Justice Ketanji Brown Jackson was the lone dissenter in the case.<\/p>\n<p class=\"wp-block-paragraph\">In its <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/26a274_l537.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">per curiam ruling<\/a>, the high court granted an emergency application filed by the National Republican Congressional Committee (NRCC) and National Republican Senatorial Committee (NRSC) to temporarily stay last week\u2019s decision by the 4th Circuit Court of Appeals. In that order, a three-judge panel (2-1) <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2026\/08\/low-price-election-ads.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that only candidates qualify for the low-cost rates \u2014 not \u201cpolitical parties nor joint fundraising committees.\u201d<\/p>\n<div id=\"fdrlst__b89e9-2753464513\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">According to <a href=\"https:\/\/www.courthousenews.com\/republicans-bring-tv-ad-rate-war-to-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Courthouse News<\/a>, \u201cThe lowest unit charge requirements allow legally qualified candidates to purchase campaign advertising on broadcast television and radio networks at cheaper rates than outside groups.\u201d The Federal Communications Commission\u2019s media bureau issued a public notice in March \u201cstating that political party committees and joint fundraising committees also qualified for the discount.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The new rules were subsequently challenged by several Democrat congressional candidates, including Senate Democrat candidates Roy Cooper (North Carolina) and Sen. Jon Ossoff (Georgia). The Democrat challengers alleged that the guidance \u201ccould have advantaged Republicans, whose party committees tend to raise more money than individual candidates,\u201d as described by Courthouse News. <\/p>\n<p class=\"wp-block-paragraph\">The NRCC and NRSC subsequently filed their emergency application <a href=\"https:\/\/www.law.cornell.edu\/rules\/supct\/rule_16\" target=\"_blank\" rel=\"noreferrer noopener\">pending disposition of a petition for writ of certiorari<\/a> at SCOTUS. In asking the high court to halt the lower court\u2019s ruling, they <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26A274\/422424\/20260828185340935_Brown%20v.%20FCC%20-%20Emergency%20Stay%20Application.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> that the 4th Circuit \u201clacked jurisdiction to review and vacate interpretive guidance that is neither agency action, nor final.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court tentatively agreed with that reasoning. <\/p>\n<p class=\"wp-block-paragraph\">After describing the requirements for obtaining the sought-after relief, the high court noted how the Communications Act \u201cmakes clear that an aggrieved party must wait for the Commission to resolve its application for review by order before filing a petition for judicial review.\u201d The majority underscored that, \u201c[b]ecause the candidates\u2019 application for review was pending when they filed their petition for review,\u201d the 4th Circuit Court \u201clikely lacked statutory jurisdiction to address their challenge.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The 4th Circuit\u2019s \u201cholding to the contrary splits with every other Circuit to have considered the issue,\u201d the court ruled.<\/p>\n<p class=\"wp-block-paragraph\">The justices went on to note that the GOP appellees demonstrated that they are likely to suffer \u201cirreparable harm\u201d if the 4th Circuit\u2019s injunction is permitted to remain in place throughout litigation. They specifically acknowledged how \u201cbroadcasters are already rescinding favorable rates\u201d in response to the 4th Circuit\u2019s ruling, and that \u201c[c]urrent and future recissions will require the party committees to pay more for advertising space, thereby hampering their efforts to reach the electorate in the critical weeks leading up to the midterms.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Citing a <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/scotus-smacks-down-limits-on-political-party-candidate-spending-coordination\/\" target=\"_blank\" rel=\"noreferrer noopener\">campaign finance decision<\/a> from its most recent term, the high court added that such an injury \u2014 \u201cwhich implicates their First Amendment rights to speak and coordinate their political activities freely\u201d \u2014 \u201ccannot be remedied after the fact through refunds or reimbursements.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In her uncharacteristically short dissent, Jackson said that she would deny Republicans\u2019 emergency request for relief because she believes that they \u201care not likely to succeed on the merits of their argument that the Fourth Circuit lacked statutory jurisdiction.\u201d<\/p>\n<p class=\"wp-block-paragraph\">According to Friday\u2019s ruling, the 4th Circuit\u2019s mandate is \u201crecalled and stayed pending the filing and disposition of a petition for a writ of certiorari, if such a writ is timely sought.\u201d The Supreme Court\u2019s stay will terminate if a petition to SCOTUS is denied by the high court or if SCOTUS agrees to consider the matter and issue a judgment on the merits of the case.<\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
