It\u2019s just that the facts as presented in the courtroom, combined with the <a href=\"https:\/\/www.westernjournal.com\/lindsay-clancy-inspired-murder-hours-boy-2-found-hanging-rafter-mom-discussing-clancy-online-court-docs\/\" target=\"_blank\" rel=\"noopener\">unusual nature of Massachusetts\u2019 insanity plea statute<\/a>, made things for the panel a great deal more complex and difficult than a post and that, due to the vagaries of the trial, they <a href=\"https:\/\/www.westernjournal.com\/breaking-lindsay-clancy-judge-declares-mistrial-pending-defense-appeal\/\" target=\"_blank\" rel=\"noopener\">couldn\u2019t arrive at a verdict<\/a>.<\/p>\n<p>Massachusetts, we were reminded, not only uses the Model Penal Code <a href=\"https:\/\/www.law.cornell.edu\/wex\/model_penal_code_insanity_defense\" target=\"_blank\" rel=\"noopener\">rule<\/a>, whereby a defendant must only not have a \u201csubstantial capacity\u2026 to conform his conduct to the requirements of law,\u201d but also puts the burden of proof on the prosecution.<\/p>\n<p>The Clancy trial, observers said, presented \u2014 at least when boiled down \u2014 a Catch-22 from the prosecution\u2019s side.<\/p>\n<p>Nobody argued that Clancy wasn\u2019t mentally ill when she killed her three children in January of 2023, but the prosecution said that the mood disorders she\u2019d been diagnosed with and medicated for did not rise to the level of reducing her \u201csubstantial capacity,\u201d and that her description of a so-called \u201ccommand hallucination\u201d telling her to kill her children was not a <a href=\"https:\/\/www.westernjournal.com\/lindsay-clancy-never-showed-signs-acute-psychosis-psychiatrists\/\" target=\"_blank\" rel=\"noopener\">usual presentation of postpartum psychosis<\/a>, which her defense argued made her unable to conform her conduct to the law.<\/p>\n<p>However, by admitting that she was indeed mentally ill and tried to kill herself, the prosecution called into question whether or not Clancy was a reliable narrator of her own symptoms.<\/p>\n<p>This is indeed a conundrum. If the defense had the burden of proof with an insanity defense, <a href=\"https:\/\/www.westernjournal.com\/massachusetts-inverted-burden-proof-standard-made-lindsay-clancy-guilty-verdict-incredibly-hard-deliver\/\" target=\"_blank\" rel=\"noopener\">as in most states<\/a>, things might have been different, but the law as it was presented a complex problem, one the media assured us the jury in Plymouth Superior Court was grappling with.<\/p>\n<p>As it turns out though, that wasn\u2019t really the case at all and the jury\u2019s deliberations, to hear the most vocal members among them tell the tale, were no more elevated than the <a href=\"https:\/\/www.westernjournal.com\/hollywood-actress-delivers-unhinged-lindsay-clancy-conspiracy-theory-heard-yet-women-dont-strangle\/\" target=\"_blank\" rel=\"noopener\">discourse among the toxic empaths on TikTok<\/a> who viewed Clancy as a proxy for every feminist grievance they carried.<\/p>\n<p>The latest evidence comes from an interview by CBS\u2019 Boston affiliate with an unidentified juror who said that she \u201cjust felt like the only way to get justice\u2026 was to get her the help that she desperately needed.\u201d<\/p>\n<p>\u201cSo originally, I felt as though she was guilty and she was criminally responsible,\u201d the juror said in the interview aired Wednesday by WBZ-TV.<\/p>\n<p>\u201cAnd maybe I still believe that in a certain way. I think this was a woman who, you know, she was not mentally healthy. She was someone who was in the throes of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-sues-tiktok-alleging-it-keeps-children-addicted-using-slot-machine-like-algorithm\/\" title=\"Utah sues TikTok, claims it hooks kids with addictive algorithm.\">significant mental health crisis<\/a>. So I really just felt like she was so deep in it that she couldn\u2019t see her way out. And so, this was the only option.\u201d<\/p>\n<p>She was then asked why she changed, especially since she had \u201cmentioned how there were so many strong personalities\u201d in the jury room.<\/p>\n<p>\u201cAt the end of the day, there was so much doubt. You know, the prosecution didn\u2019t have a figurative, you know, smoking gun,\u201d she said. \u201cThere was not a single moment throughout that presentation of that case that you could say, \u2018Oh, yep, 100 percent I\u2019m certain that she did it or she didn\u2019t do it.\u2019 There\u2019s so much gray area.\u201d<\/p>\n<p>Neither side, it\u2019s worth noting, said <a href=\"https:\/\/www.westernjournal.com\/patrick-clancy-finally-speaks-warns-conspiracy-theorists-smearing-consequences\/\" target=\"_blank\" rel=\"noopener\">there was anyone else but Lindsay Clancy<\/a> who was responsible for the murders. But why let facts get in the way? The jury apparently didn\u2019t. The question at hand was whether or not she was experiencing postpartum psychosis at the time of the killings and whether or not the highly unusual \u2014 in fact, almost <i>sui generis <\/i>\u2014 presentation it took, according to Clancy\u2019s own telling, was believable.<\/p>\n<p>That, you will not be surprised to learn, was not what the juror cared about.<\/p>\n<div class=\"firefly-embed\"> <iframe loading=\"lazy\" title=\"Full interview with Lindsay Clancy murder trial juror\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/gD7bYp-GOIE?start=244&#038;feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<p>\u201cEventually, I just felt like the only way to get justice was for Cora, Dawson, and Callan, and Patrick, and her parents, and anyone else that was closest was to get her the help that she desperately needed. And there\u2019s no way that she\u2019s getting that help [in prison],\u201d the juror said.<\/p>\n<p>So we\u2019re clear here, the deciding factor was that the only way to get justice for the three innocent children under the age of five that she killed, and to get justice for the father of those children, and for the grandparents of those children, was for Lindsay to be acquitted of murdering those children because she could get psychiatric help if they did.<\/p>\n<p>Except that, quite obviously, is not what she was asked to decide.<\/p>\n<p>No question of \u201csubstantial capacity\u201d seems to have entered into this equation, to hear this juror tell it. For that matter, the question of \u201cjustice\u201d seems to be hazy, too, considering that Clancy would be acquitted due to a transient <a href=\"https:\/\/www.westernjournal.com\/mother-1954-drowned-3-children-system-took-easy\/\" target=\"_blank\" rel=\"noopener\">psychiatric condition linked specifically to childbirth<\/a> \u2014 once her other mood disorders were medicated to the satisfaction of her doctors, there would be no legal reason why she should be detained, which is to say that she could end up serving very little time in custody for killing three children.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/watch-lindsay-clancy-jurors-accidentally-admit-made-decision-based-wrong-criteria\/\" target=\"_blank\" rel=\"noopener\">Nor was this the only evidence<\/a> of toxic sympathy for a killer on the jury that mirrored the toxic sympathy she enjoyed online, as previously mentioned.<\/p>\n<p>Consider the non-anonymous interview three female jurors carried out with another Boston-area station, WBTS-TV. In it, one juror blasted the prosecution as being \u201charsh\u201d in condemning Clancy for killing her kids and said she held it against him that \u2014 and I really don\u2019t believe I\u2019m typing these words \u2014 they didn\u2019t bring out any character witnesses in <em>support<\/em> of her.<\/p>\n<p>\u201cYou\u2019re presenting all these medical professionals, but nobody\u2019s presenting for the prosecution, a woman, a mother of three children,\u201d Kellie Farina said. \u201cWhich I guess is expected of a prosecution.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">This juror is telling you from the prosecution\u2019s opening statement that she was team free Lindsay regardless of any evidence they would produce. <a href=\"https:\/\/t.co\/HsTxl54EXA\">pic.twitter.com\/HsTxl54EXA<\/a><\/p>\n<p>\u2014 Lisa Elizabeth (@Lisaelizabeth) <a href=\"https:\/\/x.com\/Lisaelizabeth\/status\/2097498020417810468?\">September 9, 2026<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Yes, you don\u2019t say. I\u2019m sure the Clancy kids would have been entertained, too, had Lindsay not killed them.
