New York City, the city\u2019s law department waived its right to file a response, the Daily Caller <a href=\"https:\/\/dailycaller.com\/2026\/09\/14\/blue-city-ordered-to-respond-to-petition-over-stun-gun-ban\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>The Court was not finished. It directed New York to answer the petition by Oct. 8.<\/p>\n<p>A request for a response does not mean the justices will hear the case. It does mean at least some of them want a brief.<\/p>\n<p>\u201cFrankly we\u2019ve been disappointed by New York City\u2019s continued defense of its unconstitutional stun gun ban, and we\u2019re hopeful that the Supreme Court takes up the issue,\u201d SAF\u2019s Bill Sack told the Daily Caller News Foundation.<\/p>\n<p>Petitioners said the case is \u201cCaetano 2.0.\u201d<\/p>\n<p>In <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/577\/411\/\" target=\"_blank\" rel=\"noopener\">Caetano v. Massachusetts<\/a>, the Supreme Court in 2016 unanimously vacated a state ban on stun guns. The per curiam opinion repeated that the Second Amendment covers \u201cbearable arms,\u201d including weapons that did not exist in 1791.<\/p>\n<p>Justice Samuel Alito, joined by Justice Clarence Thomas, <a href=\"https:\/\/www.google.com\/goto?url=CAEShwEB6zswFVeeoyuLSVYmKQodg9ytnTwfrEEWesQ5oXxht9EWuAg_PUjDptkUvS5u6gwqGK7VL9fn-r-ZWSOtTWFp9_J3NqHNAOH836bH2EaZO_CqhJFOIbZxZRL6Oo9GjHkJg0jlBuvPvXBbIOKPJPSetWTP3imX780ZiW1I7lkZItxUy21_bYs\" target=\"_blank\" rel=\"noopener\">wrote<\/a> that stun guns are widely owned for self-defense and that a categorical ban violates the Second Amendment.<\/p>\n<p>New York still <a href=\"https:\/\/www.law.com\/newyorklawjournal\/2026\/04\/13\/nycs-ban-on-stun-guns-tasers-is-upheld-by-federal-appeals-court\/?slreturn=20260914215203\" target=\"_blank\" rel=\"noopener\">forbids<\/a> civilian possession of stun guns and Tasers, including for people who hold carry permits, the groups say.<\/p>\n<p>A 2019 order blocked the statewide ban. The city kept its own.<\/p>\n<p>Plaintiff Nunzio Calce and others, including a woman the petition says displayed a stun gun while fending off an assault, argue that the Second Circuit demanded they prove electronic arms are \u201cin common use\u201d before the Second Amendment even applies.<\/p>\n<p>They say that test contradicts Heller, Bruen, and Caetano.<\/p>\n<p>Jonathan Turley noted the order and the 2016 stun-gun ruling.
