Despite the Missouri Legislature and Republican Governor approving a new map in September 2025 that aimed to increase Republican portrayal, efforts to implement it faced legal challenges. A court had previously ordered Missouri to use its 2025 map instead of the 2022 version for November, but Missouri officials appealed to the Supreme court, which paused the lower court&#8217;s ruling. This decision means the state&#8217;s new map will not be in effect for the upcoming elections, and Missouri voters are set to decide on the map in a referendum this November. That temporary restraining order instructed the Show Me State to use its 2025 congressional map for the November elections rather than its 2022 map. <\/p>\n<div id=\"fdrlst__b89e9-454016637\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The Missouri Legislature and GOP Gov. Mike Kehoe <a href=\"https:\/\/www.scotusblog.com\/2026\/09\/missouri-urges-supreme-court-to-allow-for-use-of-congressional-map-expected-to-aid-republicans\/\" target=\"_blank\" rel=\"noreferrer noopener\">approved<\/a> the new map in question in September 2025. It sought to move the state from a six Republican-two Democrat map to a seven Republican-one Democrat map.<\/p>\n<p class=\"wp-block-paragraph\">A group of organizers submitted signatures in support of a petition later that year to place a statewide referendum for the new maps on the state\u2019s 2026 fall ballot. Republican Secretary of State Denny Hoskins rejected the petition last month, arguing that the state constitution \u201cdoes not authorize a referendum on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utm_sourcerssutm_mediumrssutm_campaignfederal-judge-reinstates-missouris-new-election-map-after-kavanaugh-declines-to-get-involved\/\" title=\"Judge Restores Missouri&#039;s New Congressional ... For Midterms\">congressional redistricting plans passed<\/a> by the General Assembly.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Missouri Supreme Court rejected that argument in a ruling last week. In <a href=\"https:\/\/www.foxnews.com\/politics\/missouri-high-court-blocks-gop-backed-congressional-maps-ahead-midterms-trump-blasts-ridiculous-ruling\" target=\"_blank\" rel=\"noreferrer noopener\">blocking<\/a> the Show Me State from using the 2025 map for the 2026 contests, the state court ruled that \u201cthe plain language of \u2026 the Missouri Constitution authorizes a referendum as to \u2018any act of the general assembly\u2019 and no exception applies.\u201d<\/p>\n<p class=\"wp-block-paragraph\">With state ballots expected to be <a href=\"https:\/\/www.kctv5.com\/2026\/09\/08\/missouri-ballot-deadline-arrives-with-congressional-map-still-undecided\/\" target=\"_blank\" rel=\"noreferrer noopener\">finalized<\/a> on Tuesday, Hoskins and state officials filed an emergency application with SCOTUS last Friday, asking that the decision be paused. They noted how the state primaries have already been held under the new congressional map, and that the Missouri Supreme Court\u2019s ruling \u201cundoubtedly will require the winners of the Primary Election to run in dramatically different districts for the General Election.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Justice Brett Kavanaugh \u2014 who oversees applications from the 8th Circuit \u2014 denied the state\u2019s request without explanation on Tuesday. Not long after Kavanaugh\u2019s order came down, Clark issued a TRO in a separate lawsuit brought by several Missouri congressional candidates, in which he ordered Missouri to use its 2025 map. <\/p>\n<p class=\"wp-block-paragraph\">While Missouri officials indicated their willingness to follow Clark\u2019s order, left-wing challengers appealed to the 8th Circuit. The challengers later <a href=\"https:\/\/www.scotusblog.com\/2026\/09\/missouri-congressional-redistricting-dispute-returns-to-the-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">appealed<\/a> to SCOTUS after the appellate court rejected their request to stay Clark\u2019s TRO. <\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court did not provide an explanation for its Thursday decision to pause Clark\u2019s ruling. The order did not include any noted dissents.<\/p>\n<p class=\"wp-block-paragraph\">The justices said that Clark\u2019s ruling is paused \u201cpending the disposition of the appeal in the United States Court of Appeals for the Eighth Circuit and disposition of a petition for a writ of certiorari in this Court, if such a writ is timely sought.\u201d The Supreme Court\u2019s stay will terminate if a petition to SCOTUS is denied by the high court or if SCOTUS agrees to consider the matter and issue a judgment on the merits of the case.<\/p>\n<p class=\"wp-block-paragraph\">The state\u2019s new congressional map will be <a href=\"https:\/\/news.ballotpedia.org\/2026\/09\/09\/missouri-voters-to-decide-congressional-map-referendum-in-november-after-court-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">considered<\/a> by Missouri voters this November. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
