Circuit panel of judges ruled Tuesday that a data-sharing agreement between the IRS and Immigration and Customs Enforcement to crack down on illegal aliens is illegal, <a href=\"https:\/\/www.courthousenews.com\/dc-circuit-rules-irs-data-sharing-plan-with-ice-unlawful\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to Courthouse News.<\/p>\n<p>The three-judge panel, all Obama appointees, upheld another federal judge\u2019s decision to stay the IRS from disclosing more addresses to ICE after it had already given the agency 47,000 records.<\/p>\n<p>U.S. Circuit Judge Cornelia Pillard, who wrote the court\u2019s 32-page opinion, was criticized for using the term \u201cweak sauce\u201d when describing the IRS\u2019 argument. The term is slang for something with no substance or foundation.<\/p>\n<p>\u201cThe IRS also asserts that the preliminary injunction is \u2018highly unusual and harmful\u2019 because it requires the IRS to provide the district court with \u2018prior notice of criminal investigatory activity.&#8217;\u201d Pillard wrote in the decision. \u201cThat argument is weak sauce where the district court has permitted the IRS to file any necessary notifications \u2018under seal,\u2019 thereby shielding any criminal investigative activity from disclosure.\u201d<\/p>\n<p>William Shipley, a former DOJ prosecutor, said on social media that this verbiage was an \u201cembarrassment\u201d and will be cited in future cases, diminishing the court\u2019s credibility.<\/p>\n<p>\u201cIt\u2019s an embarrassment to the Court that 2 judges would not have told the author to change a different phrase with the same meaning,\u201d he wrote. \u201cNow that is going to be quoted\/cited in future cases and it will look sophomoric and unserious.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">It\u2019s an embarrassment to the Court that 2 judges would not have told the author to change a different phrase with the same meaning.
