Justice Ketanji Brown Jackson was the only noted dissent to the order. The Friday ruling came months after the Supreme Court handed the National Republican Senatorial Committee <a target=\"_blank\" rel=\"noopener noreferrer\" curiam ruling Friday said the 4th Circuit did not have jurisdiction to toss out the Federal Communications Commission notice from March that said political parties and joint fundraising committees, when working in coordination with the candidate, were entitled to the favorable advertisement rates.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-1\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-1\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">\u201cThe Communications Act thus contemplates that an aggrieved party will file an application for review with the Commission, that the Commission will resolve that application by order, and that public notice of that order will issue before an aggrieved party may petition for further review in federal court,\u201d the justices\u2019 unsigned order said. \u201cBecause the candidates\u2019 application for review was pending when they filed their petition for review, the Fourth Circuit likely lacked statutory jurisdiction to address their challenge.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The majority also found that the ruling should be stayed because Republican campaign committees would face irreparable harm while legal challenges to the public notice continue, pointing to the higher advertisement rates they would have to pay for campaign advertisements for the midterm elections if the Supreme Court did not intervene.<\/p>\n<p class=\"wp-block-paragraph\">\u201cCurrent and future recissions will require the party committees to pay more for advertising space, thereby hampering their efforts to reach the electorate in the critical weeks leading up to the midterms,\u201d the per curiam ruling reads. \u201cThat injury, which implicates their First Amendment rights to speak and coordinate their political activities freely cannot be remedied after the fact through refunds or reimbursements.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div Republican campaign arms did not appear likely to succeed on the merits in their claims that the 4th Circuit lacked jurisdiction to make the ruling.<\/p>\n<p class=\"wp-block-paragraph\">The ruling will also allow Democratic Party campaign arms and Democrat-aligned joint fundraising committees, working in coordination with Democratic candidates, to access the lower \u201ccandidate rate\u201d for advertisement buys, but it is a more significant win for Republicans because of the GOP\u2019s massive cash advantage at the party level.<\/p>\n<p class=\"wp-block-paragraph\">The RNC has <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4709812\/house-gop-flexes-campaign-cash-advantage-after-supreme-court-ruling\/\">significantly more money<\/a> than the DNC heading into the hotly contested midterm elections, while Democratic candidates have individually outraised Republican candidates in many of the most hotly contested races.
