given the circumstances, the notice asserts. <\/p>\n<p>The letter also claims UVU officials did not monitor closed-circuit TV footage in \u201creal-time.\u201d A review of footage during Robinson\u2019s preliminary hearing showed the shooter \u201crunning across the roof\u201d of the building to a \u201csniper\u2019s nest.\u201d <\/p>\n<p>\u201cIf such footage had been monitored in real-time, Kirk\u2019s tragic death could have been avoided,\u201d the notice of claim asserts, adding that the campus police department could have used drones to secure the rooftops and sprawling venue. <\/p>\n<p>The notice alleges that the university was well aware that students had often gone up on the building\u2019s rooftop. UVU employees frequently found beer bottles and other trash there. <\/p>\n<h2>\u2018These Things, Unfortunately, They Happen\u2019<\/h2>\n<p>Long called the assassination <a href=\"https:\/\/ingest.abcnews.com\/US\/fatal-shooting-charlie-kirk-puts-utah-valley-universitys\/story?id=125474742\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ca police chief\u2019s nightmare.\u201d<\/a> UVU\u2019s top cop told ABC News that he had worked with Kirk\u2019s private security team in establishing security protocols for the outdoor event, which was Kirk\u2019s opening stop on his nationwide tour of college campuses that he billed as <a href=\"https:\/\/www.instagram.com\/p\/DN3iPAnXqRO\/\" target=\"_blank\" rel=\"noreferrer noopener\">The American Comeback Tour<\/a>.<\/p>\n<p>\u201cWe worked together. He has his team and they do this all over the country. We all know that. It\u2019s not uncommon for them. They\u2019re very comfortable on campuses. And I was coordinating with his lead security guy,\u201d Long said at a press conference on the day of Kirk\u2019s murder. He acknowledged that six campus police officers were on duty. The roster included plainclothes officers in the crowd. <\/p>\n<p>\u201cWe train for these things, and you think you have things covered, and these things, unfortunately, they happen,\u201d the police chief told reporters at the time. \u201cYou try to get your bases covered and, unfortunately, today we didn\u2019t. Because of that, we have this tragic incident.\u201d<\/p>\n<p>A witness told ABC News that she was surprised that there was \u201cno security check.\u201d <\/p>\n<p>\u201cThey didn\u2019t check us for IDs. They didn\u2019t pat us down. You just walked in,\u201d Jasmine Martinez, a mother of five, told the corporate news outlet a few days after Kirk\u2019s assassination. <\/p>\n<p>Don Mihalek, a retired senior special agent for the U.S. Secret Service and an ABC News contributor, raised the same security issues noted in the Kirk family notice of claim. He questioned the location of the stage beneath the rooftops of campus buildings, particularly in light of the rooftop killer who fatally shot an attendee, injured two others, and grazed Trump\u2019s ear at the Pennsylvania rally. <\/p>\n<p>\u201cIn my view, in this day and age, you can\u2019t not do proper advanced planning for an event, especially an outdoor event, and take into account all the standard security measures for an event,\u201d Mihalek <a href=\"https:\/\/ingest.abcnews.com\/US\/fatal-shooting-charlie-kirk-puts-utah-valley-universitys\/story?id=125474742\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in the story. <\/p>\n<p>Robert Boyce, the retired chief of detectives for the New York Police Department and an ABC News contributor, agreed. <\/p>\n<p>\u201cFor a controversial person speaking in any way, with any kind of petition, any outside threats we don\u2019t know right now, you really can\u2019t have it outside,\u201d Boyce <a href=\"https:\/\/ingest.abcnews.com\/US\/fatal-shooting-charlie-kirk-puts-utah-valley-universitys\/story?id=125474742\" target=\"_blank\" rel=\"noreferrer noopener\">told <\/a>the outlet. \u201cYou have to have a door to control and that\u2019s important, especially in these times.\u201d<\/p>\n<p>A university official declined to comment at the time when contacted by ABC News. <\/p>\n<h2>\u2018Entirely Preventable\u2019<\/h2>\n<p>UVU <a href=\"https:\/\/www.uvu.edu\/news\/2025\/uvu-initiating-comprehensive-review.html\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> on September 22, 2025 that it would hire an independent company to conduct a review of its planning for Kirk\u2019s event, including security measures. The university selected security consulting company The Lake Forest Group to conduct the review. It also tapped law firm Brownstein Hyatt Farber Schreck to assist. The <a href=\"https:\/\/www.sltrib.com\/news\/education\/2026\/09\/09\/year-more-than-242k-later-uvu\/\" target=\"_blank\" rel=\"noreferrer noopener\">request for proposal<\/a>, issued last November and closed on Dec. 8, called for the review to include and assessment of \u201cthe university\u2019s security and emergency preparation &#038; response protocols and execution on September 10, 2025,\u201d and set a completion deadline of \u201clate spring 2026.\u201d<\/p>\n<p>A year after the infamous day, the university has yet to release the report, <a href=\"https:\/\/www.sltrib.com\/news\/education\/2026\/09\/09\/year-more-than-242k-later-uvu\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a> the Salt Lake Tribune. UVU\u2019s new president, Jon Anderson, told the publication the consultants wanted the review \u201cto be as complete and correct as possible, rather than fast.\u201d <\/p>\n<p>The university has spent <a href=\"https:\/\/www.sltrib.com\/news\/education\/2026\/09\/09\/year-more-than-242k-later-uvu\/\" target=\"_blank\" rel=\"noreferrer noopener\">at least $240,000<\/a> on the delayed report thus far. <\/p>\n<p>Brett Parkinson, an attorney representing the Kirk Family, said the conservative icon\u2019s murder was \u201centirely preventable\u201d and would not have happened had the State of Utah and UVU \u201cfollowed through on their stated security promises, which included protecting the rooftops surrounding the quad where Charlie was speaking.\u201d<\/p>\n<p>\u201cThose failures not only robbed Charlie Kirk of his life, but also robbed his family of their husband, father, son, and brother, with impacts that will compound for the rest of their lives,\u201d Parkinson said in a statement. <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
